| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Sections 382.0651 to read as follows: |
|---|
| 11 | 11 | | Sec. 382.0651. STANDARD PERMIT WITH ENHANCED CONTROLS FOR |
|---|
| 12 | 12 | | CERTAIN AGGREGATE PRODUCTION FACILITIES. (a) The commission shall |
|---|
| 13 | 13 | | issue a Standard Permit with Enhanced Controls to a rock crushing |
|---|
| 14 | 14 | | facility that: |
|---|
| 15 | 15 | | (1) is located at an aggregate production operation |
|---|
| 16 | 16 | | required to be registered under Section 28A.051, Water Code; |
|---|
| 17 | 17 | | (2) is used for the production of aggregates, as |
|---|
| 18 | 18 | | defined by Section 28A.001, Water Code; |
|---|
| 19 | 19 | | (3) limits production to under 1500 tons per hour; and |
|---|
| 20 | 20 | | (4) meets the requirements of this section. |
|---|
| 21 | 21 | | (b) The permit process authorized by this section is not |
|---|
| 22 | 22 | | subject to the requirements relating to a contested case hearing |
|---|
| 23 | 23 | | under this chapter, Chapter 5, Water Code, or Subchapters C-G, |
|---|
| 24 | 24 | | Chapter 2001, Government Code. |
|---|
| 25 | 25 | | SECTION 2. The commission shall adopt rules relating to |
|---|
| 26 | 26 | | best management practice requirements for an owner or operator of a |
|---|
| 27 | 27 | | facility to use the permit under this section. The commission may |
|---|
| 28 | 28 | | not establish by rule any requirements that an applicant for a |
|---|
| 29 | 29 | | permit under this section be subject to a hearing under 2001.051, |
|---|
| 30 | 30 | | Government Code. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2023. |
