| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 201.054(e), Estates Code, is amended to |
|---|
| 8 | 8 | | read as follows: |
|---|
| 9 | 9 | | (e) For purposes of this section: |
|---|
| 10 | 10 | | (1) "Adopted [, "adopted] child" means a child: |
|---|
| 11 | 11 | | (A) [(1)] adopted through an existing or former |
|---|
| 12 | 12 | | statutory procedure; or |
|---|
| 13 | 13 | | (B) [(2)] considered by a court to be equitably |
|---|
| 14 | 14 | | adopted or adopted by acts of estoppel. |
|---|
| 15 | 15 | | (2) "Adoptive parent" means a parent: |
|---|
| 16 | 16 | | (A) who adopted a child through an existing or |
|---|
| 17 | 17 | | former statutory procedure; or |
|---|
| 18 | 18 | | (B) considered by a court to have equitably |
|---|
| 19 | 19 | | adopted a child or adopted a child by acts of estoppel. |
|---|
| 20 | 20 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 21 | 21 | | 201.054, Estates Code, applies only to the estate of a decedent who |
|---|
| 22 | 22 | | dies on or after the effective date of this Act. The estate of a |
|---|
| 23 | 23 | | decedent who dies before the effective date of this Act is governed |
|---|
| 24 | 24 | | by the law in effect on the date of the decedent's death, and the |
|---|
| 25 | 25 | | former law is continued in effect for that purpose. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2023. |
