55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to size limitations for certain vehicles transporting
88 agricultural products and equipment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 504.505(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) The department shall issue specialty license plates for
1313 a single motor vehicle that is:
1414 (1) used only to transport chile pepper modules, seed
1515 cotton, cotton, cotton burrs, hay, or equipment used in
1616 transporting or processing chile peppers, [or] cotton, or hay; and
1717 (2) not more than 10 feet in width.
1818 SECTION 2. Section 622.101, Transportation Code, is amended
1919 by amending Subsection (a) and adding Subsection (d) to read as
2020 follows:
2121 (a) Except as provided by Subsection (d), a [A] single motor
2222 vehicle or truck-tractor operated in combination with a semitrailer
2323 and trailer or semitrailer and semitrailer used exclusively to
2424 transport chile pepper modules, seed cotton, cotton, cotton burrs,
2525 hay, or equipment used to transport or process chile pepper
2626 modules, [or] cotton, or hay, including a motor vehicle or burr
2727 spreader, may not be operated on a highway or road if the vehicle
2828 is:
2929 (1) wider than 10 feet and the highway has not been
3030 designated by the commission under Section 621.202;
3131 (2) longer than 48 feet, if the vehicle is a single
3232 motor vehicle; or
3333 (3) higher than 14 feet 6 inches, if the vehicle is a
3434 single motor vehicle.
3535 (d) Subsection (a) does not apply to a vehicle transporting
3636 cylindrical bales of hay under a permit issued under Section
3737 623.017.
3838 SECTION 3. Section 622.902, Transportation Code, is amended
3939 to read as follows:
4040 Sec. 622.902. LENGTH EXCEPTIONS. The length limitations
4141 provided by Sections 621.203 to 621.205 do not apply to:
4242 (1) machinery used exclusively for drilling water
4343 wells, including machinery that is itself a unit or that is a unit
4444 mounted on a conventional vehicle or chassis;
4545 (2) a vehicle owned or operated by a public, private,
4646 or volunteer fire department;
4747 (3) a vehicle or combination of vehicles operated
4848 exclusively in the territory of a municipality or to a combination
4949 of vehicles operated by a municipality in a suburb adjoining the
5050 municipality in which the municipality has been using the equipment
5151 or similar equipment in connection with an established service to
5252 the suburb;
5353 (4) a truck-tractor, truck-tractor combination, or
5454 truck-trailer combination exclusively transporting machinery,
5555 materials, and equipment used in the construction, operation, and
5656 maintenance of facilities, including pipelines, that are used for
5757 the discovery, production, and processing of natural gas or
5858 petroleum;
5959 (5) a drive-away saddlemount vehicle transporter
6060 combination or a drive-away saddlemount with fullmount vehicle
6161 transporter combination, as defined by 23 C.F.R. Part 658 or its
6262 successor, if:
6363 (A) the overall length of the combination is not
6464 longer than 97 feet; and
6565 (B) the combination does not have more than three
6666 saddlemounted vehicles if the combination does not include more
6767 than one fullmount vehicle;
6868 (6) the combination of a tow truck and another vehicle
6969 or vehicle combination if:
7070 (A) the other vehicle or vehicle combination
7171 cannot be normally or safely driven or was abandoned on a highway;
7272 and
7373 (B) the tow truck is towing the other vehicle or
7474 vehicle combination directly to the nearest authorized place of
7575 repair, terminal, or destination of unloading;
7676 (7) a vehicle or combination of vehicles used to
7777 transport a harvest machine that is used in farm custom harvesting
7878 operations on a farm if the overall length of the vehicle or
7979 combination is not longer than:
8080 (A) 75 feet if the vehicle is traveling on a
8181 highway that is part of the national system of interstate and
8282 defense highways or the federal aid primary highway system; or
8383 (B) 81-1/2 feet if the vehicle is not traveling
8484 on a highway that is part of the national system of interstate and
8585 defense highways or the federal aid primary highway system;
8686 (8) a truck-tractor operated in combination with a
8787 semitrailer and trailer or semitrailer and semitrailer if:
8888 (A) the combination is used to transport a
8989 harvest machine that is used in farm custom harvesting operations
9090 on a farm;
9191 (B) the overall length of the combination,
9292 excluding the length of the truck-tractor, is not longer than
9393 81-1/2 feet; and
9494 (C) the combination is traveling on a highway
9595 that:
9696 (i) is not part of the national system of
9797 interstate and defense highways or the federal aid primary highway
9898 system; and
9999 (ii) is located in a county with a
100100 population of less than 300,000; [or]
101101 (9) a truck-tractor operated in combination with a
102102 semitrailer and trailer or semitrailer and semitrailer if:
103103 (A) the combination is used to transport chile
104104 pepper modules, seed cotton, cotton, cotton burrs, hay, or
105105 equipment used to transport or process chile pepper modules,
106106 cotton, or hay, including a motor vehicle or burr spreader; and
107107 (B) the overall length of the combination is not
108108 longer than:
109109 (i) 75 feet if the combination is traveling
110110 on a highway that is part of the national system of interstate and
111111 defense highways or the federal aid primary highway system; or
112112 (ii) 81-1/2 feet if the combination is not
113113 traveling on a highway that is part of the national system of
114114 interstate and defense highways or the federal aid primary highway
115115 system; or
116116 (10) a towaway trailer transporter combination, as
117117 defined by 49 U.S.C. Section 31111, if the overall length of the
118118 combination is not longer than 82 feet.
119119 SECTION 4. This Act takes effect September 1, 2023.
