66 relating to air quality permits for certain aggregate production
77 operations; establishing rulemaking authority.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 382, Health and Safety
1010 Code, is amended by adding Sections 382.0651 to read as follows:
1111 Sec. 382.0651. STANDARD PERMIT WITH ENHANCED CONTROLS FOR
1212 CERTAIN AGGREGATE PRODUCTION FACILITIES. (a) The commission shall
1313 issue a Standard Permit with Enhanced Controls to a rock crushing
1414 facility that:
1515 (1) is located at an aggregate production operation
1616 required to be registered under Section 28A.051, Water Code;
1717 (2) is used for the production of aggregates, as
1818 defined by Section 28A.001, Water Code;
1919 (3) limits production to under 1500 tons per hour; and
2020 (4) meets the requirements of this section.
2121 (b) The permit process authorized by this section is not
2222 subject to the requirements relating to a contested case hearing
2323 under this chapter, Chapter 5, Water Code, or Subchapters C-G,
2424 Chapter 2001, Government Code.
2525 SECTION 2. The commission shall adopt rules relating to
2626 best management practice requirements for an owner or operator of a
2727 facility to use the permit under this section. The commission may
2828 not establish by rule any requirements that an applicant for a
2929 permit under this section be subject to a hearing under 2001.051,
3030 Government Code.
3131 SECTION 3. This Act takes effect September 1, 2023.
