1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 ARTICLE 1. GENERAL PROVISIONS
1212 SECTION 1.01. DEFINITION. In this Act, "ARPA fund" means
1313 money received by this state from the Coronavirus State Fiscal
1414 Recovery Fund (42 U.S.C. Section 802) established under the
1515 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
1616 to the credit of the Coronavirus Relief Fund No. 325.
1717 ARTICLE 2. GENERAL GOVERNMENT
1818 SECTION 2.01. EMPLOYEES RETIREMENT SYSTEM: IMPLEMENTING
1919 PRIOR LEGISLATION. (a) The amount of $165,600,000 is appropriated
2020 from the general revenue fund to the Employees Retirement System
2121 for the two-year period beginning on the effective date of this Act
2222 for the purpose of implementing the provisions of Chapter 940 (S.B.
2323 321), Acts of the 87th Legislature, Regular Session, 2021.
2424 (b) The appropriations made in this section are for the
2525 purpose of amortizing the Employees Retirement System Retirement
2626 Program's unfunded actuarial liabilities not later than the state
2727 fiscal year ending August 31, 2054, consistent with Chapter 940
2828 (S.B. 321), Acts of the 87th Legislature, Regular Session, 2021.
2929 SECTION 2.02. EMPLOYEES RETIREMENT SYSTEM: UNFUNDED
3030 ACTUARIAL LIABILITIES. The amount of $1,000,000,000 is
3131 appropriated from the general revenue fund to the Employees
3232 Retirement System for the two-year period beginning on the
3333 effective date of this Act for the purpose of amortizing the
3434 Employees Retirement System Retirement Program's unfunded
3535 actuarial liabilities.
3636 SECTION 2.03. COMPTROLLER OF PUBLIC ACCOUNTS: OPIOID
3737 SETTLEMENT FUNDS. The amount of $26,846,996.60 is appropriated
3838 from the general revenue fund to the comptroller of public accounts
3939 for immediate deposit to the opioid abatement trust fund pursuant
4040 to Section 403.507(b)(2), Government Code, from money obtained
4141 under the statewide opioid settlement agreement in State of Texas
4242 v. McKinsey & Company, Inc., United States, No. D-1-GN-21-000551
4343 (98th Dist. Ct., Travis County, Tex., Feb. 4, 2021).
4444 SECTION 2.04. FISCAL PROGRAMS - COMPTROLLER OF PUBLIC
4545 ACCOUNTS: TEXAS GUARANTEED TUITION PLAN. The amount of
4646 $243,800,000 is appropriated from the general revenue fund to
4747 Fiscal Programs - Comptroller of Public Accounts for the two-year
4848 period beginning on the effective date of this Act for the purpose
4949 of paying contract obligations and program expenses for the
5050 Guaranteed Tuition Plan/Texas Tomorrow Fund.
5151 SECTION 2.05. COMPTROLLER OF PUBLIC ACCOUNTS: DEFERRED
5252 MAINTENANCE DEDICATION. Not later than August 31, 2023, the
5353 comptroller of public accounts shall transfer the amount of
5454 $400,000,000 from the general revenue fund to the deferred
5555 maintenance account number 5166 to be used for the purpose of
5656 addressing future maintenance of state buildings as directed by the
5757 legislature.
5858 SECTION 2.06. FACILITIES COMMISSION: LIBRARY AND ARCHIVES
5959 COMMISSION FACILITY. (a) The amount of $210,000,000 is
6060 appropriated from the general revenue fund to the Texas Facilities
6161 Commission for the two-year period beginning on the effective date
6262 of this Act for the purpose of constructing a new facility to be
6363 used by the Library and Archives Commission for records and archive
6464 storage.
6565 (b) The General Land Office, the Texas Facilities
6666 Commission, the Library and Archives Commission, and other
6767 necessary state agencies are directed to take all legal actions
6868 necessary to sell the Library and Archives Commission facility and
6969 adjacent state-owned land currently located on Shoal Creek in the
7070 City of Austin, Texas ("the Shoal Creek facility"). The proceeds
7171 from the sale of the Shoal Creek facility may be appropriated by a
7272 future legislature to defray costs of the construction of the new
7373 facility described by Subsection (a) of this section.
7474 (c) Any additional full-time equivalent (FTE) employees the
7575 Texas Facilities Commission may require to achieve the purpose for
7676 which the appropriation under Subsection (a) of this section was
7777 made are reflected in the total number of full-time equivalent
7878 (FTE) employees authorized for the commission in H.B. 1, Acts of the
7979 88th Legislature, Regular Session, 2023 (the General
8080 Appropriations Act).
8181 (d) The capital budget authority of the Texas Facilities
8282 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
8383 Regular Session, 2021 (the General Appropriations Act), is
8484 increased by $210,000,000 for the appropriation made under
8585 Subsection (a) of this section.
8686 (e) The capital budget authority of the Texas Facilities
8787 Commission in H.B. 1, Acts of the 88th Legislature, Regular
8888 Session, 2023 (the General Appropriations Act), for the state
8989 fiscal biennium beginning September 1, 2023, is increased by
9090 $210,000,000 for the appropriation made under Subsection (a) of
9191 this section.
9292 SECTION 2.07. APPROPRIATION REDUCTION: DEPARTMENT OF
9393 INFORMATION RESOURCES. The unencumbered appropriations from the
9494 ARPA fund and the related increase in capital budget authority made
9595 to the Department of Information Resources by Section 25, Chapter
9696 10 (S.B. 8), Acts of the 87th Legislature, 3rd Called Session, 2021
9797 (the Supplemental Appropriations Act), for cybersecurity projects
9898 are reduced by $200,000,000.
