66 AN ACT
77 relating to the regulation by the Texas Commission on Environmental
88 Quality of certain solid waste processing facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 361, Health and Safety
1111 Code, is amended by adding Section 361.127 to read as follows:
1212 Sec. 361.127. REQUIREMENTS APPLICABLE TO CERTAIN SOLID
1313 WASTE PROCESSING FACILITIES. (a) This section applies only to a
1414 solid waste processing facility that salvages, separates,
1515 dewaters, reclaims, or otherwise processes municipal sludge,
1616 sewage, septage, grease trap waste, or grit trap waste.
1717 (b) An owner or operator of a solid waste processing
1818 facility must have the consent of and authorization from the owner
1919 or operator of:
2020 (1) the wastewater collection system that will receive
2121 the treated wastewater produced by the processing facility; and
2222 (2) any wastewater treatment facility that will
2323 further treat the treated wastewater.
2424 (c) The commission may not issue, amend, or renew a permit
2525 under this chapter for a solid waste processing facility unless the
2626 owner or operator of the processing facility demonstrates to the
2727 commission's satisfaction that the owner or operator has complied
2828 with Subsection (b).
2929 SECTION 2. Section 361.127(c), Health and Safety Code, as
3030 added by this Act, applies only to a solid waste processing facility
3131 the owner or operator of which files an application with the Texas
3232 Commission on Environmental Quality for the issuance, amendment, or
3333 renewal of a permit on or after the effective date of this Act. A
3434 solid waste processing facility the owner or operator of which
3535 filed an application with the commission for the issuance,
3636 amendment, or renewal of a permit before the effective date of this
3737 Act is governed by the law as it existed immediately before the
3838 effective date of this Act, and that law is continued in effect for
3939 that purpose.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2023.
