| 11 | 11 | | is amended by adding Chapter 503A to read as follows: |

| 12 | 12 | | CHAPTER 503A. FACIAL RECOGNITION TECHNOLOGY |

| 13 | 13 | | Sec. 503A.001. NOTICE OF FACIAL RECOGNITION TECHNOLOGY USE. |

| 14 | 14 | | A business entity that uses facial recognition technology for the |

| 15 | 15 | | purpose of identifying a customer or guest in a space located in |
|---|
| 16 | 16 | | this state that is generally accessible to the public must post a |
|---|
| 17 | 17 | | clear and conspicuous notice disclosing the business's use of the |
|---|
| 18 | 18 | | technology in the space. The notice must be posted in a location |
|---|
| 19 | 19 | | that is clearly viewed by a customer or guest entering the space |
|---|
| 20 | 20 | | where the technology is used. |

| 21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