9999 SECTION 2.08. APPROPRIATION REDUCTION: PUBLIC FINANCE
100100 AUTHORITY. (a) The unencumbered appropriations from the general
101101 revenue fund to the Public Finance Authority made by Chapter 1053
102102 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021 (the
103103 General Appropriations Act), for use during the state fiscal
104104 biennium ending August 31, 2023, for bond debt service payments,
105105 including appropriations subject to Rider 3, page I-52, Chapter
106106 1053 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021
107107 (the General Appropriations Act), to the bill pattern of the
108108 appropriations to the Public Finance Authority, are reduced by a
109109 total of $18,466,179.
110110 (b) The Public Finance Authority shall identify the
111111 strategies and objectives out of which the reduction in
112112 appropriations described by Subsection (a) of this section are to
113113 be made and the amount of the reduction for each of those strategies
114114 and objectives.
115115 SECTION 2.09. PUBLIC FINANCE AUTHORITY: CUSTOMER RATE
116116 RELIEF CHARGES RELATED TO WINTER STORM URI. Contingent on the
117117 enactment of legislation by the 88th Legislature, Regular Session,
118118 2023, relating to the payment of gas customer rate relief charges
119119 imposed for costs related to Winter Storm Uri, the amount necessary
120120 to implement the provisions of that legislation (estimated to be
121121 $3,861,553,084) is appropriated from the general revenue fund to
122122 the Public Finance Authority for the two-year period beginning on
123123 the effective date of this Act for the purpose of making a grant to
124124 the issuing financing entity created under Section 1232.1072,
125125 Government Code, to be used to pay the aggregate customer rate
126126 relief charges authorized by Subchapter I, Chapter 104, Utilities
127127 Code, on behalf of customers in lieu of monthly charges in order to
128128 assist with recovery from the impact of Winter Storm Uri.
129129 SECTION 2.10. STATE PRESERVATION BOARD: ENDOWMENT FUND.
130130 Contingent on the enactment of legislation by the 88th Legislature,
131131 Regular Session, 2023, relating to the creation of an endowment
132132 fund for the State Preservation Board to be held by the Texas
133133 Treasury Safekeeping Trust Company, the amount of $200,000,000 is
134134 appropriated from the general revenue fund to the comptroller of
135135 public accounts for the period beginning on the effective date of
136136 this Act and ending August 31, 2023, to be deposited before August
137137 31, 2023, to the endowment fund for use by the State Preservation
138138 Board for the purposes described by that legislation.
139139 SECTION 2.11. STATE PRESERVATION BOARD: MAINTENANCE FOR
140140 TEXAS STATE HISTORY MUSEUM. (a) The amount of $2,975,000 is
141141 appropriated from the general revenue fund to the State
142142 Preservation Board for the two-year period beginning on the
143143 effective date of this Act for the purpose of replacing the roof and
144144 boiler system of the Texas State History Museum.
145145 (b) The capital budget authority of the State Preservation
146146 Board in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
147147 Regular Session, 2021 (the General Appropriations Act), is
148148 increased by $2,975,000 for the appropriation made under Subsection
149149 (a) of this section.
150150 (c) The capital budget authority of the State Preservation
151151 Board in H.B. 1, Acts of the 88th Legislature, Regular Session, 2023
152152 (the General Appropriations Act), for the state fiscal biennium
153153 beginning September 1, 2023, is increased by $2,975,000 for the
154154 appropriation made under Subsection (a) of this section.
155155 SECTION 2.12. TEXAS HISTORICAL COMMISSION: FORT VELASCO
156156 HISTORICAL SITE. The amount of $500,000 is appropriated from the
157157 general revenue fund to the Texas Historical Commission for the
158158 two-year period beginning on the effective date of this Act for the
159159 purpose of making a grant for the maintenance and improvement of the
160160 Fort Velasco Historic Site.
161161 SECTION 2.13. TEXAS HISTORICAL COMMISSION: ENDOWMENT FUND.
162162 Contingent on the enactment of legislation by the 88th Legislature,
163163 Regular Session, 2023, relating to the creation of an endowment
164164 fund for the Texas Historical Commission to be held by the Texas
165165 Treasury Safekeeping Trust Company, the amount of $300,000,000 is
166166 appropriated from the general revenue fund to the comptroller of
167167 public accounts for the period beginning on the effective date of
168168 this Act and ending August 31, 2023, to be deposited before August
169169 31, 2023, to the endowment fund for use by the Texas Historical
170170 Commission for the purposes described by that legislation.
171171 SECTION 2.14. TEXAS HISTORICAL COMMISSION: SAN JACINTO
172172 BATTLEGROUND STATE HISTORIC SITE. (a) The amount of $102,700,000
173173 is appropriated from the general revenue fund to the Texas
174174 Historical Commission for the two-year period beginning on the
175175 effective date of this Act for the purpose of restoring the San
176176 Jacinto Battleground State Historic Site and making improvements to
177177 the visitor center for the site.
178178 (b) The capital budget authority of the Texas Historical
179179 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
180180 Regular Session, 2021 (the General Appropriations Act), is
181181 increased by $102,700,000 for the appropriation made under
182182 Subsection (a) of this section.
183183 (c) The capital budget authority of the Texas Historical
184184 Commission in H.B. 1, Acts of the 88th Legislature, Regular
185185 Session, 2023 (the General Appropriations Act), for the state
186186 fiscal biennium beginning September 1, 2023, is increased by
187187 $102,700,000 for the appropriation made under Subsection (a) of
188188 this section.
