55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the collection and evaluation of data related to child
88 care programs in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 302.0043, Labor Code, is amended by
1111 adding Subsections (c-2), (c-3), and (c-4) to read as follows:
1212 (c-2) The commission shall measure and evaluate the need for
1313 and availability of child care in this state. The commission shall
1414 consider:
1515 (1) the total number of places available at all child
1616 care providers in each local workforce development area categorized
1717 by:
1818 (A) subsidized and nonsubsidized places;
1919 (B) filled and unfilled places;
2020 (C) child care providers participating in the
2121 Texas Rising Star Program and child care providers not
2222 participating in the Texas Rising Star Program; and
2323 (D) for those child care providers participating
2424 in the Texas Rising Star Program, the provider's Rising Star
2525 rating;
2626 (2) the total number of children receiving child care
2727 services in each local workforce development area categorized by:
2828 (A) children receiving subsidized child care and
2929 children receiving nonsubsidized child care;
3030 (B) child care providers participating in the
3131 Texas Rising Star Program and child care providers not
3232 participating in the Texas Rising Star Program; and
3333 (C) for those child care providers participating
3434 in the Texas Rising Star Program, the provider's Rising Star
3535 rating; and
3636 (3) the total number of children on a waiting list to
3737 receive child care in each local workforce development area
3838 categorized by:
3939 (A) children waiting for a subsidized place; and
4040 (B) children waiting for a nonsubsidized place.
4141 (c-3) The commission shall to the extent possible compare
4242 the data under Subsections (c-2)(2) and (3) to ensure there are no
4343 children counted under both subdivisions.
4444 (c-4) The commission shall coordinate with the Health and
4545 Human Services Commission to acquire data required under Subsection
4646 (c-2).
4747 SECTION 2. Subchapter A, Chapter 302, Labor Code, is
4848 amended by adding Section 302.00432 to read as follows:
4949 Sec. 302.00432. DATA REPORTING PILOT PROGRAM. (a) In this
5050 section, "program" means the enhanced child care data reporting
5151 pilot program established under this section.
5252 (b) The commission shall develop and implement an enhanced
5353 child care data reporting pilot program to enhance the commission's
5454 ability to measure the need for and availability of child care in
5555 this state.
5656 (c) The commission shall partner with local workforce
5757 development boards to conduct outreach to child care providers and
5858 to recruit providers to participate in the program. The commission
5959 shall ensure that participants in the program represent
6060 geographically and demographically different areas of the state.
6161 (d) A child care provider participating in the program shall
6262 provide to the commission:
6363 (1) the total number of places available at the
6464 provider categorized by:
6565 (A) subsidized and nonsubsidized places; and
6666 (B) filled and unfilled places;
6767 (2) the size of the provider's facility in comparison
6868 to the number of places available;
6969 (3) the number of places currently available in
7070 comparison to the number of places that would be available at the
7171 provider's maximum operational capacity;
7272 (4) the total number of children on a waiting list to
7373 receive child care from the provider categorized by:
7474 (A) children waiting for a subsidized place; and
7575 (B) children waiting for a nonsubsidized place;
7676 and
7777 (5) the number of employees who left employment with
7878 the provider in the preceding year compared to the number of
7979 additional employees the provider would need to operate at maximum
8080 operational capacity.
8181 (e) The commission shall to the extent possible compare the
8282 data collected under the program to ensure that:
8383 (1) no children are counted under both the total
8484 number of children enrolled in a child care program and the total
8585 number of children on a waiting list to receive child care in a
8686 local workforce development area; and
8787 (2) no children are counted on multiple waiting lists
8888 when determining the number of children waiting for child care in a
8989 local workforce development area.
9090 (f) The commission shall sort data provided under this
9191 section by local workforce development board.
9292 (g) The commission shall work with the Health and Human
9393 Services Commission to make joint recommendations to the
9494 legislature on the development of an information technology system
9595 that allows for the regular reporting and collection of the data
9696 collected under the program statewide.
9797 (h) Not later than December 1, 2024, the commission shall
9898 provide a report to the legislature. The report must include:
9999 (1) the local workforce development boards that
100100 participated in the program;
101101 (2) the types and characteristics of child care
102102 providers in each local workforce development area that
103103 participated in the program;
104104 (3) the data collected through the program; and
105105 (4) recommendations to the legislature to improve the
106106 availability of child care in this state, including the
107107 recommendations developed under Subsection (g).
108108 (i) The commission may use any available funding to
109109 implement the program.
110110 (j) The commission shall ensure that no personally
111111 identifiable information is disclosed in the report or the program.
112112 SECTION 3. This Act takes effect September 1, 2023.
