A BILL TO BE ENTITLED
AN ACT
relating to the distribution of an application for a ballot to be
voted by mail.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 84.0111(a), Election Code, is amended to
read as follows:
(a) An [Except as provided by Subsection (c) or as otherwise
authorized by this code, an] officer or employee of this state or of
a political subdivision of this state may not distribute an
application form for an early voting ballot to a person who did not
request an application under Section 84.001.
SECTION 2. Section 84.0111(c), Election Code, is repealed.
SECTION 3. The changes in law made by this Act apply to an
application form for an early voting ballot distributed on or after
the effective date of this Act. The distribution of an application
form for an early voting ballot before the effective date of this
Act is governed by the law in effect on the date the application was
distributed, and the former law is continued in effect for that
purpose.
SECTION 4. This Act takes effect September 1, 2023.
