| 7 | 7 | | relating to permissible accountability interventions for certain |

| 8 | 8 | | school districts with low-performing campuses. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39A.107(c), Education Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (c) If the commissioner does not approve a campus turnaround |
|---|
| 13 | 13 | | plan, the commissioner may [shall] order: |
|---|
| 14 | 14 | | (1) appointment of a board of managers to govern the |
|---|
| 15 | 15 | | school district as provided by Section 39A.202; |
|---|
| 16 | 16 | | (2) alternative management of the campus; or |
|---|
| 17 | 17 | | (3) closure of the campus. |
|---|
| 18 | 18 | | SECTION 2. Section 39A.111, Education Code, is amended to |
|---|
| 19 | 19 | | read as follows: |
|---|
| 20 | 20 | | Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING. |
|---|
| 21 | 21 | | If a campus is considered to have an unacceptable performance |
|---|
| 22 | 22 | | rating for five consecutive school years, the commissioner, subject |
|---|
| 23 | 23 | | to Section 39A.112, may [shall] order: |
|---|
| 24 | 24 | | (1) appointment of a board of managers to govern the |
|---|
| 25 | 25 | | school district as provided by Section 39A.202; or |
|---|
| 26 | 26 | | (2) closure of the campus. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2023. |
