| 7 | 7 | | of the Texas crime information system by the Department of Public |
|---|
| 8 | 8 | | Safety. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 411.054, Government Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 411.054. INCIDENT-BASED CRIME STATISTICS REPORTING BY |
|---|
| 13 | 13 | | LOCAL LAW ENFORCEMENT AGENCIES [GOAL]. (a) The department shall |
|---|
| 14 | 14 | | require [establish a goal that, not later than September 1, 2019,] |
|---|
| 15 | 15 | | all local law enforcement agencies to: |
|---|
| 16 | 16 | | (1) implement [will have implemented] an |
|---|
| 17 | 17 | | incident-based reporting system that meets the reporting |
|---|
| 18 | 18 | | requirements of the National Incident-Based Reporting System of the |
|---|
| 19 | 19 | | Uniform Crime Reporting Program of the Federal Bureau of |
|---|
| 20 | 20 | | Investigation; and |
|---|
| 21 | 21 | | (2) [will] use the system described by Subdivision (1) |
|---|
| 22 | 22 | | to submit to the department information and statistics concerning |
|---|
| 23 | 23 | | criminal offenses committed in the jurisdiction of the local law |
|---|
| 24 | 24 | | enforcement agency. |
|---|
| 25 | 25 | | (b) The department by rule shall prescribe the form and |
|---|
| 26 | 26 | | manner for submitting information and statistics under this section |
|---|
| 27 | 27 | | [Not later than January 1, 2017, the department shall submit a |
|---|
| 28 | 28 | | report to the legislature that identifies the number of local law |
|---|
| 29 | 29 | | enforcement agencies that have implemented the system described by |
|---|
| 30 | 30 | | Subsection (a)]. |
|---|
| 31 | 31 | | (c) Except as otherwise provided by this section and Section |
|---|
| 32 | 32 | | 411.0541, information and statistics submitted to the department |
|---|
| 33 | 33 | | under this section are confidential and not subject to disclosure |
|---|
| 34 | 34 | | under Chapter 552. |
|---|
| 35 | 35 | | (d) The department shall submit the information and |
|---|
| 36 | 36 | | statistics received by the department under this section to the |
|---|
| 37 | 37 | | Uniform Crime Reporting Program of the Federal Bureau of |
|---|
| 38 | 38 | | Investigation, as required by that program. |
|---|
| 39 | 39 | | SECTION 2. Subchapter D, Chapter 411, Government Code, is |
|---|
| 40 | 40 | | amended by adding Section 411.0541 to read as follows: |
|---|
| 41 | 41 | | Sec. 411.0541. TEXAS CRIME INFORMATION SYSTEM. (a) In this |
|---|
| 42 | 42 | | section: |
|---|
| 43 | 43 | | (1) "Criminal justice agency" means: |
|---|
| 44 | 44 | | (A) a state agency that is engaged in the |
|---|
| 45 | 45 | | administration of criminal justice under a statute or executive |
|---|
| 46 | 46 | | order and allocates a substantial part of the agency's annual |
|---|
| 47 | 47 | | budget to the administration of criminal justice; or |
|---|
| 48 | 48 | | (B) a municipal or county agency, or school |
|---|
| 49 | 49 | | district law enforcement agency, that is engaged in the |
|---|
| 50 | 50 | | administration of criminal justice under a statute or executive |
|---|
| 51 | 51 | | order. |
|---|
| 52 | 52 | | (2) "System" means the computer-based Texas crime |
|---|
| 53 | 53 | | information system established under Subsection (b). |
|---|
| 54 | 54 | | (b) The department shall establish and maintain a |
|---|
| 55 | 55 | | computer-based Texas crime information system that includes all of |
|---|
| 56 | 56 | | the information and statistics submitted to the department under |
|---|
| 57 | 57 | | Section 411.054. |
|---|
| 58 | 58 | | (c) The department shall restrict access to the system to |
|---|
| 59 | 59 | | authorized personnel of criminal justice agencies, as determined by |
|---|
| 60 | 60 | | the department. |
|---|
| 61 | 61 | | (d) The department shall use the information included in the |
|---|
| 62 | 62 | | system to periodically publish reports regarding the nature and |
|---|
| 63 | 63 | | extent of criminal activities in this state. The department shall |
|---|
| 64 | 64 | | submit each report published under this subsection to the governor |
|---|
| 65 | 65 | | and each member of the legislature and shall publish each report on |
|---|
| 66 | 66 | | the department's Internet website. |
|---|
| 67 | 67 | | SECTION 3. The Department of Public Safety of the State of |
|---|
| 68 | 68 | | Texas shall adopt rules as necessary to implement Section 411.0541, |
|---|
| 69 | 69 | | Government Code, as added by this Act. |
|---|
| 70 | 70 | | SECTION 4. This Act takes effect September 1, 2023. |
