66 relating to the development of a severe weather adaptation plan by

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle C, Title 5, Health and Safety Code, is
1010 amended by adding Chapter 393 to read as follows:
1111 CHAPTER 393. SEVERE WEATHER PLAN
1212 Sec. 393.001. PARTICIPATING ENTITIES. Not later than
1313 September 1 of each even-numbered year, each of the following
1414 entities shall publish a severe weather adaptation plan that will
1515 assess the entity's role with respect to severe weather:
1616 (1) the Texas Division of Emergency Management;
1717 (2) the Department of Agriculture;
1818 (3) the independent organization certified under
1919 Section 39.151, Utilities Code;
2020 (4) the Texas Commission on Environmental Quality;
2121 (5) the General Land Office;
2222 (6) the Health and Human Services Commission;
2323 (7) the Texas Department of Housing and Community
2424 Affairs;
2525 (8) the Texas Department of Insurance;
2626 (9) the Parks and Wildlife Department;
2727 (10) the Department of Public Safety of the State of
2828 Texas;
2929 (11) the Public Utility Commission of Texas;
3030 (12 the office of the comptroller;
3131 (13) the Texas Department of Transportation;
3232 (14) the Texas Forest Service; and
3333 (15) the Texas Water Development Board.
3434 Sec. 393.002. PLAN. (a) For the purposes of this chapter,
3535 a severe weather adaptation plan is a strategy to identify,
3636 minimize, and adequately prepare for the effects of increased
3737 incidence and prevalence of severe weather on the social, economic,
3838 and ecological systems of this state and to manage the risks
3939 associated severe weather. A plan under this section must be based
4040 on current research-based science that identifies the likely
4141 impacts of extreme weather events on this state.
4242 (b) Each severe weather adaptation plan must include:
4343 (1) a severe weather vulnerability assessment;
4444 (2) a review of existing programs in the context of
4545 anticipated severe weather conditions;
4646 (3) specific steps necessary for the entity to fulfill
4747 its mission during the anticipated severe weather event;
4848 (4) an analysis of the effects implementing the steps
4949 identified under Subdivision (3) would have on the entity's budget
5050 during the next 2, 5, and 10 years;
5151 (5) potential sources of funding to support the
5252 entity's efforts to adapt to increased prevalence of severe
5353 weather; and
5454 (6) a statewide strategy to monitor the continuing
5555 effects of severe weather events.
5656 (c) In developing a severe weather adaptation plan, each
5757 entity subject to this section shall:
5858 (1) consult with the Houston Advanced Research Center;
5959 and
6060 (2) consult with the Office of the Texas State
6161 Climatologist in the Department of Atmospheric Sciences, College of
6262 Geosciences, Texas A&M University.
6363 (d) Not later than September 1 of each even-numbered year,
6464 each entity subject to this section shall post the entity's severe
6565 weather adaptation plan on a publicly accessible Internet website
6666 and electronically submit a copy of the plan to:
6767 (1) the governor, lieutenant governor, and speaker of
6868 the house of representatives;
6969 (2) the presiding officer of each standing committee
7070 or subcommittee of the legislature with primary jurisdiction over
7171 environmental matters; and
7272 (3) the executive director of the Texas Commission on
7373 Environmental Quality.
7474 (e) Each severe weather adaptation plan is subject to audit
7575 by the state auditor in accordance with Chapter 321, Government
7676 Code.
7777 SECTION 2. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2023.