189189 SECTION 2.15. TEXAS HISTORICAL COMMISSION: BATTLESHIP
190190 TEXAS SITE RESTORATION. (a) The amount of $40,000,000 is
191191 appropriated from the general revenue fund to the Texas Historical
192192 Commission for the two-year period beginning on the effective date
193193 of this Act for the purpose of restoring the Battleship Texas site,
194194 including demolishing the battleship's slip and accessory
195195 structures and restoring the historic appearance of the entire
196196 site.
197197 (b) The capital budget authority of the Texas Historical
198198 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
199199 Regular Session, 2021 (the General Appropriations Act), is
200200 increased by $40,000,000 for the appropriation made under
201201 Subsection (a) of this section.
202202 (c) The capital budget authority of the Texas Historical
203203 Commission in H.B. 1, Acts of the 88th Legislature, Regular
204204 Session, 2023 (the General Appropriations Act), for the state
205205 fiscal biennium beginning September 1, 2023, is increased by
206206 $40,000,000 for the appropriation made under Subsection (a) of this
207207 section.
208208 SECTION 2.16. TEXAS HISTORICAL COMMISSION: OFFICE
209209 MAINTENANCE AND REPAIRS. (a) The amount of $327,000 is
210210 appropriated from the general revenue fund to the Texas Historical
211211 Commission for the two-year period beginning on the effective date
212212 of this Act for the purpose of maintenance and repairs to the
213213 commission's complex in central Austin, Texas, including lead paint
214214 abatement and window repairs.
215215 (b) The capital budget authority of the Texas Historical
216216 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
217217 Regular Session, 2021 (the General Appropriations Act), is
218218 increased by $327,000 for the appropriation made under Subsection
219219 (a) of this section.
220220 SECTION 2.17. TEXAS HISTORICAL COMMISSION: MAGOFFIN HOME
221221 STATE HISTORIC SITE. (a) The amount of $4,144,000 is appropriated
222222 from the general revenue fund to the Texas Historical Commission
223223 for the two-year period beginning on the effective date of this Act
224224 for the purpose of stabilizing and rebuilding the Magoffin Home in
225225 the City of El Paso, Texas.
226226 (b) The capital budget authority of the Texas Historical
227227 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
228228 Regular Session, 2021 (the General Appropriations Act), is
229229 increased by $4,144,000 for the appropriation made under Subsection
230230 (a) of this section.
231231 (c) The capital budget authority of the Texas Historical
232232 Commission in H.B. 1, Acts of the 88th Legislature, Regular
233233 Session, 2023 (the General Appropriations Act), for the state
234234 fiscal biennium beginning September 1, 2023, is increased by
235235 $4,144,000 for the appropriation made under Subsection (a) of this
236236 section.
237237 SECTION 2.18. TEXAS HISTORICAL COMMISSION: VARNER-HOGG
238238 PLANTATION STATE HISTORIC SITE. (a) The amount of $825,000 is
239239 appropriated from the general revenue fund to the Texas Historical
240240 Commission for the two-year period beginning on the effective date
241241 of this Act for the purpose of remediating damage to the foundation
242242 of Varner-Hogg Plantation structures caused by decades of flood
243243 events occurring at the plantation.
244244 (b) The capital budget authority of the Texas Historical
245245 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
246246 Regular Session, 2021 (the General Appropriations Act), is
247247 increased by $825,000 for the appropriation made under Subsection
248248 (a) of this section.
249249 (c) The capital budget authority of the Texas Historical
250250 Commission in H.B. 1, Acts of the 88th Legislature, Regular
251251 Session, 2023 (the General Appropriations Act), for the state
252252 fiscal biennium beginning September 1, 2023, is increased by
253253 $825,000 for the appropriation made under Subsection (a) of this
254254 section.
255255 SECTION 2.19. TEXAS HISTORICAL COMMISSION: MAINTENANCE AT
256256 VARIOUS STATE HISTORIC SITES. (a) The amount of $2,875,000 is
257257 appropriated from the general revenue fund to the Texas Historical
258258 Commission for the two-year period beginning on the effective date
259259 of this Act for the purpose of undertaking maintenance projects at
260260 various state historic sites, which may include replacing roofs,
261261 stabilizing ruins, replacing heating, ventilation, and air
262262 conditioning (HVAC) systems, or other necessary maintenance
263263 projects.
264264 (b) The capital budget authority of the Texas Historical
265265 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
266266 Regular Session, 2021 (the General Appropriations Act), is
267267 increased by $2,875,000 for the appropriation made under Subsection
268268 (a) of this section.
269269 (c) The capital budget authority of the Texas Historical
270270 Commission in H.B. 1, Acts of the 88th Legislature, Regular
271271 Session, 2023 (the General Appropriations Act), for the state
272272 fiscal biennium beginning September 1, 2023, is increased by
273273 $2,875,000 for the appropriation made under Subsection (a) of this
274274 section.
275275 SECTION 2.20. TEXAS HISTORICAL COMMISSION: COURTHOUSE
276276 GRANT PROGRAM. (a) The amount of $45,000,000 is appropriated from
277277 the general revenue fund to the Texas Historical Commission for the
278278 two-year period beginning on the effective date of this Act for the
279279 purpose of the courthouse grant program, including grants for
280280 restorations and emergency planning projects.
