66 AN ACT
77 relating to the establishment of a bullying prevention pilot
88 program for public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 37, Education Code, is
1111 amended by adding Section 37.0835 to read as follows:
1212 Sec. 37.0835. BULLYING PREVENTION PILOT PROGRAM. (a) In
1313 this section:
1414 (1) "Bullying" has the meaning assigned by Section
1515 37.0832.
1616 (2) "Pilot program" means the bullying prevention
1717 pilot program established under this section.
1818 (b) The agency shall:
1919 (1) develop a bullying prevention pilot program to
2020 reduce incidents of bullying on public school campuses; and
2121 (2) award grants to eligible school districts to
2222 implement the pilot program on district campuses.
2323 (c) In developing the pilot program under Subsection (b),
2424 the agency shall:
2525 (1) use research-based best practices for the
2626 prevention of bullying; and
2727 (2) collaborate with qualified experts and
2828 researchers with experience in child and youth psychology, mental
2929 health, and education.
3030 (d) From funds appropriated for the purpose, the
3131 commissioner shall award grants to school districts that
3232 demonstrate a substantial need for bullying prevention, as
3333 determined by the commissioner. A school district that is awarded a
3434 grant under this subsection shall implement the pilot program at
3535 not more than three campuses in the district.
3636 (e) The agency shall use funds appropriated for purposes of
3737 the pilot program under this section to provide technical
3838 assistance to grant recipients. The agency may provide technical
3939 assistance through regional education service centers.
4040 (f) The commissioner shall:
4141 (1) establish application criteria for a school
4242 district to apply to receive a grant under this section; and
4343 (2) determine allowable uses of grant funds by a
4444 school district under this section.
4545 (g) The commissioner may use funds otherwise available and
4646 may solicit or accept grants or donations to implement this
4747 section.
4848 (h) The commissioner shall adopt rules as necessary to
4949 implement this section.
5050 (i) The commissioner is not required to develop the pilot
5151 program or award grants under this section unless money is
5252 specifically appropriated for that purpose.
5353 SECTION 2. This Act takes effect September 1, 2023.
