| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 325, Government Code, is amended by |
|---|
| 11 | 11 | | adding Section 325.026 to read as follows: |
|---|
| 12 | 12 | | Sec. 325.026. REVIEW OF SCHOOL DISTRICTS. (a) In this |
|---|
| 13 | 13 | | section, "education service center region" means a geographic |
|---|
| 14 | 14 | | region served by a regional education service center under Chapter |
|---|
| 15 | 15 | | 8, Education Code. |
|---|
| 16 | 16 | | (b) The commission shall review the operations of certain |
|---|
| 17 | 17 | | independent school districts or consolidated school districts. The |
|---|
| 18 | 18 | | commission shall review one school district each review cycle. A |
|---|
| 19 | 19 | | school district identified for review by the commission under this |
|---|
| 20 | 20 | | section is subject to the requirements of this chapter as if it were |
|---|
| 21 | 21 | | a state agency but may not be abolished. |
|---|
| 22 | 22 | | (c) Not later than January 31 of each odd-numbered year, the |
|---|
| 23 | 23 | | commission shall select an education service center region from |
|---|
| 24 | 24 | | which the school district to be reviewed will be selected. The |
|---|
| 25 | 25 | | commission shall review the school district within the selected |
|---|
| 26 | 26 | | region that has the lowest instructional spending per student |
|---|
| 27 | 27 | | according to the most recent information reported to the Texas |
|---|
| 28 | 28 | | Education Agency. |
|---|
| 29 | 29 | | (d) The commission shall prepare a report identifying areas |
|---|
| 30 | 30 | | of the district's operations that do not effectively or efficiently |
|---|
| 31 | 31 | | use the district's funds and that detract from instructional |
|---|
| 32 | 32 | | spending and make recommendations to address its findings. The |
|---|
| 33 | 33 | | commission's review may also include recommendations related to a |
|---|
| 34 | 34 | | district's governance, management, operating structure, and |
|---|
| 35 | 35 | | compliance with legislative requirements. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect September 1, 2023. |