281281 (b) The capital budget authority of the Texas Historical
282282 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
283283 Regular Session, 2021 (the General Appropriations Act), is
284284 increased by $45,000,000 for the appropriation made under
285285 Subsection (a) of this section.
286286 (c) The capital budget authority of the Texas Historical
287287 Commission in H.B. 1, Acts of the 88th Legislature, Regular
288288 Session, 2023 (the General Appropriations Act), for the state
289289 fiscal biennium beginning September 1, 2023, is increased by
290290 $45,000,000 for the appropriation made under Subsection (a) of this
291291 section.
292292 SECTION 2.21. TEXAS HISTORICAL COMMISSION: LEVI JORDAN
293293 STATE HISTORIC SITE. (a) The amount of $5,000,000 is appropriated
294294 from the general revenue fund to the Texas Historical Commission
295295 for the two-year period beginning on the effective date of this Act
296296 for the purpose of land acquisition to restore the boundaries of the
297297 Levi Jordan plantation and develop a visitor center and exhibits
298298 for the plantation site.
299299 (b) The capital budget authority of the Texas Historical
300300 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
301301 Regular Session, 2021 (the General Appropriations Act), is
302302 increased by $5,000,000 for the appropriation made under Subsection
303303 (a) of this section.
304304 (c) The capital budget authority of the Texas Historical
305305 Commission in H.B. 1, Acts of the 88th Legislature, Regular
306306 Session, 2023 (the General Appropriations Act), for the state
307307 fiscal biennium beginning September 1, 2023, is increased by
308308 $5,000,000 for the appropriation made under Subsection (a) of this
309309 section.
310310 SECTION 2.22. TEXAS HISTORICAL COMMISSION: TRAVEL
311311 PUBLICATION REPRINTS. The amount of $522,240 is appropriated from
312312 the general revenue fund to the Texas Historical Commission for the
313313 two-year period beginning on the effective date of this Act for the
314314 purpose of reprinting:
315315 (1) the Statewide Heritage Travel Guide;
316316 (2) the African Americans in Texas brochure;
317317 (3) the Hispanic Texans brochure;
318318 (4) the Chisholm Trail guide; and
319319 (5) the Texas and the Great War guide.
320320 SECTION 2.23. TEXAS HISTORICAL COMMISSION: NATIONAL MUSEUM
321321 OF THE PACIFIC WAR. (a) The amount of $7,500,000 is appropriated
322322 from the general revenue fund to the Texas Historical Commission
323323 for the two-year period beginning on the effective date of this Act
324324 for the purpose of making updates and modifications to modernize
325325 the George H. W. Bush Gallery and exhibits at the National Museum of
326326 the Pacific War.
327327 (b) The capital budget authority of the Texas Historical
328328 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
329329 Regular Session, 2021 (the General Appropriations Act), is
330330 increased by $7,500,000 for the appropriation made under Subsection
331331 (a) of this section.
332332 (c) The capital budget authority of the Texas Historical
333333 Commission in H.B. 1, Acts of the 88th Legislature, Regular
334334 Session, 2023 (the General Appropriations Act), for the state
335335 fiscal biennium beginning September 1, 2023, is increased by
336336 $7,500,000 for the appropriation made under Subsection (a) of this
337337 section.
338338 SECTION 2.24. TEXAS HISTORICAL COMMISSION: EISENHOWER
339339 BIRTHPLACE STATE HISTORIC SITE. (a) The amount of $3,401,000 is
340340 appropriated from the general revenue fund to the Texas Historical
341341 Commission for the two-year period beginning on the effective date
342342 of this Act for the purpose of making site upgrades at the
343343 Eisenhower Birthplace State Historic Site, including a new visitor
344344 center, landscaping improvements, improved entry to the site, and
345345 enhancement to the overall appearance of the Eisenhower statue.
346346 (b) The capital budget authority of the Texas Historical
347347 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
348348 Regular Session, 2021 (the General Appropriations Act), is
349349 increased by $3,401,000 for the appropriation made under Subsection
350350 (a) of this section.
351351 (c) The capital budget authority of the Texas Historical
352352 Commission in H.B. 1, Acts of the 88th Legislature, Regular
353353 Session, 2023 (the General Appropriations Act), for the state
354354 fiscal biennium beginning September 1, 2023, is increased by
355355 $3,401,000 for the appropriation made under Subsection (a) of this
356356 section.
357357 SECTION 2.25. TEXAS HISTORICAL COMMISSION: MONUMENT HILL
358358 STATE HISTORIC SITE. (a) The amount of $4,300,000 is appropriated
359359 from the general revenue fund to the Texas Historical Commission
360360 for the two-year period beginning on the effective date of this Act
361361 for the purpose of building a new visitor center and incorporating
362362 an open-air pavilion at the Monument Hill State Historic Site.
363363 (b) The capital budget authority of the Texas Historical
364364 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
365365 Regular Session, 2021 (the General Appropriations Act), is
366366 increased by $4,300,000 for the appropriation made under Subsection
367367 (a) of this section.
368368 (c) The capital budget authority of the Texas Historical
369369 Commission in H.B. 1, Acts of the 88th Legislature, Regular
370370 Session, 2023 (the General Appropriations Act), for the state
371371 fiscal biennium beginning September 1, 2023, is increased by
372372 $4,300,000 for the appropriation made under Subsection (a) of this
373373 section.
