77 relating to suicide prevention in municipal jails.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter Z, Chapter 361, Local Government
1010 Code, is amended by adding Section 361.902 to read as follows:
1111 Sec. 361.902. SUICIDE PREVENTION IN MUNICIPAL JAIL. (a) A
1212 municipal jail shall:
1313 (1) provide two hours of training to each jailer or
1414 person responsible for the supervision of a person confined in the
1515 jail on the procedures for identifying, documenting, and handling a
1616 person who is potentially suicidal or has a mental health
1717 condition;
1818 (2) conduct and document mental health screenings
1919 during the intake process in accordance with the procedures adopted
2020 by the Commission on Jail Standards for county jails;
2121 (3) install cameras in the hall directly outside the
2222 cell of any person who is identified as potentially suicidal;
2323 (4) regularly check on each person confined in the
2424 jail who is identified as potentially suicidal; and
2525 (5) report to the attorney general, in the manner
2626 prescribed by the attorney general, any incident involving the
2727 suicide or attempted suicide of a person confined in the jail not
2828 later than 48 hours after the incident.
2929 (b) Subsection (a)(1) does not apply to a municipal jail
3030 that requires individuals described by that subdivision to complete
3131 a municipal jailer training or certification course as a condition
3232 of employment.
3333 (c) The attorney general may use the information reported
3434 under Subsection (a)(5) only for purposes of data collection and
3535 analysis.
3636 SECTION 2. This Act takes effect September 1, 2023.
