55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of platting and subdivisions of land by a
88 municipality or county.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 212.003(a), Local Government Code, is
1111 amended to read as follows:
1212 (a) In [The governing body of a municipality by ordinance
1313 may extend to the extraterritorial jurisdiction of the municipality
1414 the application of municipal ordinances adopted under Section
1515 212.002 and other municipal ordinances relating to access to public
1616 roads or the pumping, extraction, and use of groundwater by persons
1717 other than retail public utilities, as defined by Section 13.002,
1818 Water Code, for the purpose of preventing the use or contact with
1919 groundwater that presents an actual or potential threat to human
2020 health. However, unless otherwise authorized by state law, in] its
2121 extraterritorial jurisdiction a municipality shall not regulate,
2222 either directly or indirectly:
2323 (1) the use of any building or property for business,
2424 industrial, residential, or other purposes;
2525 (2) the bulk, height, or number of buildings
2626 constructed on a particular tract of land;
2727 (3) the size of a building that can be constructed on a
2828 particular tract of land, including without limitation any
2929 restriction on the ratio of building floor space to the land square
3030 footage;
3131 (4) the number of residential units that can be built
3232 per acre of land; [or]
3333 (5) the size, type, or method of construction of a
3434 water or wastewater facility that can be constructed to serve a
3535 developed tract of land if[:
3636 [(A)] the facility meets the minimum standards
3737 established for water or wastewater facilities by state and federal
3838 regulatory entities; or
3939 (6) minimum lot sizes, lot dimensions, lot frontages,
4040 lot setbacks, or other components of lot density [and
4141 [(B) the developed tract of land is:
4242 [(i) located in a county with a population
4343 of 2.8 million or more; and
4444 [(ii) served by:
4545 [(a) on-site septic systems
4646 constructed before September 1, 2001, that fail to provide adequate
4747 services; or
4848 [(b) on-site water wells constructed
4949 before September 1, 2001, that fail to provide an adequate supply of
5050 safe drinking water].
5151 SECTION 2. Sections 232.101(a) and (b), Local Government
5252 Code, are amended to read as follows:
5353 (a) By an order adopted and entered in the minutes of the
5454 commissioners court and after a notice is published in a newspaper
5555 of general circulation in the county, the commissioners court may
5656 adopt rules governing plats and subdivisions of land within the
5757 unincorporated area of the county as authorized in this subchapter
5858 [to promote the health, safety, morals, or general welfare of the
5959 county and the safe, orderly, and healthful development of the
6060 unincorporated area of the county].
6161 (b) A [Unless otherwise authorized by state law, a]
6262 commissioners court shall not regulate, either directly or
6363 indirectly [under this section]:
6464 (1) the use of any building or property for business,
6565 industrial, residential, or other purposes;
6666 (2) the bulk, height, or number of buildings
6767 constructed on a particular tract of land;
6868 (3) the size of a building that can be constructed on a
6969 particular tract of land, including without limitation and
7070 restriction on the ratio of building floor space to the land square
7171 footage;
7272 (4) the number of residential units that can be built
7373 per acre of land;
7474 (5) a plat or subdivision in an adjoining county; [or]
7575 (6) road access to a plat or subdivision in an
7676 adjoining county; or
7777 (7) minimum lot sizes, lot dimensions, lot frontages,
7878 lot setbacks, or other components of lot density.
7979 SECTION 3. Section 212.003(a), Local Government Code, as
8080 amended by this Act, and Sections 232.101(a) and (b), Local
8181 Government Code, as amended by this Act, apply only to a plat filed
8282 on or after the effective date of this Act.
8383 SECTION 4. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2023.
