12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter B, Chapter 372, Transportation Code, |
---|
14 | 14 | | is amended by adding Section 372.059 to read as follows: |

15 | 15 | | Sec. 372.059. PUBLIC SCHOOL BUSES. (a) A toll project |
---|
16 | 16 | | entity may not require a school bus exempt from registration fees |
---|
17 | 17 | | under Section 502.453 to pay a toll for use of a toll project in a |
---|
18 | 18 | | county with a population of more than four million. |
---|
19 | 19 | | (b) This section does not affect the ability of a toll |
---|
20 | 20 | | project entity to adopt policies or rules regarding the use of a |
---|
21 | 21 | | toll project or managed lane of the entity, including policies or |
---|
22 | 22 | | rules prohibiting the use of the toll project or managed lane by |
---|
23 | 23 | | vehicles unable to maintain minimum designated travel speeds. |

24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
