7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Sections 14(a), (b), and (f), Chapter 200, Acts |
---|
9 | 9 | | of the 61st Legislature, Regular Session, 1969, are amended to read |
---|
10 | 10 | | as follows: |
---|
11 | 11 | | (a) On the approval of a majority of the electors of the |
---|
12 | 12 | | District voting at an election called for that purpose, the |
---|
13 | 13 | | District may levy and collect an ad valorem [a] tax at a rate of not |
---|
14 | 14 | | more than 75 cents on each $100 of assessed valuation to be used to |
---|
15 | 15 | | pay the principal of and interest on bonds issued by the District |
---|
16 | 16 | | [district] and to pay for the operation of the District [district] |
---|
17 | 17 | | and maintenance of its property. |
---|
18 | 18 | | (b) Before a tax is levied under this section, the District |
---|
19 | 19 | | shall hold an election in the District in the manner provided in |
---|
20 | 20 | | Section 17 of this Act to approve the tax rate. The ballots for the |
---|
21 | 21 | | election shall be printed to provide for voting for or against the |
---|
22 | 22 | | proposition: 'The levy and collection of a tax on all property in |
---|
23 | 23 | | the Jackson County County-Wide Drainage District in an amount of |
---|
24 | 24 | | not more than (insert the amount prescribed by the election |
---|
25 | 25 | | order, not to exceed 75 cents) [75] cents on each $100 of assessed |
---|
26 | 26 | | valuation.' The proposition for the levy of the tax may be |
---|
27 | 27 | | submitted at one or more [a] separate elections [election] or it may |
---|
28 | 28 | | be submitted at one or more elections [an election] held for other |
---|
29 | 29 | | purposes by the District. A maximum tax rate approved at an |
---|
30 | 30 | | election under this subsection may be modified by the District in |
---|
31 | 31 | | the same manner as provided by this section. |
---|
32 | 32 | | (f) The assessor and collector of taxes for the District is |
---|
33 | 33 | | entitled to a fee for the assessor and collector's [his] services of |
---|
34 | 34 | | not more than one percent of the total tax collected, but not more |
---|
35 | 35 | | than $10,000 [$5,000] in any one fiscal year. The board shall |
---|
36 | 36 | | determine the exact amount of the fee, and the assessor and |
---|
37 | 37 | | collector of taxes for the District shall deduct this fee from the |
---|
38 | 38 | | tax payments made to the District. If the county tax assessor and |
---|
39 | 39 | | collector is acting as assessor and collector of taxes for the |
---|
40 | 40 | | District, the assessor and collector [he] shall deposit the fee |
---|
41 | 41 | | paid under this subsection in the general fund of the county as a |
---|
42 | 42 | | fee of office. |
---|
43 | 43 | | SECTION 2. (a) The legal notice of the intention to |
---|
44 | 44 | | introduce this Act, setting forth the general substance of this |
---|
45 | 45 | | Act, has been published as provided by law, and the notice and a |
---|
46 | 46 | | copy of this Act have been furnished to all persons, agencies, |
---|
47 | 47 | | officials, or entities to which they are required to be furnished |
---|
48 | 48 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
49 | 49 | | Government Code. |
---|
50 | 50 | | (b) The governor, one of the required recipients, has |
---|
51 | 51 | | submitted the notice and Act to the Texas Commission on |
---|
52 | 52 | | Environmental Quality. |
---|
53 | 53 | | (c) The Texas Commission on Environmental Quality has filed |
---|
54 | 54 | | its recommendations relating to this Act with the governor, the |
---|
55 | 55 | | lieutenant governor, and the speaker of the house of |
---|
56 | 56 | | representatives within the required time. |
---|
57 | 57 | | (d) All requirements of the constitution and laws of this |
---|
58 | 58 | | state and the rules and procedures of the legislature with respect |
---|
59 | 59 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
60 | 60 | | and accomplished. |
---|
61 | 61 | | SECTION 3. This Act takes effect immediately if it receives |
---|
62 | 62 | | a vote of two-thirds of all the members elected to each house, as |
---|
63 | 63 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
64 | 64 | | Act does not receive the vote necessary for immediate effect, this |
---|
65 | 65 | | Act takes effect September 1, 2023. |
