66 AN ACT
77 relating to reporting by operators of certain gas supply chain
88 facilities and gas pipeline facilities on a failure to perform a
99 contractual obligation due to a weather emergency.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 86.044, Natural Resources Code, is
1212 amended by adding Subsection (g-1) to read as follows:
1313 (g-1) The commission by rule shall require each operator of
1414 a gas supply chain facility that fails to perform a contractual
1515 obligation related to the provision of natural gas in the
1616 electricity supply chain as mapped under Section 38.203, Utilities
1717 Code, due to force majeure during a weather emergency to report the
1818 failure and force majeure to the commission not later than the 60th
1919 day after the date of the failure. Information provided by an
2020 operator of a gas supply chain facility under this subsection is
2121 confidential and is not subject to disclosure under Chapter 552,
2222 Government Code, unless the requestor is a party to the contract.
2323 SECTION 2. Section 121.2015, Utilities Code, is amended by
2424 adding Subsection (e-1) to read as follows:
2525 (e-1) The railroad commission by rule shall require each gas
2626 pipeline facility operator described by Subsection (a)(3) that
2727 fails to perform a contractual obligation regarding the provision
2828 of gas in the electricity supply chain as mapped under Section
2929 38.203 due to force majeure during a weather emergency to report the
3030 failure and force majeure to the railroad commission not later than
3131 the 60th day after the date of the failure. Information provided by
3232 a gas pipeline facility operator under this subsection is
3333 confidential and is not subject to disclosure under Chapter 552,
3434 Government Code, unless the requestor is a party to the contract.
3535 SECTION 3. This Act takes effect September 1, 2023.
