77 relating to prohibiting the acquisition and use of certain unmanned
88 aircraft by a governmental entity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 423, Government Code, is
1111 amended to read as follows:
1212 CHAPTER 423. [USE OF] UNMANNED AIRCRAFT
1313 SECTION 2. Chapter 423, Government Code, is amended by
1414 adding Section 423.010 to read as follows:
1515 Sec. 423.010. ACQUISITION OR USE OF CERTAIN FOREIGN
1616 UNMANNED AIRCRAFT BY GOVERNMENTAL ENTITY PROHIBITED; REPORT. (a)
1717 In this section:
1818 (1) "Company" means a sole proprietorship,
1919 organization, association, corporation, partnership, joint
2020 venture, limited partnership, limited liability partnership, or
2121 limited liability company, including a wholly owned subsidiary,
2222 majority-owned subsidiary, parent company, or affiliate of those
2323 entities or business associations, that exists to make a profit.
2424 (2) "Governmental entity" means this state, a
2525 political subdivision of this state, or an agency of this state or a
2626 political subdivision of this state.
2727 (b) Except as otherwise provided by Subsection (d), a
2828 governmental entity may not acquire or use an unmanned aircraft
2929 produced by a company that the governmental entity knows or has
3030 reason to believe is:
3131 (1) owned by or the majority of stock or other
3232 ownership interest of the company is held or controlled by:
3333 (A) individuals who are citizens of China; or
3434 (B) a company or other entity, including a
3535 government entity, that is owned or controlled by citizens of or is
3636 directly controlled by the government of China; or
3737 (2) headquartered in China.
3838 (c) The prohibition described by Subsection (b) applies
3939 regardless of whether:
4040 (1) the company's or its parent company's securities
4141 are publicly traded; or
4242 (2) the company or its parent company is listed on a
4343 public stock exchange as a Chinese company.
4444 (d) A governmental entity that, before September 1, 2023,
4545 acquired, or entered into a contract or agreement to acquire, an
4646 unmanned aircraft described by Subsection (b) may continue to use
4747 the unmanned aircraft after that date, except that for each
4848 acquisition of an unmanned aircraft that is not prohibited under
4949 Subsection (b) that occurs on or after September 1, 2023, the
5050 governmental entity must discontinue use of an unmanned aircraft
5151 described by Subsection (b).
5252 (e) Not later than October 1 of each even-numbered year, a
5353 governmental entity that continues to use an unmanned aircraft as
5454 described by Subsection (d) must submit the following information
5555 for the preceding state fiscal biennium to the Department of Public
5656 Safety in the form and manner prescribed by the department:
5757 (1) the number and percentage of the governmental
5858 entity's unmanned aircraft that are described by Subsection (b);
5959 (2) the number of unmanned aircraft acquired;
6060 (3) the number and percentage of unmanned aircraft
6161 described by Subsection (b) that the governmental entity
6262 discontinued using; and
6363 (4) any other information prescribed by the
6464 department.
6565 (f) Not later than December 1 of each even-numbered year,
6666 the Department of Public Safety shall submit to the governor, the
6767 lieutenant governor, and the legislature a report summarizing the
6868 information received by the department under Subsection (e) for the
6969 preceding state fiscal biennium.
7070 SECTION 3. Section 423.010(b), Government Code, as added by
7171 this Act:
7272 (1) applies to the acquisition of an unmanned aircraft
7373 on or after the effective date of this Act, except that a contract
7474 or agreement to purchase or otherwise acquire an unmanned aircraft
7575 described by that section that is entered into before the effective
7676 date of this Act is unaffected by this Act; and
7777 (2) except as otherwise provided by Section
7878 423.010(d), as added by this Act, applies to the use of an unmanned
7979 aircraft on or after the effective date of this Act, regardless of
8080 whether the unmanned aircraft was acquired before, on, or after the
8181 effective date of this Act.
8282 SECTION 4. This Act takes effect September 1, 2023.
