55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a reduction of the amount by which certain school
88 districts must reduce their local revenue levels in excess of
99 entitlement under the public school finance system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 48.257, Education Code, is amended by
1212 amending Subsection (a) and adding Subsection (b-1) to read as
1313 follows:
1414 (a) Subject to Subsection (b) and except as provided by
1515 Subsection (b-1), if a school district's tier one local share under
1616 Section 48.256 exceeds the district's entitlement under Section
1717 48.266(a)(1) less the district's distribution from the state
1818 available school fund, the district must reduce the district's tier
1919 one revenue level in accordance with Chapter 49 to a level not to
2020 exceed the district's entitlement under Section 48.266(a)(1) less
2121 the district's distribution from the state available school fund.
2222 (b-1) This subsection applies only to a school district to
2323 which Subsection (a) applies and that adopted a maintenance and
2424 operations tax rate for the 2022-2023 school year equal to or
2525 greater than the sum of the district's maximum compressed tax rate,
2626 as determined under Section 48.2551, and six cents.
2727 Notwithstanding Subsection (a), if, after reducing the tier one
2828 revenue level of a school district to which this subsection applies
2929 as required under Subsection (a), the maintenance and operations
3030 revenue per student in average daily attendance of the district for
3131 a school year would be less than the maintenance and operations
3232 revenue per student in average daily attendance available to the
3333 district for the 2023-2024 school year, excluding any funding
3434 provided to the district under Sections 48.278, 48.279, and 48.281,
3535 the agency shall adjust the amount of the reduction required in the
3636 district's tier one revenue level under Subsection (a) up to the
3737 amount of local funds necessary to provide the district with the
3838 amount of maintenance and operations revenue per student in average
3939 daily attendance available to the district for the 2023-2024 school
4040 year.
4141 SECTION 2. This Act takes effect September 1, 2023.
