11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 19, Education Code, is amended by adding |
---|
13 | 13 | | Section 19.0052 to read as follows: |
---|
14 | 14 | | Sec. 19.0052. ADULT EDUCATION PILOT PROGRAM. (a) The |
---|
15 | 15 | | Windham School District shall establish a pilot program under which |
---|
16 | 16 | | one or more nonprofit entities provide an adult education program |
---|
17 | 17 | | under Subchapter G, Chapter 12, to enable persons described by |
---|
18 | 18 | | Subsection (b) to successfully complete a high school program that |
---|
19 | 19 | | can lead to a diploma. |
---|
20 | 20 | | (b) A person confined or imprisoned in the department who is |
---|
21 | 21 | | at least 26 years of age and not more than 50 years of age is |
---|
22 | 22 | | eligible to enroll in an adult education program operated under the |
---|
23 | 23 | | pilot program if the person: |
---|
24 | 24 | | (1) has failed to complete the curriculum requirements |
---|
25 | 25 | | for high school graduation; |
---|
26 | 26 | | (2) has failed to perform satisfactorily on an |
---|
27 | 27 | | assessment instrument required for high school graduation; or |
---|
28 | 28 | | (3) has failed to earn a high school equivalency |
---|
29 | 29 | | certificate. |
---|
30 | 30 | | (c) The district shall enter into a memorandum of |
---|
31 | 31 | | understanding with at least one nonprofit entity described by |
---|
32 | 32 | | Section 12.256, Education Code, to provide an adult education |
---|
33 | 33 | | program under the pilot program. The district shall require the |
---|
34 | 34 | | nonprofit entity to identify each region of this state in which the |
---|
35 | 35 | | entity is able to operate an adult education program under the pilot |
---|
36 | 36 | | program. |
---|
37 | 37 | | (d) The district, in consultation with each nonprofit |
---|
38 | 38 | | entity with which the district enters into a memorandum of |
---|
39 | 39 | | understanding under this section, shall identify at least three |
---|
40 | 40 | | schools operated by the district that are suitable to serve as sites |
---|
41 | 41 | | for the pilot program. |
---|
42 | 42 | | SECTION 2. Not later than September 1, 2024, the Windham |
---|
43 | 43 | | School District shall establish and implement the pilot program |
---|
44 | 44 | | required by Section 19.0052, Education Code, as added by this Act. |
---|
45 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
---|
46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
---|
47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
---|
49 | 49 | | Act takes effect September 1, 2023. |
