66 AN ACT
77 relating to certain restrictions on package store permit holders.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 22.06(a), Alcoholic Beverage Code, is
1010 amended to read as follows:
1111 (a) Except as otherwise provided in Section 102.05, no
1212 person who holds a package store permit or owns an interest in a
1313 package store may have a direct or indirect interest in any of the
1414 following:
1515 (1) a brewer's [, retail dealer's on-premise,] or
1616 general or branch distributor's license;
1717 (2) a [wine and malt beverage retailer's, wine and malt
1818 beverage retailer's off-premise, or] mixed beverage permit; or
1919 (3) the business of any of the permits or licenses
2020 listed in Subdivisions (1) and (2) of this subsection.
2121 SECTION 2. Section 22.14(d), Alcoholic Beverage Code, is
2222 amended to read as follows:
2323 (d) Subsections (a), (b), and (c) shall not apply to a
2424 package store that:
2525 (1) qualifies for exemption under Section 11.50;
2626 (2) is adjacent [or] to the premises of a business
2727 covered by a wine only package store permit, wine and malt beverage
2828 retailer's permit, or wine and malt beverage retailer's off-premise
2929 permit operated by the package store permit holder; or
3030 (3) is located in a hotel that qualifies for exemption
3131 under Section 102.05.
3232 SECTION 3. Section 22.16, Alcoholic Beverage Code, is
3333 repealed.
3434 SECTION 4. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2023.
