55 relating to certain requirements regarding court-appointed
66 volunteer advocate programs.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 264.601, Family Code, is amended by
99 adding Subdivisions (1-a) and (1-b) to read as follows:
1010 (1-a) "Active volunteer advocate" means an individual
1111 who:
1212 (A) has been trained by a volunteer advocate
1313 program in accordance with recognized standards for volunteer
1414 advocate programs; and
1515 (B) is currently serving as a volunteer advocate
1616 on at least one child's case.
1717 (1-b) "Inactive volunteer advocate" means an
1818 individual who:
1919 (A) has been trained by a volunteer advocate
2020 program in accordance with recognized standards for volunteer
2121 advocate programs; and
2222 (B) is not currently serving as a volunteer
2323 advocate.
2424 SECTION 2. Section 264.603(a), Family Code, is amended to
2525 read as follows:
2626 (a) The commission shall contract with one statewide
2727 organization that is exempt from federal income taxation under
2828 Section 501(a), Internal Revenue Code of 1986, as an organization
2929 described by Section 501(c)(3) of that code and that is composed of
3030 individuals or groups of individuals who have expertise in the
3131 dynamics of child abuse and neglect and experience in operating
3232 volunteer advocate programs to provide training, technical
3333 assistance, and evaluation services for the benefit of local
3434 volunteer advocate programs. The contract shall:
3535 (1) include measurable goals and objectives relating
3636 to the number of:
3737 (A) active volunteer advocates in the program;
3838 [and]
3939 (B) inactive volunteer advocates in the program;
4040 and
4141 (C) children receiving services from the
4242 program; and
4343 (2) follow practices designed to ensure compliance
4444 with standards referenced in the contract.
4545 SECTION 3. Section 264.604(a), Family Code, is amended to
4646 read as follows:
4747 (a) A person is eligible for a contract under Section
4848 264.602 only if the person is a public or private nonprofit entity
4949 that operates a volunteer advocate program that:
5050 (1) uses individuals appointed as volunteer advocates
5151 or guardians ad litem by the court to provide for the needs of
5252 abused or neglected children;
5353 (2) has provided court-appointed advocacy services
5454 for at least six months;
5555 (3) provides court-appointed advocacy services for at
5656 least 10 children each month; [and]
5757 (4) has demonstrated that the program has local
5858 judicial support;
5959 (5) has adopted a grievance procedure to address
6060 complaints regarding negligence or misconduct related to a
6161 volunteer advocate's duties under Section 107.002; and
6262 (6) maintains accurate records regarding active
6363 volunteer advocates and inactive volunteer advocates under the
6464 program.
6565 SECTION 4. This Act takes effect September 1, 2023.
