77 relating to an acute psychiatric bed registry to list available
88 beds for the inpatient psychiatric treatment of certain
99 individuals.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle A, Title 7, Health and Safety Code, is
1212 amended by adding Chapter 535 to read as follows:
1313 CHAPTER 535. ACUTE PSYCHIATRIC BED REGISTRY IN CERTAIN COUNTIES
1414 Sec. 535.001. DEFINITION. In this chapter, "inpatient
1515 mental health facility" has the meaning assigned by Section
1616 571.003.
1717 Sec. 535.002. APPLICABILITY. This chapter applies only to
1818 counties with a population of four million or more.
1919 Sec. 535.003. DEVELOPMENT AND ADMINISTRATION OF REGISTRY.
2020 (a) The commission shall develop and administer an Internet-based
2121 and searchable acute psychiatric bed registry to collect,
2222 aggregate, and display information on available beds at inpatient
2323 mental health facilities located in a county to which this chapter
2424 applies for the inpatient psychiatric treatment of individuals.
2525 (b) For each inpatient mental health facility, the acute
2626 psychiatric bed registry must list:
2727 (1) the name and contact information of the facility;
2828 (2) the number of available beds;
2929 (3) the type of individual who may be admitted;
3030 (4) the level of security provided; and
3131 (5) any other information that may be necessary to
3232 identify appropriate beds for the inpatient psychiatric treatment
3333 of individuals.
3434 (c) The commission shall make the acute psychiatric bed
3535 registry available to law enforcement agencies, community service
3636 boards, mental health facilities, public and private residential
3737 crisis stabilization units, emergency care facilities, and
3838 emergency care providers located in a county to which this chapter
3939 applies. The commission may make the registry available to any
4040 other person the commission considers appropriate.
4141 (d) The commission may contract with any person the
4242 commission considers appropriate to develop and administer the
4343 acute psychiatric bed registry.
4444 Sec. 535.004. INPATIENT MENTAL HEALTH FACILITY
4545 REQUIREMENTS. (a) An inpatient mental health facility located in
4646 a county to which this chapter applies shall submit to the
4747 commission information for the acute psychiatric bed registry as
4848 required by the commission and review the information and confirm
4949 the information's accuracy to the commission at least once daily
5050 and whenever there is a change in bed availability at the facility.
5151 (b) An inpatient mental health facility located in a county
5252 to which this chapter applies shall designate an employee or
5353 employees as necessary to:
5454 (1) submit to the commission the information required
5555 under Subsection (a) and review the information as required by that
5656 subsection; and
5757 (2) serve as a contact for questions about the
5858 information submitted.
5959 Sec. 535.005. GIFTS, GRANTS, AND DONATIONS. The commission
6060 may accept gifts, grants, or donations from a public or private
6161 source to carry out this chapter.
6262 SECTION 2. Not later than January 1, 2024, the Health and
6363 Human Services Commission shall establish the acute psychiatric bed
6464 registry required by Chapter 535, Health and Safety Code, as added
6565 by this Act.
6666 SECTION 3. This Act takes effect September 1, 2023.
