| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Subchapter K, Chapter 2306, |
|---|
| 12 | 12 | | Government Code, is amended to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER K. [HOUSING] PROGRAMS |
|---|
| 14 | 14 | | SECTION 2. Subchapter K, Chapter 2306, Government Code, is |
|---|
| 15 | 15 | | amended by adding Section 2306.2595 to read as follows: |
|---|
| 16 | 16 | | Sec. 2306.2595. PEDESTRIAN INFRASTRUCTURE PROGRAM. (a) In |
|---|
| 17 | 17 | | this section: |
|---|
| 18 | 18 | | (1) "Grant" means financial assistance that is awarded |
|---|
| 19 | 19 | | in the form of money to a neighborhood organization for a specific |
|---|
| 20 | 20 | | purpose and that is not required to be repaid. For purposes of this |
|---|
| 21 | 21 | | section, the term includes a forgivable loan. |
|---|
| 22 | 22 | | (2) "Grant fund" means the pedestrian infrastructure |
|---|
| 23 | 23 | | grant fund. |
|---|
| 24 | 24 | | (b) The grant fund is a dedicated account in the general |
|---|
| 25 | 25 | | revenue fund and consists of: |
|---|
| 26 | 26 | | (1) appropriations of money to the grant fund by the |
|---|
| 27 | 27 | | legislature; |
|---|
| 28 | 28 | | (2) gifts, grants, including federal grants, and other |
|---|
| 29 | 29 | | donations received for the grant fund; and |
|---|
| 30 | 30 | | (3) interest earned on the investment of money in the |
|---|
| 31 | 31 | | grant fund. |
|---|
| 32 | 32 | | (c) The department shall award grants to neighborhood |
|---|
| 33 | 33 | | organizations to construct pedestrian infrastructure related to |
|---|
| 34 | 34 | | sidewalks, curbs, or pedestrian lighting. |
|---|
| 35 | 35 | | (d) The grant fund may be used by the department only to: |
|---|
| 36 | 36 | | (1) award grants under this section; and |
|---|
| 37 | 37 | | (2) administer the grant program under this section. |
|---|
| 38 | 38 | | (e) The department shall adopt rules necessary to |
|---|
| 39 | 39 | | administer this section. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2023. |
