55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of the money in the Opioid Abatement Account.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 403.505(d), Government Code, is amended
1010 to read as follows:
1111 (d) A state agency may use money appropriated from the
1212 account only to:
1313 (1) prevent opioid use disorder through
1414 evidence-based education and prevention, such as school-based
1515 prevention, early intervention, or health care services or programs
1616 intended to reduce the risk of opioid use by school-age children;
1717 (2) support efforts to prevent or reduce deaths from
1818 opioid overdoses or other opioid-related harms, including through
1919 increasing the availability or distribution of naloxone or other
2020 opioid antagonists for use by health care providers, first
2121 responders, persons experiencing an opioid overdose, families,
2222 schools, community-based service providers, social workers, or
2323 other members of the public;
2424 (3) create and provide training on the treatment of
2525 opioid addiction, including the treatment of opioid dependence with
2626 each medication approved for that purpose by the United States Food
2727 and Drug Administration, medical detoxification, relapse
2828 prevention, patient assessment, individual treatment planning,
2929 counseling, recovery supports, diversion control, and other best
3030 practices;
3131 (4) provide opioid use disorder treatment for youths
3232 and adults, with an emphasis on programs that provide a continuum of
3333 care that includes screening and assessment for opioid use disorder
3434 and co-occurring behavioral health disorders, early intervention,
3535 contingency management, cognitive behavioral therapy, case
3636 management, relapse management, counseling services, and
3737 medication-assisted treatments;
3838 (5) provide patients suffering from opioid dependence
3939 with access to all medications approved by the United States Food
4040 and Drug Administration for the treatment of opioid dependence and
4141 relapse prevention following opioid detoxification, including
4242 opioid agonists, partial agonists, and antagonists;
4343 (6) support efforts to reduce the abuse or misuse of
4444 addictive prescription medications, including tools used to give
4545 health care providers information needed to protect the public from
4646 the harm caused by improper use of those medications;
4747 (7) support treatment alternatives that provide both
4848 psychosocial support and medication-assisted treatments in areas
4949 with geographical or transportation-related challenges, including
5050 providing access to mobile health services and telemedicine,
5151 particularly in rural areas;
5252 (8) address:
5353 (A) the needs of persons involved with criminal
5454 justice; and
5555 (B) rural county unattended deaths; [or]
5656 (9) purchase opioid antagonists in bulk from
5757 manufacturers to decrease the price burden on organizations
5858 distributing opioid antagonists to respond to opioid overdoses; or
5959 (10) further any other purpose related to opioid
6060 abatement authorized by appropriation.
6161 SECTION 2. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2023.
