| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 361, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 361.127 to read as follows: |
|---|
| 12 | 12 | | Sec. 361.127. REQUIREMENTS APPLICABLE TO CERTAIN SOLID |
|---|
| 13 | 13 | | WASTE PROCESSING FACILITIES. (a) This section applies only to a |
|---|
| 14 | 14 | | solid waste processing facility that salvages, separates, |
|---|
| 15 | 15 | | dewaters, reclaims, or otherwise processes municipal sludge, |
|---|
| 16 | 16 | | sewage, septage, grease trap waste, or grit trap waste. |
|---|
| 17 | 17 | | (b) An owner or operator of a solid waste processing |
|---|
| 18 | 18 | | facility must have the consent of and authorization from the owner |
|---|
| 19 | 19 | | or operator of: |
|---|
| 20 | 20 | | (1) the wastewater collection system that will receive |
|---|
| 21 | 21 | | the treated wastewater produced by the processing facility; and |
|---|
| 22 | 22 | | (2) any wastewater treatment facility that will |
|---|
| 23 | 23 | | further treat the treated wastewater. |
|---|
| 24 | 24 | | (c) The commission may not issue, amend, or renew a permit |
|---|
| 25 | 25 | | under this chapter for a solid waste processing facility unless the |
|---|
| 26 | 26 | | owner or operator of the processing facility demonstrates to the |
|---|
| 27 | 27 | | commission's satisfaction that the owner or operator has complied |
|---|
| 28 | 28 | | with Subsection (b). |
|---|
| 29 | 29 | | SECTION 2. Section 361.127(c), Health and Safety Code, as |
|---|
| 30 | 30 | | added by this Act, applies only to a solid waste processing facility |
|---|
| 31 | 31 | | the owner or operator of which files an application with the Texas |
|---|
| 32 | 32 | | Commission on Environmental Quality for the issuance, amendment, or |
|---|
| 33 | 33 | | renewal of a permit on or after the effective date of this Act. A |
|---|
| 34 | 34 | | solid waste processing facility the owner or operator of which |
|---|
| 35 | 35 | | filed an application with the commission for the issuance, |
|---|
| 36 | 36 | | amendment, or renewal of a permit before the effective date of this |
|---|
| 37 | 37 | | Act is governed by the law as it existed immediately before the |
|---|
| 38 | 38 | | effective date of this Act, and that law is continued in effect for |
|---|
| 39 | 39 | | that purpose. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2023. |
