66 AN ACT
77 relating to the confidentiality of certain home address information
88 in certain documents.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 13.004(c), Election Code, is amended to
1111 read as follows:
1212 (c) The following information furnished on a registration
1313 application is confidential and does not constitute public
1414 information for purposes of Chapter 552, Government Code:
1515 (1) a social security number;
1616 (2) a Texas driver's license number;
1717 (3) a number of a personal identification card issued
1818 by the Department of Public Safety;
1919 (4) the residence address of the applicant, if the
2020 applicant is a federal judge, including a federal bankruptcy judge,
2121 a marshal of the United States Marshals Service, a United States
2222 attorney, or a state judge, a family member of a federal judge,
2323 including a federal bankruptcy judge, a marshal of the United
2424 States Marshals Service, a United States attorney, or a state
2525 judge, the spouse of a peace officer as defined by Article 2.12,
2626 Code of Criminal Procedure, or an individual to whom Section
2727 552.1175, Government Code, or Section 521.1211, Transportation
2828 Code, applies and the applicant:
2929 (A) included an affidavit with the registration
3030 application describing the applicant's status under this
3131 subdivision, if the applicant is a federal judge, including a
3232 federal bankruptcy judge, a marshal of the United States Marshals
3333 Service, a United States attorney, or a state judge or a family
3434 member of a federal judge, including a federal bankruptcy judge, a
3535 marshal of the United States Marshals Service, a United States
3636 attorney, or a state judge;
3737 (B) provided the registrar with an affidavit
3838 describing the applicant's status under this subdivision, if the
3939 applicant is a federal judge, including a federal bankruptcy judge,
4040 a marshal of the United States Marshals Service, a United States
4141 attorney, or a state judge or a family member of a federal judge,
4242 including a federal bankruptcy judge, a marshal of the United
4343 States Marshals Service, a United States attorney, or a state
4444 judge; or
4545 (C) provided the registrar with a completed form
4646 approved by the secretary of state for the purpose of notifying the
4747 registrar of the applicant's status under this subdivision;
4848 (5) the residence address of the applicant, if the
4949 applicant, the applicant's child, or another person in the
5050 applicant's household is a victim of family violence as defined by
5151 Section 71.004, Family Code, who provided the registrar with:
5252 (A) a copy of a protective order issued under
5353 Chapter 85, Family Code, or a magistrate's order for emergency
5454 protection issued under Article 17.292, Code of Criminal Procedure;
5555 or
5656 (B) other independent documentary evidence
5757 necessary to show that the applicant, the applicant's child, or
5858 another person in the applicant's household is a victim of family
5959 violence;
6060 (6) the residence address of the applicant, if the
6161 applicant, the applicant's child, or another person in the
6262 applicant's household is a victim of sexual assault or abuse,
6363 stalking, or trafficking of persons who provided the registrar
6464 with:
6565 (A) a copy of a protective order issued under
6666 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
6767 magistrate's order for emergency protection issued under Article
6868 17.292, Code of Criminal Procedure; or
6969 (B) other independent documentary evidence
7070 necessary to show that the applicant, the applicant's child, or
7171 another person in the applicant's household is a victim of sexual
7272 assault or abuse, stalking, or trafficking of persons;
7373 (7) the residence address of the applicant, if the
7474 applicant:
7575 (A) is a participant in the address
7676 confidentiality program administered by the attorney general under
7777 Subchapter B, Chapter 58, Code of Criminal Procedure; and
7878 (B) provided the registrar with proof of
7979 certification under Article 58.059, Code of Criminal Procedure;
8080 [or]
8181 (8) the telephone number of any applicant submitting
8282 documentation under Subdivision (4), (5), (6), or (7); or
8383 (9) the residence address of the applicant, if the
8484 applicant is an employee of or a volunteer or contractor for a
8585 clinic or facility that provides abortion services or
8686 gender-affirming health care services.
