66 AN ACT
77 relating to rest breaks for employees of certain contractors with a
88 governmental entity; providing an administrative penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 2252, Government Code, is
1111 amended by adding Section 2252.909 to read as follows:
1212 Sec. 2252.909. REST BREAKS REQUIRED FOR EMPLOYEES
1313 PERFORMING CONSTRUCTION WORK UNDER CONTRACTS WITH GOVERNMENTAL
1414 ENTITIES. (a) In this section:
1515 (1) "Construction contract" means a contract or
1616 agreement for the performance of general construction.
1717 (2) "Contractor" means a person, firm, or corporation
1818 contracting with a governmental entity for general construction.
1919 (3) "Employee" means an individual paid by a
2020 contractor or subcontractor to perform general construction work or
2121 services.
2222 (4) "General construction" means:
2323 (A) erecting or preparing to erect a structure,
2424 including a building, bridge, roadway, public utility facility, or
2525 related structure;
2626 (B) remodeling, extending, repairing, or
2727 demolishing a structure; or
2828 (C) otherwise improving real property or a
2929 structure related to real property.
3030 (5) "Governmental entity" means:
3131 (A) a board, commission, department, office, or
3232 other agency in the executive branch of state government; or
3333 (B) a political subdivision of this state,
3434 including a municipality, county, public school district, or
3535 special-purpose district or authority.
3636 (6) "Rest break" means a break from work during work
3737 hours. The term does not include a regular meal break period
3838 provided to an employee by a contractor or subcontractor.
3939 (b) A governmental entity contracting with a contractor
4040 shall require the contractor and any subcontractor to provide at
4141 least a 10-minute paid rest break within every four-hour period of
4242 work to each employee performing work under the contract.
4343 (c) Each construction contract with a governmental entity
4444 must include terms that:
4545 (1) authorize an employee of a contractor or
4646 subcontractor required to work without a rest break in violation of
4747 Subsection (b) to make a verbal or written complaint to the
4848 governmental entity contracting with the contractor;
4949 (2) explain that, on confirmation of a violation of
5050 Subsection (b) that is the subject of a complaint, the governmental
5151 entity shall provide to the contractor written notice of the
5252 violation by hand delivery or certified mail;
5353 (3) inform a contractor that the governmental entity
5454 may impose an administrative penalty if the contractor fails to
5555 comply with Subsection (b) after the date on which the contractor
5656 receives notice under Subdivision (2); and
5757 (4) explain that a penalty amount may be withheld from
5858 a payment otherwise owed to a contractor under the contract.
5959 (d) In accordance with a construction contract governed by
6060 this section, the governmental entity may impose an administrative
6161 penalty in an amount of not less than $100 and not more than $500 per
6262 day if any employee is required to work without a rest break in
6363 violation of Subsection (b). A proceeding under this section to
6464 impose an administrative penalty is a contested case under Chapter
6565 2001.
6666 (e) Each governmental entity shall develop procedures for
6767 the administration of this section.
6868 (f) This section does not preempt a local ordinance, rule,
6969 or other measure adopted by a political subdivision of this state
7070 requiring rest breaks in accordance with a construction contract
7171 that is compatible with and equal to or more stringent than the
7272 provisions of this section.
7373 SECTION 2. Section 2252.909, Government Code, as added by
7474 this Act, applies only to a contract for which the solicitation of
7575 qualifications, proposals, or other similar expressions of
7676 interest is published on or after September 1, 2023.
7777 SECTION 3. This Act takes effect September 1, 2023.
