| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 442, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 442.034 to read as follows: |
|---|
| 12 | 12 | | Sec. 442.034. STATE HIGHWAY 356 AS TEXAS HISTORIC HIGHWAY. |
|---|
| 13 | 13 | | (a) The commission shall cooperate with the Texas Department of |
|---|
| 14 | 14 | | Transportation to designate, interpret, and market the portion of |
|---|
| 15 | 15 | | State Highway 356 in the municipal limits of Irving as a Texas |
|---|
| 16 | 16 | | historic highway. |
|---|
| 17 | 17 | | (b) To supplement revenue available for the purposes under |
|---|
| 18 | 18 | | Subsection (a), the commission and the Texas Department of |
|---|
| 19 | 19 | | Transportation may pursue federal funds dedicated to highway |
|---|
| 20 | 20 | | enhancement. |
|---|
| 21 | 21 | | (c) A designation of a portion of State Highway 356 as a |
|---|
| 22 | 22 | | Texas historic highway may not be construed as a designation under |
|---|
| 23 | 23 | | the National Historic Preservation Act (54 U.S.C. Section 300101 et |
|---|
| 24 | 24 | | seq.). |
|---|
| 25 | 25 | | (d) The Texas Department of Transportation is not required |
|---|
| 26 | 26 | | to design, construct, or erect a marker under this section unless a |
|---|
| 27 | 27 | | grant or donation of funds is made to the department to cover the |
|---|
| 28 | 28 | | cost of the design, construction, and erection of the marker. Money |
|---|
| 29 | 29 | | received to cover the cost of the marker shall be deposited to the |
|---|
| 30 | 30 | | credit of the state highway fund. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2023. |
