9	9	A BILL TO BE ENTITLED
10	10	AN ACT
11	11	relating to the design and issuance of specialty license plates to
12	12	honor members of the military and for recipients of certain
13	13	military awards.
14	14	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	15	SECTION 1. Section 504.202(e-1), Transportation Code, is
16	16	amended to read as follows:
17	17	(e-1) Other than license plates issued under Subsection
18	18	(h), license plates issued under this section may include, on
19	19	request:
20	20	(1) the emblem of the veteran's branch of service; or
21	21	(2) one emblem from another license plate to which the
22	22	person is entitled under Section 504.308, 504.309, 504.310(b),
23	23	504.311, 504.312, 504.313, 504.3135, 504.314, 504.315, 504.316,
24	24	504.3161, 504.318, 504.319, 504.320, 504.323, 504.325, [or]
25	25	504.327, 504.331, 504.332, 504.333, 504.334, or 504.335.
26	26	SECTION 2. Section 504.301, Transportation Code, is amended
27	27	by adding Subsection (a-1) to read as follows:
28	28	(a-1) The department may consider recommendations for the
29	29	design of specialty license plates under Subsection (a) from
30	30	persons who are eligible to be issued a specialty license plate
31	31	under this subchapter.
32	32	SECTION 3. Section 504.3015, Transportation Code, is
33	33	amended by amending Subsection (a) and adding Subsections (a-1) and
34	34	(a-2) to read as follows:
35	35	(a) A person applying for a set of license plates under this
36	36	subchapter shall pay:
37	37	(1) except as provided by Subsections (a-1) and (a-2),
38	38	the registration fee required under Chapter 502; and
39	39	(2) any [the] applicable special plate fee required
40	40	under this section.
41	41	(a-1) The department shall issue one set of license plates
42	42	[, except that one set of license plates shall be issued] without
43	43	the payment of the registration fee required under Chapter 502 for
44	44	the first registration period and for each renewal of registration
45	45	for which the vehicle is registered with license plates issued
46	46	under:
47	47	(1) Section 504.308;
48	48	(2) Section 504.310(b);
49	49	(3) Section 504.315, other than Subsections (c) and
50	50	(q) of that section; and
51	51	(4) Section 504.319.
52	52	(a-2) The department shall issue one set of license plates
53	53	without the payment of the registration fee required under Chapter
54	54	502 for the first registration period for which the vehicle is
55	55	registered with license plates issued under:
56	56	(1) Section 504.331;
57	57	(2) Section 504.332;
58	58	(3) Section 504.333;
59	59	(4) Section 504.334; and
60	60	(5) Section 504.335.
61	61	SECTION 4. Subchapter D, Chapter 504, Transportation Code,
62	62	is amended by adding Sections 504.331, 504.332, 504.333, 504.334,
63	63	and 504.335 to read as follows:
64	64	Sec. 504.331. TEXAS HOMELAND DEFENSE SERVICE MEDAL. The
65	65	department shall issue specialty license plates for recipients of
66	66	the Texas Homeland Defense Service Medal. The license plates must
67	67	include the Texas Homeland Defense Service Medal emblem and must
68	68	include the words "Texas Homeland Defense Service Medal" at the
69	69	bottom of each plate.
70	70	Sec. 504.332. TEXAS SUPERIOR SERVICE MEDAL. The department
71	71	shall issue specialty license plates for recipients of the Texas
72	72	Superior Service Medal. The license plates must include the Texas
73	73	Superior Service Medal emblem and must include the words "Texas
74	74	Superior Service Medal" at the bottom of each plate.
75	75	Sec. 504.333. LONE STAR DISTINGUISHED SERVICE MEDAL. The
76	76	department shall issue specialty license plates for recipients of
77	77	the Lone Star Distinguished Service Medal. License plates issued
78	78	under this subsection must include the Lone Star Distinguished
79	79	Service Medal emblem and must include the words "Lone Star
80	80	Distinguished Service Medal" at the bottom of each plate.
81	81	Sec. 504.334. TEXAS OUTSTANDING SERVICE MEDAL. The
82	82	department shall issue specialty license plates for recipients of
83	83	the Texas Outstanding Service Medal. License plates issued under
84	84	this subsection must include the Texas Outstanding Service Medal
85	85	emblem and must include the words "Texas Outstanding Service Medal"
86	86	at the bottom of each plate.
87	87	Sec. 504.335. TEXAS MEDAL OF MERIT. The department shall
88	88	issue specialty license plates for recipients of the Texas Medal of
89	89	Merit. License plates issued under this subsection must include
90	90	the Texas Medal of Merit emblem and must include the words "Texas
91	91	Medal of Merit" at the bottom of each plate.
92	92	SECTION 5. It is the intent of the 88th Legislature, Regular
93	93	Session, 2023, that the amendments made by this Act be harmonized
94	94	with another Act of the 88th Legislature, Regular Session, 2023,
95	95	relating to nonsubstantive additions to and corrections in enacted
96	96	codes.
97	97	SECTION 6. This Act takes effect September 1, 2023.
