88 AN ACT
99 relating to an advanced mathematics program for public school
1010 students in middle school.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 28, Education Code, is
1313 amended by adding Section 28.029 to read as follows:
1414 Sec. 28.029. MIDDLE SCHOOL ADVANCED MATHEMATICS PROGRAM.
1515 (a) To increase the number of students who complete advanced
1616 mathematics courses in high school, each school district and
1717 open-enrollment charter school shall develop an advanced
1818 mathematics program for middle school students that is designed to
1919 enable those students to enroll in Algebra I in eighth grade.
2020 (b) Under the program, subject to Subsection (c), a school
2121 district or open-enrollment charter school shall automatically
2222 enroll in an advanced mathematics course each sixth grade student
2323 who performed in the top 40 percent on:
2424 (1) the fifth grade mathematics assessment instrument
2525 administered under Section 39.023(a); or
2626 (2) a local measure that includes the student's fifth
2727 grade class ranking or a demonstrated proficiency in the student's
2828 fifth grade mathematics coursework.
2929 (c) The parent or guardian of a student described by
3030 Subsection (b) may opt the student out of automatic enrollment
3131 under that subsection.
3232 (d) The commissioner may adopt rules to implement this
3333 section.
3434 SECTION 2. As soon as practicable after the effective date
3535 of this Act, each school district or open-enrollment charter school
3636 shall develop the middle school advanced mathematics program
3737 required by Section 28.029, Education Code, as added by this Act.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2023.
