8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter Z, Chapter 361, Local Government |
---|
10 | 10 | | Code, is amended by adding Section 361.902 to read as follows: |

11 | 11 | | Sec. 361.902. SUICIDE PREVENTION IN MUNICIPAL JAIL. (a) A |
---|
12 | 12 | | municipal jail shall: |
---|
13 | 13 | | (1) provide two hours of training to each jailer or |
---|
14 | 14 | | person responsible for the supervision of a person confined in the |
---|
15 | 15 | | jail on the procedures for identifying, documenting, and handling a |
---|
16 | 16 | | person who is potentially suicidal or has a mental health |
---|
17 | 17 | | condition; |
---|
18 | 18 | | (2) conduct and document mental health screenings |
---|
19 | 19 | | during the intake process in accordance with the procedures adopted |
---|
20 | 20 | | by the Commission on Jail Standards for county jails; |
---|
21 | 21 | | (3) install cameras in the hall directly outside the |
---|
22 | 22 | | cell of any person who is identified as potentially suicidal; |
---|
23 | 23 | | (4) regularly check on each person confined in the |
---|
24 | 24 | | jail who is identified as potentially suicidal; and |
---|
25 | 25 | | (5) report to the attorney general, in the manner |
---|
26 | 26 | | prescribed by the attorney general, any incident involving the |
---|
27 | 27 | | suicide or attempted suicide of a person confined in the jail not |
---|
28 | 28 | | later than 48 hours after the incident. |
---|
29 | 29 | | (b) Subsection (a)(1) does not apply to a municipal jail |
---|
30 | 30 | | that requires individuals described by that subdivision to complete |
---|
31 | 31 | | a municipal jailer training or certification course as a condition |
---|
32 | 32 | | of employment. |
---|
33 | 33 | | (c) The attorney general may use the information reported |
---|
34 | 34 | | under Subsection (a)(5) only for purposes of data collection and |
---|
35 | 35 | | analysis. |
---|
36 | 36 | | SECTION 2. This Act takes effect September 1, 2023. |
