66 AN ACT
77 relating to a grant program for municipal pedestrian infrastructure
88 administered by the Texas Department of Housing and Community
99 Affairs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Subchapter K, Chapter 2306,
1212 Government Code, is amended to read as follows:
1313 SUBCHAPTER K. [HOUSING] PROGRAMS
1414 SECTION 2. Subchapter K, Chapter 2306, Government Code, is
1515 amended by adding Section 2306.2595 to read as follows:
1616 Sec. 2306.2595. PEDESTRIAN INFRASTRUCTURE PROGRAM. (a) In
1717 this section:
1818 (1) "Grant" means financial assistance that is awarded
1919 in the form of money to a municipality for a specific purpose and
2020 that is not required to be repaid. For purposes of this section,
2121 the term includes a forgivable loan.
2222 (2) "Grant fund" means the pedestrian infrastructure
2323 grant fund.
2424 (b) The grant fund is a dedicated account in the general
2525 revenue fund and consists of:
2626 (1) appropriations of money to the grant fund by the
2727 legislature;
2828 (2) gifts, grants, including federal grants, and other
2929 donations received for the grant fund; and
3030 (3) interest earned on the investment of money in the
3131 grant fund.
3232 (c) The department shall award grants to municipalities to
3333 construct pedestrian infrastructure related to sidewalks, curbs,
3434 or pedestrian lighting.
3535 (d) The grant fund may be used by the department only to:
3636 (1) award grants under this section; and
3737 (2) administer the grant program under this section.
3838 (e) The department shall adopt rules necessary to
3939 administer this section.
4040 SECTION 3. This Act takes effect September 1, 2023.
