| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 44, Education Code, is |

| 11 | 11 | | amended by adding Section 44.0081 to read as follows: |
|---|
| 12 | 12 | | Sec. 44.0081. INCLUSION OF CERTAIN LEGAL FEES IN REPORT. A |
|---|
| 13 | 13 | | school district shall include in the district's annual audit report |
|---|
| 14 | 14 | | filed under Section 44.008 as a separately itemized expense all |
|---|
| 15 | 15 | | legal fees incurred by the district in connection with providing |
|---|
| 16 | 16 | | special education services, including legal fees incurred for |
|---|
| 17 | 17 | | representation in impartial due process hearings brought under 20 |
|---|
| 18 | 18 | | U.S.C. Section 1415. |
|---|
| 19 | 19 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 20 | 20 | | to an annual audit report submitted by a school district for a |
|---|
| 21 | 21 | | fiscal year that begins on or after the effective date of this Act. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
