55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to permissible accountability interventions for certain
88 school districts with low-performing campuses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39A.107(c), Education Code, is amended
1111 to read as follows:
1212 (c) If the commissioner does not approve a campus turnaround
1313 plan, the commissioner may [shall] order:
1414 (1) appointment of a board of managers to govern the
1515 school district as provided by Section 39A.202;
1616 (2) alternative management of the campus; or
1717 (3) closure of the campus.
1818 SECTION 2. Section 39A.111, Education Code, is amended to
1919 read as follows:
2020 Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING.
2121 If a campus is considered to have an unacceptable performance
2222 rating for five consecutive school years, the commissioner, subject
2323 to Section 39A.112, may [shall] order:
2424 (1) appointment of a board of managers to govern the
2525 school district as provided by Section 39A.202; or
2626 (2) closure of the campus.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2023.
