55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the enrollment, including admission and resident
88 status, of certain persons by public institutions of higher
99 education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1.002(a), Education Code, is amended to
1212 read as follows:
1313 (a) An educational institution undertaking to provide
1414 education, services, or activities to any individual within the
1515 jurisdiction or geographical boundaries of the educational
1616 institution shall provide equal opportunities to all individuals
1717 within its jurisdiction or geographical boundaries pursuant to this
1818 code except as provided by Section 51.8051.
1919 SECTION 2. Subchapter U, Chapter 51, Education Code, is
2020 amended by adding Section 51.8051 to read as follows:
2121 Sec. 51.8051. PROHIBITED ADMISSIONS. Notwithstanding any
2222 other law, an institution of higher education, as defined by
2323 Section 61.003, may not admit an applicant for admission to the
2424 institution as a student if the applicant is:
2525 (1) a citizen of China, Iran, North Korea, or Russia;
2626 or
2727 (2) not authorized under federal statute to be present
2828 in the United States.
2929 SECTION 3. Section 54.052, Education Code, is amended to
3030 read as follows:
3131 Sec. 54.052. DETERMINATION OF RESIDENT STATUS. (a)
3232 Subject to the other applicable provisions of this subchapter
3333 governing the determination of resident status, the following
3434 persons are considered residents of this state for purposes of this
3535 title:
3636 (1) a person who:
3737 (A) established a domicile in this state not
3838 later than one year before the census date of the academic term in
3939 which the person is enrolled in an institution of higher education;
4040 and
4141 (B) maintained that domicile continuously for
4242 the year preceding that census date; and
4343 (2) a dependent whose parent:
4444 (A) established a domicile in this state not
4545 later than one year before the census date of the academic term in
4646 which the dependent is enrolled in an institution of higher
4747 education; and
4848 (B) maintained that domicile continuously for
4949 the year preceding that census date[; and
5050 [(3) a person who:
5151 [(A) graduated from a public or private high
5252 school in this state or received the equivalent of a high school
5353 diploma in this state; and
5454 [(B) maintained a residence continuously in this
5555 state for:
5656 [(i) the three years preceding the date of
5757 graduation or receipt of the diploma equivalent, as applicable; and
5858 [(ii) the year preceding the census date of
5959 the academic term in which the person is enrolled in an institution
6060 of higher education].
6161 (b) For purposes of this section, the domicile of a
6262 dependent's parent is presumed to be the domicile of the dependent
6363 [unless the person establishes eligibility for resident status
6464 under Subsection (a)(3)].
6565 (c) A person who is not authorized under federal statute to
6666 be present in the United States may not be considered a resident of
6767 this state for purposes of this title.
6868 SECTION 4. Section 54.053, Education Code, is amended to
6969 read as follows:
7070 Sec. 54.053. INFORMATION REQUIRED TO ESTABLISH RESIDENT
7171 STATUS. A person shall submit the following information to an
7272 institution of higher education to establish resident status under
7373 this subchapter:
7474 (1) if the person applies for resident status under
7575 Section 54.052(a)(1):
7676 (A) a statement of the dates and length of time
7777 the person has resided in this state, as relevant to establish
7878 resident status under this subchapter; and
7979 (B) a statement by the person that the person's
8080 presence in this state for that period was for a purpose of
8181 establishing and maintaining a domicile; or
8282 (2) if the person applies for resident status under
8383 Section 54.052(a)(2):
8484 (A) a statement of the dates and length of time
8585 any parent of the person has resided in this state, as relevant to
8686 establish resident status under this subchapter; and
8787 (B) a statement by the parent or, if the parent is
8888 unable or unwilling to provide the statement, a statement by the
8989 person that the parent's presence in this state for that period was
9090 for a purpose of establishing and maintaining a domicile[; or
9191 [(3) if the person applies for resident status under
9292 Section 54.052(a)(3):
9393 [(A) a statement of the dates and length of time
9494 the person has resided in this state, as relevant to establish
9595 resident status under this subchapter; and
9696 [(B) if the person is not a citizen or permanent
9797 resident of the United States, an affidavit stating that the person
9898 will apply to become a permanent resident of the United States as
9999 soon as the person becomes eligible to apply].
100100 SECTION 5. Notwithstanding Subchapter B, Chapter 54,
101101 Education Code, a public institution of higher education in this
102102 state may, for any semester or academic term, before the beginning
103103 of that semester or academic term, reclassify as a nonresident a
104104 student previously classified as a resident of this state by the
105105 institution or another public institution of higher education in
106106 this state:
107107 (1) under Section 54.052(a)(3), Education Code, as
108108 that section existed before amendment by this Act, if the student is
109109 not otherwise eligible to be classified as a resident of this state
110110 under Subchapter B, Chapter 54, Education Code; or
111111 (2) before the enactment of Section 54.052(c),
112112 Education Code, as added by this Act, if the student is not
113113 authorized under federal statute to be present in the United
114114 States.
115115 SECTION 6. This Act takes effect September 1, 2023.