8787 SECTION 2. Section 25.025(a), Tax Code, is amended to read
8888 as follows:
8989 (a) This section applies only to:
9090 (1) a current or former peace officer as defined by
9191 Article 2.12, Code of Criminal Procedure, and the spouse or
9292 surviving spouse of the peace officer;
9393 (2) the adult child of a current peace officer as
9494 defined by Article 2.12, Code of Criminal Procedure;
9595 (3) a current or honorably retired county jailer as
9696 defined by Section 1701.001, Occupations Code;
9797 (4) an employee of the Texas Department of Criminal
9898 Justice;
9999 (5) a commissioned security officer as defined by
100100 Section 1702.002, Occupations Code;
101101 (6) an individual who shows that the individual, the
102102 individual's child, or another person in the individual's household
103103 is a victim of family violence as defined by Section 71.004, Family
104104 Code, by providing:
105105 (A) a copy of a protective order issued under
106106 Chapter 85, Family Code, or a magistrate's order for emergency
107107 protection issued under Article 17.292, Code of Criminal Procedure;
108108 or
109109 (B) other independent documentary evidence
110110 necessary to show that the individual, the individual's child, or
111111 another person in the individual's household is a victim of family
112112 violence;
113113 (7) an individual who shows that the individual, the
114114 individual's child, or another person in the individual's household
115115 is a victim of sexual assault or abuse, stalking, or trafficking of
116116 persons by providing:
117117 (A) a copy of a protective order issued under
118118 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
119119 magistrate's order for emergency protection issued under Article
120120 17.292, Code of Criminal Procedure; or
121121 (B) other independent documentary evidence
122122 necessary to show that the individual, the individual's child, or
123123 another person in the individual's household is a victim of sexual
124124 assault or abuse, stalking, or trafficking of persons;
125125 (8) a participant in the address confidentiality
126126 program administered by the attorney general under Subchapter B,
127127 Chapter 58, Code of Criminal Procedure, who provides proof of
128128 certification under Article 58.059, Code of Criminal Procedure;
129129 (9) a federal judge, a federal bankruptcy judge, a
130130 marshal of the United States Marshals Service, a state judge, or a
131131 family member of a federal judge, a federal bankruptcy judge, a
132132 marshal of the United States Marshals Service, or a state judge;
133133 (10) a current or former district attorney, criminal
134134 district attorney, or county or municipal attorney whose
135135 jurisdiction includes any criminal law or child protective services
136136 matters;
137137 (11) a current or former employee of a district
138138 attorney, criminal district attorney, or county or municipal
139139 attorney whose jurisdiction includes any criminal law or child
140140 protective services matters;
141141 (12) an officer or employee of a community supervision
142142 and corrections department established under Chapter 76,
143143 Government Code, who performs a duty described by Section 76.004(b)
144144 of that code;
145145 (13) a criminal investigator of the United States as
146146 described by Article 2.122(a), Code of Criminal Procedure;
147147 (14) a current or honorably retired police officer or
148148 inspector of the United States Federal Protective Service;
149149 (15) a current or former United States attorney,
150150 assistant United States attorney, federal public defender, deputy
151151 federal public defender, or assistant federal public defender and
152152 the spouse and child of the attorney or public defender;
153153 (16) a current or former employee of the office of the
154154 attorney general who is or was assigned to a division of that office
155155 the duties of which involve law enforcement;
156156 (17) a medical examiner or person who performs
157157 forensic analysis or testing who is employed by this state or one or
158158 more political subdivisions of this state;
159159 (18) a current or former member of the United States
160160 armed forces who has served in an area that the president of the
161161 United States by executive order designates for purposes of 26
162162 U.S.C. Section 112 as an area in which armed forces of the United
163163 States are or have engaged in combat;
164164 (19) a current or former employee of the Texas
165165 Juvenile Justice Department or of the predecessors in function of
166166 the department;
167167 (20) a current or former juvenile probation or
168168 supervision officer certified by the Texas Juvenile Justice
169169 Department, or the predecessors in function of the department,
170170 under Title 12, Human Resources Code;
171171 (21) a current or former employee of a juvenile
172172 justice program or facility, as those terms are defined by Section
173173 261.405, Family Code;
174174 (22) a current or former employee of the Texas Civil
175175 Commitment Office or the predecessor in function of the office or a
176176 division of the office;
177177 (23) a current or former employee of a federal judge or
178178 state judge;
179179 (24) a current or former child protective services
180180 caseworker, adult protective services caseworker, or investigator
181181 for the Department of Family and Protective Services or a current or
182182 former employee of a department contractor performing child
183183 protective services caseworker, adult protective services
184184 caseworker, or investigator functions for the contractor on behalf
185185 of the department;
186186 (25) an elected public officer; [and]
187187 (26) a firefighter or volunteer firefighter or
188188 emergency medical services personnel as defined by Section 773.003,
189189 Health and Safety Code;
190190 (27) an employee of or a volunteer or contractor for a
191191 clinic or facility that provides abortion services or
192192 gender-affirming health care services; and
193193 (28) an employee of or a volunteer or contractor for an
194194 organization that provides logistical or financial support to
195195 individuals seeking an abortion or gender-affirming health care.
196196 SECTION 3. This Act takes effect immediately if it receives
197197 a vote of two-thirds of all the members elected to each house, as
198198 provided by Section 39, Article III, Texas Constitution. If this
199199 Act does not receive the vote necessary for immediate effect, this
200200 Act takes effect September 1, 2023.