374374 ARTICLE 3. HEALTH AND HUMAN SERVICES
375375 SECTION 3.01. HEALTH AND HUMAN SERVICES COMMISSION:
376376 MEDICAID SHORTFALL. The amount of $2,935,300,000 is appropriated
377377 from the general revenue fund, and the amount of $5,500,000,000 is
378378 appropriated from federal funds, to the Health and Human Services
379379 Commission for the state fiscal year ending August 31, 2023, for the
380380 purpose of Medicaid client services under Goal A, Medicaid Client
381381 Services, as listed in Chapter 1053 (S.B. 1), Acts of the 87th
382382 Legislature, Regular Session, 2021 (the General Appropriations
383383 Act).
384384 SECTION 3.02. HEALTH AND HUMAN SERVICES COMMISSION: STATE
385385 HOSPITALS AND CAPACITY. (a) The amount of $2,321,000,000 is
386386 appropriated from the general revenue fund to the Health and Human
387387 Services Commission for the two-year period beginning on the
388388 effective date of this Act for the purpose of constructing state
389389 hospitals and increasing inpatient capacity.
390390 (b) The capital budget authority of the Health and Human
391391 Services Commission in Chapter 1053 (S.B. 1), Acts of the 87th
392392 Legislature, Regular Session, 2021 (the General Appropriations
393393 Act), is increased by $2,321,000,000 for the appropriation made
394394 under Subsection (a) of this section.
395395 (c) The capital budget authority of the Health and Human
396396 Services Commission in H.B. 1, Acts of the 88th Legislature,
397397 Regular Session, 2023 (the General Appropriations Act), for the
398398 state fiscal biennium beginning September 1, 2023, is increased by
399399 $2,321,000,000 for the appropriation made under Subsection (a) of
400400 this section.
401401 SECTION 3.03. TEXAS DEPARTMENT OF FAMILY AND PROTECTIVE
402402 SERVICES: FOSTER CARE SHORTFALL. The amount of $12,581,246 is
403403 appropriated from the general revenue fund to the Texas Department
404404 of Family and Protective Services for the state fiscal year ending

423423 appropriated from the ARPA fund to the Department of State Health
424424 Services for use during the two-year period beginning on the
425425 effective date of this Act for the Federally Qualified Health
426426 Center Incubator Program.
427427 ARTICLE 4. EDUCATION
428428 SECTION 4.01. APPROPRIATION REDUCTION: TEXAS EDUCATION
429429 AGENCY. (a) The unencumbered appropriations from the Foundation
430430 School Fund No. 193 made to the Texas Education Agency by Chapter
431431 1053 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021
432432 (the General Appropriations Act), for use during the state fiscal
433433 biennium ending August 31, 2023, for Strategy A.1.1, Foundation
434434 School Program - Equalized Operations, as listed in that Act, are
435435 reduced by $8,207,005,559.
436436 (b) Notwithstanding Rider 3, page III-5, Chapter 1053 (S.B.
437437 1), Acts of the 87th Legislature, Regular Session, 2021 (the
438438 General Appropriations Act), to the bill pattern of the
439439 appropriations to the Texas Education Agency, the sum-certain

444444 Texas Education Agency for use during the two-year period beginning
445445 on the effective date of this Act for Strategy B.2.2, Health and
446446 Safety, as listed in Chapter 1053 (S.B. 1), Acts of the 87th
447447 Legislature, Regular Session, 2021 (the General Appropriations
448448 Act), and H.B. 1, Acts of the 88th Legislature, Regular Session,

450450 in implementing school safety initiatives.
451451 SECTION 4.03. SCHOOL FOR THE BLIND AND VISUALLY IMPAIRED:
452452 SALARY ADJUSTMENTS. The amount of $936,061 is appropriated from
453453 the general revenue fund to the School for the Blind and Visually
454454 Impaired for the period beginning on the effective date of this Act
455455 and ending August 31, 2024, for staff salary increases provided in
456456 the state fiscal year ending August 31, 2022, to address staffing

475475 Texas A&M Forest Service for the two-year period beginning on the
476476 effective date of this Act for the purpose of responding to
477477 previously occurring and future natural disasters, including
478478 responding through the mobilization of ground and aviation
479479 resources for fire suppression.
480480 SECTION 4.05. UNIVERSITY OF TEXAS AT AUSTIN: TEXAS MEMORIAL
481481 MUSEUM. (a) The amount of $8,000,000 is appropriated from the
482482 general revenue fund to The University of Texas at Austin for the
483483 two-year period beginning on the effective date of this Act for the
484484 purpose of renovating the Texas Memorial Museum.
485485 (b) The legislature finds that there is a demonstrated need
486486 for the appropriation of general revenue funds for the purpose of
487487 renovating the Texas Memorial Museum. The appropriation made by
488488 this section is contingent on approval by two-thirds of each
489489 chamber of the legislature, as required under Section 18(i),
490490 Article VII, Texas Constitution.
491491 SECTION 4.06. LAMAR INSTITUTIONS: DISASTER RESILIENCY
492492 INFRASTRUCTURE. The following amounts totaling $24,500,000 are
493493 appropriated from the ARPA fund to the following institutions for
494494 the two-year period beginning on the effective date of this Act for
495495 the purpose of creating disaster resiliency infrastructure at those
496496 institutions:
497497 (1) Lamar University: $10,000,000;
498498 (2) Lamar State College - Port Arthur: $4,000,000;
499499 (3) Lamar Institute of Technology: $4,000,000; and
500500 (4) Lamar State College - Orange: $6,500,000.
