| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 775.301, Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 775.301. DEFINITION. In this subchapter, |
|---|
| 13 | 13 | | "commissioners court" means the commissioners court of a county |
|---|
| 14 | 14 | | described by Section 775.302 [that borders the United Mexican |
|---|
| 15 | 15 | | States, has a population of more than 800,000, and appoints a board |
|---|
| 16 | 16 | | of emergency services commissioners under this chapter]. |

| 17 | 17 | | SECTION 2. Section 775.302(a), Health and Safety Code, is |
|---|
| 18 | 18 | | amended to read as follows: |
|---|
| 19 | 19 | | (a) This subchapter applies only to a district with an |
|---|
| 20 | 20 | | appointed [that is located wholly in a county that borders the |
|---|
| 21 | 21 | | United Mexican States, that has a population of more than 800,000, |
|---|
| 22 | 22 | | and for which the commissioners court appoints a] board of |
|---|
| 23 | 23 | | emergency services commissioners located wholly in a county that: |
|---|
| 24 | 24 | | (1) borders the United Mexican States and has a |
|---|
| 25 | 25 | | population of more than 800,000; or |
|---|
| 26 | 26 | | (2) contains a reservoir operated by a river authority |
|---|
| 27 | 27 | | and has a population of at least 60,000 and not more than 65,000 |
|---|
| 28 | 28 | | [under Section 775.034]. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2023. |
