55 relating to taxing authority of Jackson County County-Wide Drainage

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 14(a), (b), and (f), Chapter 200, Acts
99 of the 61st Legislature, Regular Session, 1969, are amended to read
1010 as follows:
1111 (a) On the approval of a majority of the electors of the
1212 District voting at an election called for that purpose, the
1313 District may levy and collect an ad valorem [a] tax at a rate of not
1414 more than 75 cents on each $100 of assessed valuation to be used to
1515 pay the principal of and interest on bonds issued by the District
1616 [district] and to pay for the operation of the District [district]
1717 and maintenance of its property.
1818 (b) Before a tax is levied under this section, the District
1919 shall hold an election in the District in the manner provided in
2020 Section 17 of this Act to approve the tax rate. The ballots for the
2121 election shall be printed to provide for voting for or against the
2222 proposition: 'The levy and collection of a tax on all property in
2323 the Jackson County County-Wide Drainage District in an amount of
2424 not more than (insert the amount prescribed by the election
2525 order, not to exceed 75 cents) [75] cents on each $100 of assessed
2626 valuation.' The proposition for the levy of the tax may be
2727 submitted at one or more [a] separate elections [election] or it may
2828 be submitted at one or more elections [an election] held for other
2929 purposes by the District. A maximum tax rate approved at an
3030 election under this subsection may be modified by the District in
3131 the same manner as provided by this section.
3232 (f) The assessor and collector of taxes for the District is
3333 entitled to a fee for the assessor and collector's [his] services of
3434 not more than one percent of the total tax collected, but not more
3535 than $10,000 [$5,000] in any one fiscal year. The board shall
3636 determine the exact amount of the fee, and the assessor and
3737 collector of taxes for the District shall deduct this fee from the
3838 tax payments made to the District. If the county tax assessor and
3939 collector is acting as assessor and collector of taxes for the
4040 District, the assessor and collector [he] shall deposit the fee
4141 paid under this subsection in the general fund of the county as a
4242 fee of office.
4343 SECTION 2. (a) The legal notice of the intention to
4444 introduce this Act, setting forth the general substance of this
4545 Act, has been published as provided by law, and the notice and a
4646 copy of this Act have been furnished to all persons, agencies,
4747 officials, or entities to which they are required to be furnished
4848 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4949 Government Code.
5050 (b) The governor, one of the required recipients, has
5151 submitted the notice and Act to the Texas Commission on
5252 Environmental Quality.
5353 (c) The Texas Commission on Environmental Quality has filed
5454 its recommendations relating to this Act with the governor, the
5555 lieutenant governor, and the speaker of the house of
5656 representatives within the required time.
5757 (d) All requirements of the constitution and laws of this
5858 state and the rules and procedures of the legislature with respect
5959 to the notice, introduction, and passage of this Act are fulfilled
6060 and accomplished.
6161 SECTION 3. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2023.