501501 SECTION 4.07. TEACHER RETIREMENT SYSTEM: BENEFIT
502502 ENHANCEMENT. Contingent on the enactment of legislation by the
503503 88th Legislature, Regular Session, 2023, relating to providing a
504504 benefit enhancement for retired employees under the Teacher
505505 Retirement System, and contingent on compliance with the
506506 requirements regarding the amortization period of the unfunded
507507 actuarial liabilities of the Teacher Retirement System under
508508 Section 821.006, Government Code, the amount of $1,000,000,000 is
509509 appropriated from the general revenue fund to the Teacher
510510 Retirement System for the two-year period beginning on the
511511 effective date of this Act for the purpose of providing a benefit
512512 enhancement.
513513 ARTICLE 5. PUBLIC SAFETY AND CRIMINAL JUSTICE
514514 SECTION 5.01. TEXAS DEPARTMENT OF CRIMINAL JUSTICE: AGENCY
515515 OPERATIONS. The amount of $237,200,000 is appropriated from the
516516 general revenue fund to the Texas Department of Criminal Justice
517517 for the two-year period beginning on the effective date of this Act
518518 for the purpose of correctional security operations, staffing
519519 adjustments, resumption of services at the Bradshaw State Jail, and
520520 other agency operations expenses.
521521 SECTION 5.02. TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
522522 CORRECTIONAL MANAGED HEALTH CARE. The amount of $141,770,855 is
523523 appropriated from the general revenue fund to the Texas Department
524524 of Criminal Justice for use during the state fiscal year ending
525525 August 31, 2023, for correctional managed health care under
526526 Strategy C.1.9, Hospital and Clinical Care, as listed in Chapter
527527 1053 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021

529529 SECTION 5.03. TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
530530 DEFERRED MAINTENANCE SECURITY PROJECTS. (a) The amount of

534534 addressing previously deferred maintenance of correctional

539539 Act), is increased by $23,762,000 for the appropriation made under
540540 Subsection (a) of this section.
541541 (c) The capital budget authority of the Texas Department of
542542 Criminal Justice in H.B. 1, Acts of the 88th Legislature, Regular
543543 Session, 2023 (the General Appropriations Act), for the state
544544 fiscal biennium beginning September 1, 2023, is increased by
545545 $23,762,000 for the appropriation made under Subsection (a) of this

547547 SECTION 5.04. TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
548548 TRAINING FACILITY. (a) The amount of $35,000,000 is appropriated
549549 from the ARPA fund to the Texas Department of Criminal Justice for
550550 the two-year period beginning on the effective date of this Act for
551551 the purpose of constructing a training facility on land owned by the
552552 department.
553553 (b) The capital budget authority of the Texas Department of
554554 Criminal Justice in Chapter 1053 (S.B. 1), Acts of the 87th
555555 Legislature, Regular Session, 2021 (the General Appropriations
556556 Act), is increased by $35,000,000 for the appropriation made under
557557 Subsection (a) of this section.
558558 (c) The capital budget authority of the Texas Department of
559559 Criminal Justice in H.B. 1, Acts of the 88th Legislature, Regular
560560 Session, 2023 (the General Appropriations Act), for the state
561561 fiscal biennium beginning September 1, 2023, is increased by
562562 $35,000,000 for the appropriation made under Subsection (a) of this
563563 section.
564564 SECTION 5.05. TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
565565 VOCATIONAL TRAINING PROGRAM. The amount of $600,000 is
566566 appropriated from the general revenue fund to the Texas Department
567567 of Criminal Justice for the two-year period beginning on the
568568 effective date of this Act for the purpose of implementing the
569569 provisions of Chapter 1014 (H.B. 2352), Acts of the 87th
570570 Legislature, Regular Session, 2021, relating to an educational and
571571 vocational training pilot program to assist certain offenders in
572572 finding jobs on release from incarceration or community
573573 supervision.
574574 SECTION 5.06. TEXAS DEPARTMENT OF PUBLIC SAFETY: BORDER
575575 SECURITY. The amount of $47,300,000 is appropriated from the
576576 general revenue fund to the Texas Department of Public Safety for
577577 the two-year period beginning on the effective date of this Act for
578578 the purpose of supporting the border security deployment for
579579 Operation Lone Star.
580580 SECTION 5.07. TEXAS JUVENILE JUSTICE DEPARTMENT:
581581 REIMBURSEMENT TO COUNTIES. The amount of $9,720,960 is
582582 appropriated from the general revenue fund to the Texas Juvenile
583583 Justice Department for the two-year period beginning on the
584584 effective date of this Act for the purpose of reimbursing counties
585585 for the costs of holding juveniles for whom the department does not
586586 have adequate capacity.
587587 ARTICLE 6. NATURAL RESOURCES
588588 SECTION 6.01. COMMISSION ON ENVIRONMENTAL QUALITY:
589589 HAZARDOUS AND SOLID WASTE REMEDIATION. (a) Rider 24, page VI-24,
590590 Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
591591 Session, 2021 (the General Appropriations Act), to the bill pattern
592592 of the appropriations to the Commission on Environmental Quality is
593593 amended to read as follows:
594594 24. Appropriations and Unexpended Balances: [from] Cost
595595 Recovery for Site Remediation and Cleanups. (a) In addition to
596596 amounts appropriated above, any unobligated and unexpended
597597 balances as of August 31, 2021, (estimated to be $0) remaining in
598598 the Hazardous and Solid Waste Remediation Fee Account No. 550 which
599599 were received from responsible parties as cost recovery payments
600600 for site remediation and cleanups undertaken by the Commission on
601601 Environmental Quality (TCEQ) are appropriated to the TCEQ for the
602602 biennium beginning September 1, 2021. The funds shall be used to
603603 pay the cost of site cleanups and remediation during the biennium.
