| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 38.074, Utilities Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (c) to read as follows: |
|---|
| 12 | 12 | | (c) The rules must authorize the independent organization |
|---|
| 13 | 13 | | certified under Section 39.151 for the ERCOT power region to |
|---|
| 14 | 14 | | require that a gas utility, as defined by Section 121.001, that owns |
|---|
| 15 | 15 | | or controls a facility that is designated as critical under Section |
|---|
| 16 | 16 | | 81.073, Natural Resources Code, or that provides physical gas |
|---|
| 17 | 17 | | delivery to an electric cooperative, municipally owned utility, or |
|---|
| 18 | 18 | | power generation company provide to the independent organization |
|---|
| 19 | 19 | | information in real time about the utility's gas supply, including |
|---|
| 20 | 20 | | through telemetry or the use of a hotline. |
|---|
| 21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
