| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 253.035, Election Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (c-1) to read as follows: |
|---|
| 11 | 11 | | (c-1) The prohibition prescribed by Subsection (a) includes |
|---|
| 12 | 12 | | the personal use of political contributions accepted by a person as |
|---|
| 13 | 13 | | a candidate or officeholder or by a specific-purpose committee for |
|---|
| 14 | 14 | | the purpose of supporting the person as a candidate or assisting the |
|---|
| 15 | 15 | | person as an officeholder to settle a civil action asserting a claim |
|---|
| 16 | 16 | | against the officeholder. |

| 17 | 17 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 18 | 18 | | to the use of a political contribution that occurs on or after the |
|---|
| 19 | 19 | | effective date of this Act. The use of a political contribution |
|---|
| 20 | 20 | | that occurs before the effective date of this Act is governed by the |
|---|
| 21 | 21 | | law in effect on the date the use occurred, and the former law is |
|---|
| 22 | 22 | | continued in effect for that purpose. |

| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
