55 relating to programs established and funded under the Texas
66 emissions reduction plan.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 386.051(b), Health and Safety Code, is
99 amended to read as follows:
1010 (b) Under the plan, the commission and the comptroller shall
1111 provide grants or other funding for:
1212 (1) the diesel emissions reduction incentive program
1313 established under Subchapter C, including for infrastructure
1414 projects established under that subchapter;
1515 (2) the motor vehicle purchase or lease incentive
1616 program established under Subchapter D;
1717 (3) the air quality research support program
1818 established under Chapter 387;
1919 (4) the clean school bus program established under
2020 Chapter 390;
2121 (5) the new technology implementation grant program
2222 established under Chapter 391;
2323 (6) the regional air monitoring program established
2424 under Section 386.252(a);
2525 (7) a health effects study as provided by Section
2626 386.252(a);
2727 (8) air quality planning activities as provided by
2828 Section 386.252(d);
2929 (9) a contract with the Energy Systems Laboratory at
3030 the Texas A&M Engineering Experiment Station for computation of
3131 creditable statewide emissions reductions as provided by Section
3232 386.252(a);
3333 (10) the Texas clean fleet program established under
3434 Chapter 392;
3535 (11) the Texas alternative fueling facilities program
3636 established under Chapter 393;
3737 (12) the Texas natural gas vehicle grant program
3838 established under Chapter 394;
3939 (13) other programs the commission may develop that
4040 lead to reduced emissions of nitrogen oxides, particulate matter,
4141 or volatile organic compounds in a nonattainment area or affected
4242 county;
4343 (14) other programs the commission may develop that
4444 support congestion mitigation to reduce mobile source ozone
4545 precursor emissions;
4646 (15) the seaport and rail yard areas emissions
4747 reduction program established under Subchapter D-1;
4848 (16) conducting research and other activities
4949 associated with making any necessary demonstrations to the United
5050 States Environmental Protection Agency to account for the impact of
5151 foreign emissions or an exceptional event;
5252 (17) studies of or pilot programs for incentives for
5353 port authorities located in nonattainment areas or affected
5454 counties as provided by Section 386.252(a);
5555 (18) the governmental alternative fuel fleet grant
5656 program established under Chapter 395; [and]
5757 (19) remittance of funds to the state highway fund for
5858 use by the Texas Department of Transportation for congestion
5959 mitigation and air quality improvement projects in nonattainment
6060 areas and affected counties; and
6161 (20) the Texas hydrogen infrastructure, vehicle, and
6262 equipment grant program established under Subchapter G.
6363 SECTION 2. Section 386.252(a), Health and Safety Code, is
6464 amended to read as follows:
6565 (a) Money in the fund and account may be used only to
6666 implement and administer programs established under the plan.
6767 Subject to the reallocation of funds by the commission under
6868 Subsection (h) and after remittance to the state highway fund under
6969 Subsection (a-1), money from the fund and account to be used for the
7070 programs under Section 386.051(b) shall initially be allocated as
7171 follows:
7272 (1) four percent may be used for the clean school bus
7373 program under Chapter 390;
7474 (2) eight [three] percent total may be used between
7575 the Texas hydrogen infrastructure, vehicle, and equipment grant
7676 program established under Subchapter G and [for] the new technology
7777 implementation grant program under Chapter 391, from which at least
7878 $1 million will be set aside for electricity storage projects
7979 related to renewable energy and not more than $8 million may be used
8080 for the Texas hydrogen infrastructure, vehicle, and equipment grant
8181 program;
8282 (3) five percent may be used for the Texas clean fleet
8383 program under Chapter 392;
8484 (4) not more than $3 million may be used by the
8585 commission to fund a regional air monitoring program in commission
8686 Regions 3 and 4 to be implemented under the commission's oversight,
8787 including direction regarding the type, number, location, and
8888 operation of, and data validation practices for, monitors funded by
8989 the program through a regional nonprofit entity located in North
9090 Texas having representation from counties, municipalities, higher
9191 education institutions, and private sector interests across the
9292 area;
9393 (5) 7.5 [10] percent may be used for the Texas natural
9494 gas vehicle grant program under Chapter 394;
9595 (6) not more than $6 million may be used for the Texas
9696 alternative fueling facilities program under Chapter 393, of which
9797 a specified amount may be used for fueling stations to provide
