| 7 | 7 | | relating to the eligibility of certain local governmental entities |

| 8 | 8 | | affected by the realignment of defense worker jobs or facilities to |

| 9 | 9 | | receive grants. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 436.201(a), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (a) The following local governmental entities are eligible |
|---|
| 14 | 14 | | for a grant under this subchapter: |
|---|
| 15 | 15 | | (1) a municipality or county that is a defense |
|---|
| 16 | 16 | | community; |
|---|
| 17 | 17 | | (2) a regional planning commission that has a defense |
|---|
| 18 | 18 | | community within its boundaries; |
|---|
| 19 | 19 | | (3) a public junior college district that is wholly or |
|---|
| 20 | 20 | | partly located in a defense community; |
|---|
| 21 | 21 | | (4) a campus or education extension center of the |
|---|
| 22 | 22 | | Texas State Technical College System that is located in a defense |
|---|
| 23 | 23 | | community; |
|---|
| 24 | 24 | | (5) a defense base development authority created under |
|---|
| 25 | 25 | | Chapter 379B, Local Government Code; [and] |
|---|
| 26 | 26 | | (6) a political subdivision that has the power of a |
|---|
| 27 | 27 | | defense base development authority created under Chapter 379B, |
|---|
| 28 | 28 | | Local Government Code; and |
|---|
| 29 | 29 | | (7) a municipally owned utility that acts as a retail |
|---|
| 30 | 30 | | public utility, as those terms are defined by Section 13.002, Water |
|---|
| 31 | 31 | | Code. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2023. |
