| 6 | 6 | | relating to certain powers and duties of a drainage district. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 56.111, Water Code, is amended to read as |
|---|
| 9 | 9 | | follows: |
|---|
| 10 | 10 | | Sec. 56.111. CONTROL AND REPAIR OF DISTRICT IMPROVEMENTS. |
|---|
| 11 | 11 | | (a) The board may control and supervise the construction and |
|---|
| 12 | 12 | | maintenance of canals, drains, ditches and levees, and other |
|---|
| 13 | 13 | | improvements of the district and shall keep them in repair. |
|---|
| 14 | 14 | | (b) Notwithstanding any other law, a district described by |
|---|
| 15 | 15 | | this subsection may control, supervise, finance, purchase, |
|---|
| 16 | 16 | | construct, acquire, own, operate, maintain, repair, improve, and |
|---|
| 17 | 17 | | extend inside and outside its boundaries any works, improvements, |
|---|
| 18 | 18 | | facilities, plants, equipment, and appliances necessary to |
|---|
| 19 | 19 | | accomplish the creation and operation of a stormwater reclamation |
|---|
| 20 | 20 | | system and may issue related bonds. This subsection applies only to |
|---|
| 21 | 21 | | a district located in a county that is located adjacent to the |
|---|
| 22 | 22 | | United Mexican States, has a population of more than 800,000, and |
|---|
| 23 | 23 | | contains at least two municipalities each of which has a population |
|---|
| 24 | 24 | | of 70,000 or more. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2023. |
|---|
