55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the administration of a grant program to support
88 community mental health programs for veterans and their families.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 531.0992(d-1) and (d-2), Government
1111 Code, are amended to read as follows:
1212 (d-1) For services and treatment provided in a single
1313 county, the commission shall condition each grant provided under
1414 this section on a potential grant recipient providing funds from
1515 non-state sources in a total amount at least equal to:
1616 (1) 25 percent of the grant amount if the community
1717 mental health program to be supported by the grant provides
1818 services and treatment in a county with a population of less than
1919 100,000; or
2020 (2) 50 percent of the grant amount if the community
2121 mental health program to be supported by the grant provides
2222 services and treatment in a county with a population of 100,000 or
2323 more [but less than 250,000; or
2424 [(3) 100 percent of the grant amount if the community
2525 mental health program to be supported by the grant provides
2626 services and treatment in a county with a population of 250,000 or
2727 more].
2828 (d-2) For a community mental health program that provides
2929 services and treatment in more than one county, the commission
3030 shall condition each grant provided under this section on a
3131 potential grant recipient providing funds from non-state sources in
3232 a total amount at least equal to:
3333 (1) 25 percent of the grant amount if the county with
3434 the largest population in which the community mental health program
3535 to be supported by the grant provides services and treatment has a
3636 population of less than 100,000; or
3737 (2) 50 percent of the grant amount if the county with
3838 the largest population in which the community mental health program
3939 to be supported by the grant provides services and treatment has a
4040 population of 100,000 or more [but less than 250,000; or
4141 [(3) 100 percent of the grant amount if the county with
4242 the largest population in which the community mental health program
4343 to be supported by the grant provides services and treatment has a
4444 population of 250,000 or more].
4545 SECTION 2. The changes in law made by this Act apply to a
4646 grant awarded on or after the effective date of this Act. A grant
4747 awarded under a provision amended by this Act is governed by the law
4848 in effect on the date the grant was awarded, and the former law is
4949 continued in effect for that purpose.
5050 SECTION 3. The Health and Human Services Commission is
5151 required to implement the changes in law made by this Act to
5252 Sections 531.0992(d-1) and (d-2), Government Code, only if the
5353 legislature appropriates money specifically for that purpose in an
5454 amount greater than the amount appropriated to the commission for
5555 that purpose for the state fiscal biennium ending August 31, 2023.
5656 If the legislature does not appropriate money specifically for that
5757 purpose and in such amount, the commission may, but is not required
5858 to, implement those changes in law using other money available to
5959 the commission for that purpose.
6060 SECTION 4. This Act takes effect September 1, 2023.
