55 AN ACT
66 relating to the authority of a municipality, county, or property
77 owners' association to prohibit or regulate certain activities on
88 residence homestead property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 250, Local Government Code, is amended
1111 by adding Section 250.014 to read as follows:
1212 Sec. 250.014. ACTIVITIES ALLOWED ON RESIDENCE HOMESTEAD
1313 PROPERTY. (a) In this section, "residence homestead property"
1414 means real property that is all or part of a residence homestead, as
1515 defined by Section 11.13(j), Tax Code.
1616 (b) Notwithstanding any other law and except as provided by
1717 this section, a municipality or county may not adopt or enforce an
1818 ordinance that prohibits any of the following activities on
1919 residence homestead property:
2020 (1) growing fruits and vegetables;
2121 (2) raising or keeping:
2222 (A) six or fewer domestic fowl; or
2323 (B) six or fewer adult rabbits; or
2424 (3) installing for on-site use:
2525 (A) a solar or wind-powered energy device, as
2626 defined by Section 11.27, Tax Code;
2727 (B) an underground shelter;
2828 (C) rain barrels or a rainwater harvesting
2929 system; or
3030 (D) a standby electric generator, as defined by
3131 Section 202.019, Property Code.
3232 (c) A municipality or county may impose reasonable
3333 regulations on the growing of fruits and vegetables on residence
3434 homestead property that do not have the effect of prohibiting the
3535 growing of the fruits or vegetables in the front, side, or rear yard
3636 of a residence, including:
3737 (1) a requirement that the growing area be maintained
3838 in good condition if visible from the street faced by the property
3939 or from an adjoining lot; and
4040 (2) a requirement for the trimming or removal of a tree
4141 as necessary for the maintenance of a utility easement.
4242 (d) A municipality or county may impose reasonable
4343 regulations on the raising or keeping of fowl or rabbits on
4444 residence homestead property to control odor, noise, safety, or
4545 sanitary conditions that do not have the effect of prohibiting the
4646 raising or keeping of the fowl or rabbits, including:
4747 (1) a limit on the number of fowl or rabbits that is
4848 more than:
4949 (A) the minimum number allowed by Subsection
5050 (b)(2); or
5151 (B) a total combined number of eight fowl and
5252 rabbits, subject to the limits of Subsection (b)(2);
5353 (2) a prohibition on raising or keeping a rooster;
5454 (3) the minimum distance between an animal shelter and
5555 a residential structure other than the animal owner's own
5656 residence;
5757 (4) a requirement for fencing or shelter sufficient to
5858 contain the fowl or rabbits on the owner's residence homestead
5959 property;
6060 (5) minimum requirements for combined housing and
6161 outdoor space of at least:
6262 (A) 20 square feet per fowl; and
6363 (B) nine square feet per rabbit;
6464 (6) a requirement to address sanitary conditions in a
6565 manner that prevents accumulation of animal waste in a quantity
6666 sufficient to create an offensive odor or attract pests; or
6767 (7) a requirement that the fowl or rabbits may only be
6868 kept in the side or rear yard of a residence.
6969 (e) This section does not apply to a condominium unit.
7070 SECTION 2. Chapter 250, Local Government Code, is amended
7171 by adding Section 250.015 to read as follows:
7272 Sec. 250.015. MUNICIPAL OR COUNTY REGULATIONS VOID. An
7373 order, ordinance, rule or other regulation adopted by a
7474 municipality or county that violates Section 250.014 is void.
7575 SECTION 3. Chapter 202, Property Code, is amended by adding
7676 Section 202.027 to read as follows:
7777 Sec. 202.027. ACTIVITIES ALLOWED ON RESIDENCE HOMESTEAD
7878 PROPERTY. (a) In this section, "residence homestead property"
7979 means real property that is all or part of a residence homestead, as
8080 defined by Section 11.13(j), Tax Code.
