88 AN ACT
99 relating to the establishment of an adult education pilot program
1010 by the Windham School District.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 19, Education Code, is amended by adding
1313 Section 19.0052 to read as follows:
1414 Sec. 19.0052. ADULT EDUCATION PILOT PROGRAM. (a) The
1515 Windham School District shall establish a pilot program under which
1616 one or more nonprofit entities provide an adult education program
1717 under Subchapter G, Chapter 12, to enable persons described by
1818 Subsection (b) to successfully complete a high school program that
1919 can lead to a diploma.
2020 (b) A person confined or imprisoned in the department who is
2121 at least 26 years of age and not more than 50 years of age is
2222 eligible to enroll in an adult education program operated under the
2323 pilot program if the person:
2424 (1) has failed to complete the curriculum requirements
2525 for high school graduation;
2626 (2) has failed to perform satisfactorily on an
2727 assessment instrument required for high school graduation; or
2828 (3) has failed to earn a high school equivalency
2929 certificate.
3030 (c) The district shall enter into a memorandum of
3131 understanding with at least one nonprofit entity described by
3232 Section 12.256, Education Code, to provide an adult education
3333 program under the pilot program. The district shall require the
3434 nonprofit entity to identify each region of this state in which the
3535 entity is able to operate an adult education program under the pilot
3636 program.
3737 (d) The district, in consultation with each nonprofit
3838 entity with which the district enters into a memorandum of
3939 understanding under this section, shall identify at least three
4040 schools operated by the district that are suitable to serve as sites
4141 for the pilot program.
4242 SECTION 2. Not later than September 1, 2024, the Windham
4343 School District shall establish and implement the pilot program
4444 required by Section 19.0052, Education Code, as added by this Act.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2023.