9898 natural gas fuel, except that money may not be allocated for the
9999 Texas alternative fueling facilities program for the state fiscal
100100 year ending August 31, 2019;
101101 (7) not more than $750,000 may be used each year to
102102 support research related to air quality as provided by Chapter 387;
103103 (8) not more than $200,000 may be used for a health
104104 effects study;
105105 (9) at least $6 million but not more than 15 percent
106106 [$16 million] may be used by the commission for administrative
107107 costs, including all direct and indirect costs for administering
108108 the plan, costs for conducting outreach and education activities,
109109 and costs attributable to the review or approval of applications
110110 for marketable emissions reduction credits;
111111 (10) six percent may be used by the commission for the
112112 seaport and rail yard areas emissions reduction program established
113113 under Subchapter D-1;
114114 (11) 2.5 [five] percent may be used for the light-duty
115115 motor vehicle purchase or lease incentive program established under
116116 Subchapter D;
117117 (12) not more than $500,000 [$216,000] may be used by
118118 the commission to contract with the Energy Systems Laboratory at
119119 the Texas A&M Engineering Experiment Station annually for the
120120 development and annual computation of creditable statewide
121121 emissions reductions for the state implementation plan that are
122122 obtained through:
123123 (A) wind and other renewable energy resources;
124124 (B) energy efficiency programs administered by
125125 the Public Utility Commission of Texas or the State Energy
126126 Conservation Office; or
127127 (C) the implementation of advanced building
128128 energy codes [for the state implementation plan];
129129 (13) not more than $500,000 may be used for studies of
130130 or pilot programs for incentives for port authorities located in
131131 nonattainment areas or affected counties to encourage cargo
132132 movement that reduces emissions of nitrogen oxides and particulate
133133 matter; and
134134 (14) the balance is to be used by the commission for
135135 the diesel emissions reduction incentive program under Subchapter C
136136 as determined by the commission.
137137 SECTION 3. Chapter 386, Health and Safety Code, is amended
138138 by adding Subchapter G to read as follows:
139139 SUBCHAPTER G. TEXAS HYDROGEN INFRASTRUCTURE, VEHICLE, AND
140140 EQUIPMENT GRANT PROGRAM
141141 Sec. 386.301. DEFINITIONS. In this subchapter:
142142 (1) "Hydrogen vehicle or equipment" means a heavy-duty
143143 motor vehicle or piece of heavy-duty equipment that uses hydrogen
144144 to operate the vehicle or equipment, including through the use of
145145 hydrogen fuel cells or an internal combustion engine that runs on
146146 hydrogen.
147147 (2) "Program" means the Texas hydrogen
148148 infrastructure, vehicle, and equipment grant program established
149149 under this subchapter.
150150 Sec. 386.302. PROGRAM. (a) The commission shall establish
151151 and administer the Texas hydrogen infrastructure, vehicle, and
152152 equipment grant program to encourage the adoption of hydrogen
153153 infrastructure, vehicles, and equipment. Under the program, the
154154 commission shall provide funding for eligible projects to offset
155155 the incremental cost of projects that reduce emissions of oxides of
156156 nitrogen from high-emitting sources in nonattainment areas and
157157 affected counties of this state. The commission shall determine
158158 the eligibility of projects.
159159 (b) Projects that may be considered for a grant under the
160160 program include:
161161 (1) implementation of hydrogen infrastructure
162162 projects;
163163 (2) purchase or lease of on-road or non-road hydrogen
164164 vehicles or equipment;
165165 (3) replacement of on-road or non-road heavy-duty
166166 vehicles or equipment with newer on-road or non-road hydrogen
167167 vehicles or equipment; and
168168 (4) the repower or conversion of on-road or non-road
169169 heavy-duty vehicles or equipment with a powertrain that runs on or
170170 is powered by hydrogen.
171171 (c) A project listed in Subsection (b) is not eligible if it
172172 is required by any state or federal law, rule or regulation,
173173 memorandum of agreement, or other legally binding document. This
174174 subsection does not apply to:
175175 (1) an otherwise qualified project, regardless of the
176176 fact that the state implementation plan assumes that the change in
177177 vehicles, equipment, or operations will occur, if on the date the
178178 grant is awarded the change is not required by any state or federal
179179 law, rule or regulation, memorandum of agreement, or other legally
180180 binding document; or
181181 (2) the purchase of a hydrogen vehicle or equipment or
182182 facility required only by local law or regulation or by corporate or
183183 controlling board policy of a public or private entity.
