55 relating to incident-based reporting of information and statistics

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.054, Government Code, is amended to
1111 read as follows:
1212 Sec. 411.054. INCIDENT-BASED CRIME STATISTICS REPORTING BY
1313 LOCAL LAW ENFORCEMENT AGENCIES [GOAL]. (a) The department shall
1414 require [establish a goal that, not later than September 1, 2019,]
1515 all local law enforcement agencies to:
1616 (1) implement [will have implemented] an
1717 incident-based reporting system that meets the reporting
1818 requirements of the National Incident-Based Reporting System of the
1919 Uniform Crime Reporting Program of the Federal Bureau of
2020 Investigation; and
2121 (2) [will] use the system described by Subdivision (1)
2222 to submit to the department information and statistics concerning
2323 criminal offenses committed in the jurisdiction of the local law
2424 enforcement agency.
2525 (b) The department by rule shall prescribe the form and
2626 manner for submitting information and statistics under this section
2727 [Not later than January 1, 2017, the department shall submit a
2828 report to the legislature that identifies the number of local law
2929 enforcement agencies that have implemented the system described by
3030 Subsection (a)].
3131 (c) Except as otherwise provided by this section and Section
3232 411.0541, information and statistics submitted to the department
3333 under this section are confidential and not subject to disclosure
3434 under Chapter 552.
3535 (d) The department shall submit the information and
3636 statistics received by the department under this section to the
3737 Uniform Crime Reporting Program of the Federal Bureau of
3838 Investigation, as required by that program.
3939 SECTION 2. Subchapter D, Chapter 411, Government Code, is
4040 amended by adding Section 411.0541 to read as follows:
4141 Sec. 411.0541. TEXAS CRIME INFORMATION SYSTEM. (a) In this
4242 section:
4343 (1) "Criminal justice agency" means:
4444 (A) a state agency that is engaged in the
4545 administration of criminal justice under a statute or executive
4646 order and allocates a substantial part of the agency's annual
4747 budget to the administration of criminal justice; or
4848 (B) a municipal or county agency, or school
4949 district law enforcement agency, that is engaged in the
5050 administration of criminal justice under a statute or executive
5151 order.
5252 (2) "System" means the computer-based Texas crime
5353 information system established under Subsection (b).
5454 (b) The department shall establish and maintain a
5555 computer-based Texas crime information system that includes all of
5656 the information and statistics submitted to the department under
5757 Section 411.054.
5858 (c) The department shall restrict access to the system to
5959 authorized personnel of criminal justice agencies, as determined by
6060 the department.
6161 (d) The department shall use the information included in the
6262 system to periodically publish reports regarding the nature and
6363 extent of criminal activities in this state. The department shall
6464 submit each report published under this subsection to the governor
6565 and each member of the legislature and shall publish each report on
6666 the department's Internet website.
6767 SECTION 3. The Department of Public Safety of the State of
6868 Texas shall adopt rules as necessary to implement Section 411.0541,
6969 Government Code, as added by this Act.
7070 SECTION 4. This Act takes effect September 1, 2023.
