| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 29, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 29.025 to read as follows: |
|---|
| 13 | 13 | | Sec. 29.025. REFERRAL TO LOCAL INTELLECTUAL AND |
|---|
| 14 | 14 | | DEVELOPMENTAL DISABILITY AUTHORITY. A school district shall refer |
|---|
| 15 | 15 | | each student receiving special education services under this |
|---|
| 16 | 16 | | subchapter who has or is suspected to have an intellectual or |
|---|
| 17 | 17 | | developmental disability to a local intellectual and developmental |
|---|
| 18 | 18 | | disability authority for services or public benefits, including |
|---|
| 19 | 19 | | services under a Medicaid waiver program established under Section |
|---|
| 20 | 20 | | 1915(c), Social Security Act (42 U.S.C. Section 1396n(c)). |
|---|
| 21 | 21 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 22 | 22 | | school year. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