8181 (b) Notwithstanding any other law and except as provided by
8282 this section, a property owners' association may not adopt or
8383 enforce a restrictive covenant that prohibits any of the following
8484 activities on residence homestead property:
8585 (1) growing fruits and vegetables;
8686 (2) raising or keeping:
8787 (A) six or fewer domestic fowl; or
8888 (B) six or fewer adult rabbits;
8989 (3) installing for on-site use:
9090 (A) a solar or wind-powered energy device, as
9191 defined by Section 11.27, Tax Code;
9292 (B) an underground shelter;
9393 (C) rain barrels or a rainwater harvesting
9494 system; or
9595 (D) a standby electric generator, as defined by
9696 Section 202.019; or
9797 (4) producing food at a cottage food production
9898 operation, as defined by Section 437.001(2-b), Health and Safety
9999 Code.
100100 (c) A property owners' association may adopt and enforce a
101101 restrictive covenant imposing reasonable requirements on the
102102 growing of fruits and vegetables on residence homestead property
103103 that do not have the effect of prohibiting the growing of the fruits
104104 or vegetables in the front, side, or rear yard of a residence,
105105 including:
106106 (1) a requirement that the growing area be maintained
107107 in good condition if visible from the street faced by the property
108108 or from an adjoining lot; and
109109 (2) a requirement for the trimming or removal of a tree
110110 as necessary for the maintenance of a utility easement.
111111 (d) A property owners' association may adopt and enforce a
112112 restrictive covenant imposing reasonable requirements on the
113113 raising or keeping of fowl or rabbits on residence homestead
114114 property to control odor, noise, safety, or sanitary conditions
115115 that do not have the effect of prohibiting the raising or keeping of
116116 the fowl or rabbits, including:

119119 (A) the minimum number allowed by Subsection
120120 (b)(2); or
121121 (B) a total combined number of eight fowl and
122122 rabbits, subject to the limits of Subsection (b)(2);
123123 (2) a prohibition on raising or keeping a rooster;
124124 (3) the minimum distance between an animal shelter and
125125 a residential structure other than the animal owner's own
126126 residence;
127127 (4) a requirement for fencing or shelter sufficient to
128128 contain the fowl or rabbits on the owner's residence homestead
129129 property;
130130 (5) minimum requirements for combined housing and
131131 outdoor space of at least:
132132 (A) 20 square feet per fowl; and
133133 (B) nine square feet per rabbit;
134134 (6) a requirement to address sanitary conditions in a
135135 manner that prevents accumulation of animal waste in a quantity
136136 sufficient to create an offensive odor or attract pests; or
137137 (7) a requirement that the fowl or rabbits may only be
138138 kept in the side or rear yard of a residence.
139139 SECTION 4. Section 151.3131(b), Tax Code, is amended to
140140 read as follows:
141141 (b) The sale, storage, use, or other consumption of a
142142 firearm, a firearm accessory, ammunition, or firearm safety
143143 equipment is exempted from the taxes imposed by this chapter.
144144 SECTION 5. Chapter 202, Property Code, is amended by adding
145145 Section 202.025 to read as follows:
146146 Sec. 202.025. LIMITATIONS. (a) Section 202.024 does not:
147147 (1) restrict a property owners' association from:
148148 (A) regulating the size and shielding of, or the
149149 materials used in the construction of, an animal shelter that is
150150 visible from a street, another lot, or a common area if the
151151 restriction does not prohibit the economic installation of the
152152 animal shelter on the property owner's residence homestead
153153 property;
154154 (B) regulating or prohibiting the installation
155155 of signage by a cottage food operation; or
156156 (2) require a property owners' association to permit
157157 the growing of fruits or vegetables or the raising or keeping of
158158 fowl or rabbits on property:
159159 (A) owned by the property owners' association; or
160160 (B) owned in common by the members of the
161161 property owners' association.
162162 (b) Section 202.024 does not apply to a condominium council
163163 of owners governed by Chapter 81 or unit owners' association
164164 governed by Chapter 82.
