7	7	relating to an acute psychiatric bed registry to list available
8	8	beds for the inpatient psychiatric treatment of certain
9	9	individuals.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subtitle A, Title 7, Health and Safety Code, is
12	12	amended by adding Chapter 535 to read as follows:
13	13	CHAPTER 535. ACUTE PSYCHIATRIC BED REGISTRY IN CERTAIN COUNTIES
14	14	Sec. 535.001. DEFINITION. In this chapter, "inpatient
15	15	mental health facility" has the meaning assigned by Section
16	16	571.003.
17	17	Sec. 535.002. APPLICABILITY. This chapter applies only to
18	18	counties with a population of four million or more.
19	19	Sec. 535.003. DEVELOPMENT AND ADMINISTRATION OF REGISTRY.
20	20	(a) The commission shall develop and administer an Internet-based
21	21	and searchable acute psychiatric bed registry to collect,
22	22	aggregate, and display information on available beds at inpatient
23	23	mental health facilities located in a county to which this chapter
24	24	applies for the inpatient psychiatric treatment of individuals.
25	25	(b) For each inpatient mental health facility, the acute
26	26	psychiatric bed registry must list:
27	27	(1) the name and contact information of the facility;
28	28	(2) the number of available beds;
29	29	(3) the type of individual who may be admitted;
30	30	(4) the level of security provided; and
31	31	(5) any other information that may be necessary to
32	32	identify appropriate beds for the inpatient psychiatric treatment
33	33	of individuals.
34	34	(c) The commission shall make the acute psychiatric bed
35	35	registry available to law enforcement agencies, community service
36	36	boards, mental health facilities, public and private residential
37	37	crisis stabilization units, emergency care facilities, and
38	38	emergency care providers located in a county to which this chapter
39	39	applies. The commission may make the registry available to any
40	40	other person the commission considers appropriate.
41	41	(d) The commission may contract with any person the
42	42	commission considers appropriate to develop and administer the
43	43	acute psychiatric bed registry.
44	44	Sec. 535.004. INPATIENT MENTAL HEALTH FACILITY
45	45	REQUIREMENTS. (a) An inpatient mental health facility located in
46	46	a county to which this chapter applies shall submit to the
47	47	commission information for the acute psychiatric bed registry as
48	48	required by the commission and review the information and confirm
49	49	the information's accuracy to the commission at least once daily
50	50	and whenever there is a change in bed availability at the facility.
51	51	(b) An inpatient mental health facility located in a county
52	52	to which this chapter applies shall designate an employee or
53	53	employees as necessary to:
54	54	(1) submit to the commission the information required
55	55	under Subsection (a) and review the information as required by that
56	56	subsection; and
57	57	(2) serve as a contact for questions about the
58	58	information submitted.
59	59	Sec. 535.005. GIFTS, GRANTS, AND DONATIONS. The commission
60	60	may accept gifts, grants, or donations from a public or private
61	61	source to carry out this chapter.
62	62	SECTION 2. Not later than January 1, 2024, the Health and
63	63	Human Services Commission shall establish the acute psychiatric bed
64	64	registry required by Chapter 535, Health and Safety Code, as added
65	65	by this Act.
66	66	SECTION 3. This Act takes effect September 1, 2023.
