66 AN ACT
77 relating to the referral of certain students receiving special
88 education services to a local intellectual and developmental
99 disability authority for services or public benefits.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1212 amended by adding Section 29.025 to read as follows:
1313 Sec. 29.025. REFERRAL TO LOCAL INTELLECTUAL AND
1414 DEVELOPMENTAL DISABILITY AUTHORITY. A school district shall refer
1515 each student receiving special education services under this
1616 subchapter who has or is suspected to have an intellectual or
1717 developmental disability to a local intellectual and developmental
1818 disability authority for services or public benefits, including
1919 services under a Medicaid waiver program established under Section
2020 1915(c), Social Security Act (42 U.S.C. Section 1396n(c)).
2121 SECTION 2. This Act applies beginning with the 2023-2024
2222 school year.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2023.