604604 (b) In addition to amounts appropriated above, any
605605 additional revenues generated from cost recovery fees (Revenue
606606 Object Code 3802) during the biennium beginning September 1, 2021,
607607 are appropriated from the Hazardous and Solid Waste Remediation Fee
608608 Account No. 550 to the TCEQ for that biennium for site remediation
609609 and cleanups.
610610 (c) In addition to amounts appropriated above, $3,755,606
611611 is appropriated from Hazardous and Solid Waste Remediation Fee
612612 Account No. 550 to the TCEQ for the biennium beginning September 1,
613613 2021, for site remediation and cleanups.
614614 (b) Any unobligated and unexpended balances remaining as of
615615 August 31, 2023, from appropriations made under Rider 24, page
616616 VI-24, Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
617617 Session, 2021 (the General Appropriations Act), to the bill pattern
618618 of the appropriations to the Commission on Environmental Quality
619619 are appropriated to the commission for the same purpose for the
620620 two-year period beginning on the effective date of this Act.
621621 SECTION 6.02. RAILROAD COMMISSION: PIPELINE TRANSPORTATION
622622 AND STORAGE OF NATURAL AND OTHER GASES. (a) The amount of $541,000
623623 is appropriated from the general revenue fund to the Railroad
624624 Commission for the two-year period beginning on the effective date
625625 of this Act for Strategy B.1.1, Ensure Pipeline Safety, as listed in
626626 Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
627627 Session, 2021 (the General Appropriations Act), and H.B. 1, Acts of
628628 the 88th Legislature, Regular Session, 2023 (the General
629629 Appropriations Act), to implement rule changes adopted by the
630630 United States Department of Transportation Pipeline and Hazardous
631631 Materials Safety Administration.
632632 (b) During the two-year period beginning on the effective
633633 date of this Act, in addition to the number of full-time equivalent
634634 (FTE) employees other law authorizes the commission to employ
635635 during that period, the Railroad Commission may employ out of money
636636 appropriated by Subsection (a) of this section 10.0 full-time
637637 equivalent (FTE) employees.
638638 SECTION 6.03. PARKS AND WILDLIFE DEPARTMENT: PARK
639639 ACQUISITION. (a) The amount of $100,000,000 is appropriated from
640640 the general revenue fund to the Parks and Wildlife Department for
641641 the two-year period beginning on the effective date of this Act for
642642 Strategy D.1.2, Land Acquisition, as listed in Chapter 1053 (S.B.
643643 1), Acts of the 87th Legislature, Regular Session, 2021 (the
644644 General Appropriations Act), and H.B. 1, Acts of the 88th
645645 Legislature, Regular Session, 2023 (the General Appropriations
646646 Act), to acquire real property for use as state parks.
647647 (b) The capital budget authority of the Parks and Wildlife
648648 Department in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,

721721 35(c)(3), Chapter 995 (H.B. 2), Acts of the 87th Legislature,
722722 Regular Session, 2021 (the Supplemental Appropriations Act), from
723723 the general revenue fund to the Pension Review Board for the purpose
724724 of the creation of a self-service portal to allow retirement
725725 systems to access a secure reporting portal to upload reports and
726726 view compliance status in real time (estimated to be $276,000) are
727727 appropriated to the board for the same purpose for the two-year
728728 period beginning on the effective date of this Act.
729729 (b) The capital budget authority of the Pension Review Board
730730 in Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
731731 Session, 2021 (the General Appropriations Act), is increased by the
732732 amount of the appropriation made under Subsection (a) of this
733733 section.
734734 SECTION 8.03. FACILITIES COMMISSION: CAPITOL COMPLEX PHASE
735735 I. (a) All unexpended and unobligated balances remaining as of the
736736 effective date of this Act from appropriations made by Section 3,
737737 Chapter 995 (H.B. 2), Acts of the 87th Legislature, Regular
738738 Session, 2021 (the Supplemental Appropriations Act), from the
739739 economic stabilization fund to the Texas Facilities Commission for
740740 the purpose of providing interior finish out of new facilities
741741 included in Phase I of the Capitol Complex construction projects,
742742 costs associated with moving agencies into the new facilities, and
743743 security services for the new facilities for Strategy A.2.1,
744744 Facilities Design and Construction, and Strategy B.2.1, Facilities

815815 BEHAVIORAL HEALTH CENTER. (a) Subject to Subsection (b) of this
816816 section, all unexpended and unobligated balances remaining as of
817817 the effective date of this Act from appropriations made by Section
818818 26, Chapter 10 (S.B. 8), Acts of the 87th Legislature, 3rd Called
819819 Session, 2021 (the Supplemental Appropriations Act), from the ARPA
820820 fund to the Texas Facilities Commission for the purpose of
821821 constructing a 100-bed comprehensive behavioral health center to
822822 serve the Permian Basin region (estimated to be $40,000,000) are
823823 appropriated to the commission for the same purpose for the
824824 two-year period beginning on the effective date of this Act.
825825 (b) The appropriation under Subsection (a) of this section
826826 is contingent on the completion of a signed agreement between the
827827 Texas Facilities Commission and the Ector County and Midland County
828828 Hospital Districts guaranteeing the ongoing operations of the
829829 comprehensive behavioral health center described by that
830830 subsection to ensure the construction and operation of the health
831831 center will provide a continuing benefit to the residents of this
832832 state.
833833 (c) Subject to Subsection (b) of this section, all gifts or
834834 grants made to the Texas Facilities Commission to support the
835835 construction of the comprehensive behavioral health center
836836 described by Subsection (a) of this section (estimated to be
837837 $50,000,000) are appropriated to the commission for the two-year
838838 period beginning on the effective date of this Act for the
839839 construction of the center.
