| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 56.407(g), Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (g) An institution may use other available sources of |
|---|
| 12 | 12 | | financial aid, other than a loan [or a Pell grant], to cover any |
|---|
| 13 | 13 | | difference in the amount of a grant under this subchapter and the |
|---|
| 14 | 14 | | actual amount of tuition and required fees at the institution. |
|---|
| 15 | 15 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 16 | 16 | | 56.407(g), Education Code, applies beginning with Texas |
|---|
| 17 | 17 | | Educational Opportunity Grants awarded for the 2024 fall semester. |
|---|
| 18 | 18 | | Grants awarded for a semester or term before the 2024 fall semester |
|---|
| 19 | 19 | | are governed by the applicable law in effect immediately before the |
|---|
| 20 | 20 | | effective date of this Act, and the former law is continued in |
|---|
| 21 | 21 | | effect for that purpose. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