184184 (d) The commission shall prioritize the awarding of grants
185185 under this subchapter in the following order:
186186 (1) projects to replace on-road heavy-duty vehicles
187187 with newer on-road hydrogen vehicles;
188188 (2) projects to purchase, lease, repower, or convert
189189 on-road heavy-duty vehicles with a powertrain that runs on or is
190190 powered by hydrogen;
191191 (3) projects to implement hydrogen refueling
192192 infrastructure that will be accessible and available to the public
193193 at times designated by the grant contract;
194194 (4) projects to replace non-road heavy-duty vehicles
195195 with newer non-road hydrogen vehicles; and
196196 (5) projects to purchase, lease, repower, or convert
197197 non-road heavy-duty vehicles with a powertrain that runs on or is
198198 powered by hydrogen.
199199 (e) Subject to Subsection (d), in awarding grants under this
200200 subchapter, the commission shall give preference to the most
201201 cost-effective projects that will result in the greatest reduction
202202 in emissions of oxides of nitrogen.
203203 (f) The commission shall establish additional eligibility
204204 and prioritization criteria as needed to implement the program.
205205 Sec. 386.303. APPLICATION PACKAGE. (a) The commission
206206 shall develop a simple, standardized application package for grants
207207 under this subchapter. The package must include:
208208 (1) an application form;
209209 (2) a brief description of:
210210 (A) the program;
211211 (B) the projects that are eligible for available
212212 funding;
213213 (C) the selection criteria and evaluation
214214 process; and
215215 (D) the required documentation;
216216 (3) the name of a person or office to contact for more
217217 information;
218218 (4) an example of the contract that an applicant will
219219 be required to execute before receiving a grant; and
220220 (5) any other information the commission considers
221221 useful to inform the applicant and expedite the application
222222 process.
223223 (b) The application form shall require as much information
224224 as the commission determines is necessary to properly evaluate each
225225 project but shall otherwise minimize the information required.
226226 Sec. 386.304. APPLICATION REVIEW PROCEDURES. (a) The
227227 commission shall review an application for a grant for a project
228228 authorized under this subchapter. If the commission determines
229229 that an application is incomplete, the commission shall notify the
230230 applicant with an explanation of what is missing from the
231231 application. The commission shall evaluate the completed
232232 application according to the appropriate project criteria. Subject
233233 to available funding, the commission shall make a final
234234 determination on an application as soon as possible.
235235 (b) The commission shall make every effort to expedite the
236236 application review process and to award grants to qualified
237237 projects in a timely manner. To the extent possible, the commission
238238 shall coordinate project review and approval with any timing
239239 constraints related to project purchases or installations to be
240240 made by an applicant.
241241 (c) The commission may deny an application for a project
242242 that does not meet the applicable project criteria or that the
243243 commission determines is not made in good faith, is not credible, or
244244 is not in compliance with this chapter and the goals of this
245245 chapter.
246246 (d) Subject to availability of funds, the commission shall
247247 award a grant under this subchapter in conjunction with the
248248 execution of a contract that obligates the commission to make the
249249 grant and the recipient to perform the actions described in the
250250 recipient's grant application. The contract must incorporate
251251 provisions for recapturing grant money in proportion to any loss of
252252 emissions reductions compared with the volume of emissions
253253 reductions that was projected in awarding the grant. Grant money
254254 recaptured under the contract provision shall be deposited in the
255255 fund and reallocated for other projects under this chapter.
256256 SECTION 4. Section 391.002(b), Health and Safety Code, is
257257 amended to read as follows:
258258 (b) Projects that may be considered for a grant under the
259259 program include:
260260 (1) advanced clean energy projects, as defined by
261261 Section 382.003;
262262 (2) new technology projects that reduce emissions of
263263 regulated pollutants from stationary sources;
264264 (3) new technology projects that reduce emissions from
265265 upstream, [and] midstream, or downstream oil and gas production,
266266 completions, gathering, storage, processing, [and] transmission,
267267 or refining activities through:
268268 (A) the replacement, repower, or retrofit of
269269 stationary compressor engines;
270270 (B) the installation of systems to reduce or
271271 eliminate the loss of gas, flaring of gas, or burning of gas using
272272 other combustion control devices; or
273273 (C) the installation of systems that reduce
274274 flaring emissions and other site emissions; and
275275 (4) electricity storage projects related to renewable
276276 energy, including projects to store electricity produced from wind
277277 and solar generation that provide efficient means of making the
278278 stored energy available during periods of peak energy use.
279279 SECTION 5. This Act takes effect September 1, 2023.
