55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the designation of State Highway 356 in Irving as a
88 historic highway.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 442, Government Code, is
1111 amended by adding Section 442.034 to read as follows:
1212 Sec. 442.034. STATE HIGHWAY 356 AS TEXAS HISTORIC HIGHWAY.
1313 (a) The commission shall cooperate with the Texas Department of
1414 Transportation to designate, interpret, and market the portion of
1515 State Highway 356 in the municipal limits of Irving as a Texas
1616 historic highway.
1717 (b) To supplement revenue available for the purposes under
1818 Subsection (a), the commission and the Texas Department of
1919 Transportation may pursue federal funds dedicated to highway
2020 enhancement.
2121 (c) A designation of a portion of State Highway 356 as a
2222 Texas historic highway may not be construed as a designation under
2323 the National Historic Preservation Act (54 U.S.C. Section 300101 et
2424 seq.).
2525 (d) The Texas Department of Transportation is not required
2626 to design, construct, or erect a marker under this section unless a
2727 grant or donation of funds is made to the department to cover the
2828 cost of the design, construction, and erection of the marker. Money
2929 received to cover the cost of the marker shall be deposited to the
3030 credit of the state highway fund.
3131 SECTION 2. This Act takes effect September 1, 2023.
