| 7 | 7 | | relating to certain restrictions on package store permit holders. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 22.06(a), Alcoholic Beverage Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (a) Except as otherwise provided in Section 102.05, no |
|---|
| 12 | 12 | | person who holds a package store permit or owns an interest in a |
|---|
| 13 | 13 | | package store may have a direct or indirect interest in any of the |
|---|
| 14 | 14 | | following: |
|---|
| 15 | 15 | | (1) a brewer's [, retail dealer's on-premise,] or |
|---|
| 16 | 16 | | general or branch distributor's license; |
|---|
| 17 | 17 | | (2) a [wine and malt beverage retailer's, wine and malt |
|---|
| 18 | 18 | | beverage retailer's off-premise, or] mixed beverage permit; or |
|---|
| 19 | 19 | | (3) the business of any of the permits or licenses |
|---|
| 20 | 20 | | listed in Subdivisions (1) and (2) of this subsection. |
|---|
| 21 | 21 | | SECTION 2. Section 22.14(d), Alcoholic Beverage Code, is |
|---|
| 22 | 22 | | amended to read as follows: |
|---|
| 23 | 23 | | (d) Subsections (a), (b), and (c) shall not apply to a |
|---|
| 24 | 24 | | package store that: |
|---|
| 25 | 25 | | (1) qualifies for exemption under Section 11.50; |
|---|
| 26 | 26 | | (2) is adjacent [or] to the premises of a business |
|---|
| 27 | 27 | | covered by a wine only package store permit, wine and malt beverage |
|---|
| 28 | 28 | | retailer's permit, or wine and malt beverage retailer's off-premise |
|---|
| 29 | 29 | | permit operated by the package store permit holder; or |
|---|
| 30 | 30 | | (3) is located in a hotel that qualifies for exemption |
|---|
| 31 | 31 | | under Section 102.05. |
|---|
| 32 | 32 | | SECTION 3. Section 22.16, Alcoholic Beverage Code, is |
|---|
| 33 | 33 | | repealed. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2023. |
