| 7 | 7 | | relating to health benefit plan coverage of hearing aids and |

| 8 | 8 | | cochlear implants for certain individuals. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1367.253(a), Insurance Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) A health benefit plan must provide coverage for the cost |
|---|
| 13 | 13 | | of a medically necessary hearing aid or cochlear implant and |
|---|
| 14 | 14 | | related services and supplies for a covered individual who is 25 |
|---|
| 15 | 15 | | [18] years of age or younger. |
|---|
| 16 | 16 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 17 | 17 | | to a health benefit plan delivered, issued for delivery, or renewed |
|---|
| 18 | 18 | | on or after January 1, 2024. A health benefit plan delivered, |
|---|
| 19 | 19 | | issued for delivery, or renewed before January 1, 2024, is governed |
|---|
| 20 | 20 | | by the law as it existed immediately before the effective date of |
|---|
| 21 | 21 | | this Act, and that law is continued in effect for that purpose. |

| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
