55 AN ACT
66 relating to seeking a waiver under Medicaid to provide a continuous
77 period of eligibility under the program for certain children.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 32.0261, Human Resources Code, is
1010 amended by adding Subsection (m) to read as follows:
1111 (m) This section does not apply to a child who is eligible
1212 for an extended period of continuous eligibility under Section
1313 32.02612.
1414 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
1515 is amended by adding Section 32.02612 to read as follows:
1616 Sec. 32.02612. FEDERAL AUTHORIZATION TO PROVIDE EXTENDED
1717 PERIOD OF CONTINUOUS ELIGIBILITY FOR CERTAIN CHILDREN. (a) The
1818 executive commissioner shall seek a waiver under Section 1115,
1919 Social Security Act (42 U.S.C. Section 1315), to provide for a
2020 continuous period of eligibility for children who are:
2121 (1) determined eligible for medical assistance under
2222 this chapter; and
2323 (2) five years of age or younger.
2424 (b) The waiver sought under this section must ensure that a
2525 child described by Subsection (a) remains continuously eligible for
2626 medical assistance, without additional review and regardless of
2727 changes in the child's resources or household income, from the date
2828 on which the child's eligibility for medical assistance is
2929 determined until the child's sixth birthday.
3030 (c) Subject to approval of the waiver described by
3131 Subsection (a), the executive commissioner shall adopt rules to
3232 implement this section.
3333 SECTION 3. As soon as practicable after the effective date
3434 of this Act, the executive commissioner of the Health and Human
3535 Services Commission shall apply for and actively pursue the waiver
3636 from the Centers for Medicare and Medicaid Services or any other
3737 federal agency required by Section 32.02612, Human Resources Code,
3838 as added by this Act. The commission may delay implementing Section
3939 32.02612, Human Resources Code, as added by this Act, until the
4040 waiver applied for under this section is granted.
4141 SECTION 4. This Act takes effect September 1, 2023.
