| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 28, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 28.029 to read as follows: |
|---|
| 14 | 14 | | Sec. 28.029. MIDDLE SCHOOL ADVANCED MATHEMATICS PROGRAM. |
|---|
| 15 | 15 | | (a) To increase the number of students who complete advanced |
|---|
| 16 | 16 | | mathematics courses in high school, each school district and |
|---|
| 17 | 17 | | open-enrollment charter school shall develop an advanced |
|---|
| 18 | 18 | | mathematics program for middle school students that is designed to |
|---|
| 19 | 19 | | enable those students to enroll in Algebra I in eighth grade. |
|---|
| 20 | 20 | | (b) Under the program, subject to Subsection (c), a school |
|---|
| 21 | 21 | | district or open-enrollment charter school shall automatically |
|---|
| 22 | 22 | | enroll in an advanced mathematics course each sixth grade student |
|---|
| 23 | 23 | | who performed in the top 40 percent on: |
|---|
| 24 | 24 | | (1) the fifth grade mathematics assessment instrument |
|---|
| 25 | 25 | | administered under Section 39.023(a); or |
|---|
| 26 | 26 | | (2) a local measure that includes the student's fifth |
|---|
| 27 | 27 | | grade class ranking or a demonstrated proficiency in the student's |
|---|
| 28 | 28 | | fifth grade mathematics coursework. |
|---|
| 29 | 29 | | (c) The parent or guardian of a student described by |
|---|
| 30 | 30 | | Subsection (b) may opt the student out of automatic enrollment |
|---|
| 31 | 31 | | under that subsection. |
|---|
| 32 | 32 | | (d) The commissioner may adopt rules to implement this |
|---|
| 33 | 33 | | section. |
|---|
| 34 | 34 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 35 | 35 | | of this Act, each school district or open-enrollment charter school |
|---|
| 36 | 36 | | shall develop the middle school advanced mathematics program |
|---|
| 37 | 37 | | required by Section 28.029, Education Code, as added by this Act. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2023. |
