| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 86.044, Natural Resources Code, is |
|---|
| 12 | 12 | | amended by adding Subsection (g-1) to read as follows: |
|---|
| 13 | 13 | | (g-1) The commission by rule shall require each operator of |
|---|
| 14 | 14 | | a gas supply chain facility that fails to perform a contractual |
|---|
| 15 | 15 | | obligation related to the provision of natural gas in the |
|---|
| 16 | 16 | | electricity supply chain as mapped under Section 38.203, Utilities |
|---|
| 17 | 17 | | Code, due to force majeure during a weather emergency to report the |
|---|
| 18 | 18 | | failure and force majeure to the commission not later than the 60th |
|---|
| 19 | 19 | | day after the date of the failure. Information provided by an |
|---|
| 20 | 20 | | operator of a gas supply chain facility under this subsection is |
|---|
| 21 | 21 | | confidential and is not subject to disclosure under Chapter 552, |
|---|
| 22 | 22 | | Government Code, unless the requestor is a party to the contract. |

| 23 | 23 | | SECTION 2. Section 121.2015, Utilities Code, is amended by |
|---|
| 24 | 24 | | adding Subsection (e-1) to read as follows: |
|---|
| 25 | 25 | | (e-1) The railroad commission by rule shall require each gas |
|---|
| 26 | 26 | | pipeline facility operator described by Subsection (a)(3) that |
|---|
| 27 | 27 | | fails to perform a contractual obligation regarding the provision |
|---|
| 28 | 28 | | of gas in the electricity supply chain as mapped under Section |
|---|
| 29 | 29 | | 38.203 due to force majeure during a weather emergency to report the |
|---|
| 30 | 30 | | failure and force majeure to the railroad commission not later than |
|---|
| 31 | 31 | | the 60th day after the date of the failure. Information provided by |
|---|
| 32 | 32 | | a gas pipeline facility operator under this subsection is |
|---|
| 33 | 33 | | confidential and is not subject to disclosure under Chapter 552, |
|---|
| 34 | 34 | | Government Code, unless the requestor is a party to the contract. |

| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2023. |