165165 SECTION 6. Chapter 202, Property Code, is amended by adding
166166 Section 202.026 to read as follows:
167167 Sec. 202.026. DEDICATORY INSTRUMENTS VOID. A provision in
168168 a dedicatory instrument that violates Section 202.024 is void.
169169 SECTION 7. Chapter 202, Property Code, is amended by adding
170170 Section 202.024 to read as follows:
171171 Sec. 202.024. FOOD PRODUCTION ALLOWED ON SINGLE-FAMILY
172172 RESIDENTIAL LOT. (a) Notwithstanding any other law and except as
173173 provided by this section, a property owners' association may not
174174 adopt or enforce a restrictive covenant that prohibits any of the
175175 following activities on a single-family residential lot:
176176 (1) growing fruits and vegetables;
177177 (2) raising or keeping:
178178 (A) six or fewer domestic fowl; or
179179 (B) six or fewer adult rabbits; or
180180 (3) producing food at a cottage food production
181181 operation, as defined by Section 437.001(2-b), Health and Safety
182182 Code.
183183 (b) A property owners' association may adopt and enforce a
184184 restrictive covenant imposing reasonable requirements on the
185185 growing of fruits and vegetables on a single-family residential lot
186186 that do not have the effect of prohibiting the growing of the fruits
187187 or vegetables in the front, side, or rear yard of a residence,
188188 including:
189189 (1) a requirement that the growing area be maintained
190190 in good condition if visible from the street faced by the lot or
191191 from an adjoining lot; and
192192 (2) a requirement for the trimming or removal of a tree
193193 as necessary for the maintenance of a utility easement.
194194 (c) A property owners' association may adopt and enforce a
195195 restrictive covenant imposing reasonable requirements on the
196196 raising or keeping of fowl or rabbits on a single-family
197197 residential lot to control odor, noise, safety, or sanitary
198198 conditions that do not have the effect of prohibiting the raising or
199199 keeping of the fowl or rabbits, including:
200200 (1) a limit on the number of fowl or rabbits that is
201201 more than:
202202 (A) the minimum number allowed by Subsection
203203 (a)(2); or
204204 (B) a total combined number of eight fowl and
205205 rabbits, subject to the limits of Subsection (a)(2);
206206 (2) a prohibition on raising or keeping a rooster;
207207 (3) the minimum distance between an animal shelter and
208208 a residential structure other than the animal owner's own
209209 residence;
210210 (4) a requirement for fencing or shelter sufficient to
211211 contain the fowl or rabbits on the owner's property;
212212 (5) minimum requirements for combined housing and
213213 outdoor space of at least:
214214 (A) 20 square feet per fowl; and
215215 (B) nine square feet per rabbit;
216216 (6) a requirement to address sanitary conditions in a
217217 manner that prevents accumulation of animal waste in a quantity
218218 sufficient to create an offensive odor or attract pests; or
219219 (7) a requirement that the fowl or rabbits may only be
220220 kept in the side or rear yard of a residence.
221221 (d) This section does not:
222222 (1) restrict a property owners' association from:
223223 (A) regulating the size and shielding of, or the
224224 materials used in the construction of, an animal shelter that is
225225 visible from a street, another lot, or a common area if the
226226 restriction does not prohibit the economic installation of the
227227 animal shelter on the property owner's property; or
228228 (B) regulating parking or vehicular or
229229 pedestrian traffic associated with a cottage food operation; or
230230 (2) require a property owners' association to permit
231231 the growing of fruits or vegetables or the raising or keeping of
232232 fowl or rabbits on property:
233233 (A) owned by the property owners' association; or
234234 (B) owned in common by the members of the
235235 property owners' association.
236236 (e) This section does not apply to a condominium council of
237237 owners governed by Chapter 81 or unit owners' association governed
238238 by Chapter 82.
239239 (f) A provision that violates this section is void.
240240 SECTION 8. Section 250.014, Local Government Code, as added
241241 by this Act, applies to an order, ordinance, resolution, rule, or
242242 other regulation adopted before, on, or after the effective date of
243243 this Act.
244244 SECTION 9. This Act takes effect on September 1, 2023.
