| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 26, Education Code, is amended by adding |
|---|
| 11 | 11 | | Section 26.0086 to read as follows: |
|---|
| 12 | 12 | | Sec. 26.0086. RIGHT TO INFORMATION CONCERNING GENDER |
|---|
| 13 | 13 | | IDENTITY. (a) A parent is entitled to information concerning the |
|---|
| 14 | 14 | | gender identity of the parent's child. |
|---|
| 15 | 15 | | (b) Not later than 24 hours after an employee of a school |
|---|
| 16 | 16 | | district or open-enrollment charter school discovers information |
|---|
| 17 | 17 | | indicating that a student enrolled in the district or school is or |
|---|
| 18 | 18 | | is considering identifying, through appearance, expression, or |
|---|
| 19 | 19 | | behavior, as a sex other than the biological sex the student was |
|---|
| 20 | 20 | | assigned at birth, the district or school shall notify the |
|---|
| 21 | 21 | | student's parent of the information discovered. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
