55 AN ACT
66 relating to certain powers and duties of a drainage district.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 56.111, Water Code, is amended to read as
99 follows:
1010 Sec. 56.111. CONTROL AND REPAIR OF DISTRICT IMPROVEMENTS.
1111 (a) The board may control and supervise the construction and
1212 maintenance of canals, drains, ditches and levees, and other
1313 improvements of the district and shall keep them in repair.
1414 (b) Notwithstanding any other law, a district described by
1515 this subsection may control, supervise, finance, purchase,
1616 construct, acquire, own, operate, maintain, repair, improve, and
1717 extend inside and outside its boundaries any works, improvements,
1818 facilities, plants, equipment, and appliances necessary to
1919 accomplish the creation and operation of a stormwater reclamation
2020 system and may issue related bonds. This subsection applies only to
2121 a district located in a county that is located adjacent to the
2222 United Mexican States, has a population of more than 800,000, and
2323 contains at least two municipalities each of which has a population
2424 of 70,000 or more.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2023.
