55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to allowing a governmental body to combine multiple
88 requests submitted by separate individuals on behalf of an
99 organization for purposes of computing charges under the public
1010 information law.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 552.261(e), Government Code, is amended
1313 to read as follows:
1414 (e) Except as otherwise provided by this subsection, all
1515 requests received in one calendar day from an individual may be
1616 treated as a single request for purposes of calculating costs under
1717 this chapter. A governmental body may [not] combine multiple
1818 requests under this subsection from separate individuals who submit
1919 requests on behalf of an organization.
2020 SECTION 2. The changes in law made by this Act to Section
2121 552.261(e), Government Code, apply only to a request for
2222 information that is received by a governmental body or an officer or
2323 employee of a governmental body on or after the effective date of
2424 this Act. A request for information that was received before the
2525 effective date of this Act is governed by the law in effect on the
2626 date the request was received, and the former law is continued in
2727 effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2023.
