77 AN ACT
88 relating to the prosecution of the offense of possessing or
99 carrying a weapon in certain prohibited places associated with
1010 schools or educational institutions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.03(c), Penal Code, is amended by
1313 adding Subdivisions (1-a) and (4-a) to read as follows:
1414 (1-a) "Educational institution" means:
1515 (A) an institution of higher education;
1616 (B) a private or independent institution of
1717 higher education; or
1818 (C) a career school or college, as defined by
1919 Section 132.001, Education Code.
2020 (4-a) "School" means a public or private primary or
2121 secondary school.
2222 SECTION 2. The change in law made by this Act applies only
2323 to an offense committed on or after the effective date of this
2424 Act. An offense committed before the effective date of this Act is
2525 governed by the law in effect on the date the offense was committed,
2626 and the former law is continued in effect for that purpose. For
2727 purposes of this section, an offense was committed before the
2828 effective date of this Act if any element of the offense occurred
2929 before that date.
3030 SECTION 3. This Act takes effect September 1, 2023.