840840 (d) The capital budget authority of the Texas Facilities
841841 Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
842842 Regular Session, 2021 (the General Appropriations Act), is
843843 increased by the amount of the appropriations made under this
844844 section.
845845 (e) The capital budget authority of the Texas Facilities
846846 Commission in H.B. 1, Acts of the 88th Legislature, Regular
847847 Session, 2023 (the General Appropriations Act), for the biennium
848848 beginning September 1, 2023, is increased by the amount of the

17021702 SECTION 8.52. HIGHER EDUCATION COORDINATING BOARD: TEXAS
17031703 CHILD MENTAL HEALTH CARE CONSORTIUM. (a) All unexpended and
17041704 unobligated balances remaining as of the effective date of this Act
17051705 from appropriations made by Section 8, Chapter 10 (S.B. 8), Acts of
17061706 the 87th Legislature, 3rd Called Session, 2021 (the Supplemental
17071707 Appropriations Act), from the ARPA fund to the Higher Education
17081708 Coordinating Board for the purpose of supporting the operations and
17091709 expansion of the Texas Child Mental Health Care Consortium to
17101710 expand mental health initiatives for children, pregnant women, and
17111711 women who are up to one year postpartum (estimated to be
17121712 $56,541,442) are appropriated to the coordinating board for the
17131713 same purpose for the two-year period beginning on the effective

17151715 (b) At the direction of the Texas Child Mental Health Care
17161716 Consortium, the Higher Education Coordinating Board shall transfer
17171717 money appropriated under Subsection (a) of this section to
17181718 health-related institutions of higher education through
17191719 interagency contracts for:
17201720 (1) enhancements and expansion of the Child Psychiatry
17211721 Access Network;
17221722 (2) enhancements and expansion of the Texas Child
17231723 Access Through Telemedicine program;
17241724 (3) expansion of the child and adolescent mental
17251725 health workforce; and
17261726 (4) administrative expenses.
17271727 (c) The Texas Child Mental Health Care Consortium may
17281728 transfer money allocated for a purpose described by Subsection
17291729 (b)(1), (2), or (3) of this section to any other purpose described
17301730 by those subdivisions, except that a transfer of more than 10
17311731 percent of the money allocated for one of those purposes may be made
17321732 only with the prior approval for the transfer and expenditure from
17331733 the Legislative Budget Board. A request for approval of the
17341734 transfer and expenditure by the consortium is considered approved
17351735 unless the Legislative Budget Board issues a written disapproval
17361736 within 10 business days of the receipt and review of the request by
17371737 the Legislative Budget Board.
17381738 (d) Out of money appropriated by Subsection (a) of this
17391739 section, the Texas Child Mental Health Care Consortium may enhance
17401740 the Child Psychiatry Access Network to improve perinatal mental
17411741 health services.
17421742 SECTION 8.53. TEXAS DIVISION OF EMERGENCY MANAGEMENT: STATE
17431743 OPERATIONS CENTER. All unexpended and unobligated balances
17441744 remaining as of the effective date of this Act from appropriations
17451745 made by Section 9, Chapter 10 (S.B. 8), Acts of the 87th
17461746 Legislature, 3rd Called Session, 2021 (the Supplemental

19701970 the ARPA fund to the Parks and Wildlife Department for the purpose
19711971 of providing funding for grants throughout this state as authorized
19721972 by other law and consistent with Strategy C.2.1, Outreach and

19791979 AQUARIUM CENTER. All unexpended and unobligated balances remaining
19801980 as of the effective date of this Act from appropriations made by
19811981 Section 42, Chapter 10 (S.B. 8), Acts of the 87th Legislature, 3rd
19821982 Called Session, 2021 (the Supplemental Appropriations Act), from
19831983 the ARPA fund to the Parks and Wildlife Department for the purpose
19841984 of providing funding to the Texas State Aquarium Center for
19851985 wildlife research (estimated to be $3,000,000) are appropriated to
19861986 the department for the same purpose for the two-year period
19871987 beginning on the effective date of this Act.
19881988 SECTION 8.71. DEPARTMENT OF TRANSPORTATION: PRESIDIO
19891989 CUSTOMS INSPECTION STATION. All unexpended and unobligated
19901990 balances remaining as of the effective date of this Act from
19911991 appropriations made by Section 31, Chapter 10 (S.B. 8), Acts of the
19921992 87th Legislature, 3rd Called Session, 2021 (the Supplemental
19931993 Appropriations Act), from the ARPA fund to the Department of
19941994 Transportation for the purpose of providing funding for a customs
19951995 inspection station on the South Orient Rail Line in Presidio, Texas
19961996 (estimated to be $0), are appropriated to the department for the
19971997 same purpose for the two-year period beginning on the effective
19981998 date of this Act.
19991999 SECTION 8.72. DEPARTMENT OF MOTOR VEHICLES: ACCOUNTS
20002000 RECEIVABLE SYSTEM PROJECT. All unexpended and unobligated balances
20012001 remaining as of the effective date of this Act from appropriations
20022002 made by Section 35(c)(11), Chapter 995 (H.B. 2), Acts of the 87th
20032003 Legislature, Regular Session, 2021 (the Supplemental
20042004 Appropriations Act), from the Texas Department of Motor Vehicles
20052005 fund to the Department of Motor Vehicles for the Accounts
20062006 Receivable System Project (estimated to be $0) are appropriated to
20072007 the department for the same purpose for the two-year period
20082008 beginning on the effective date of this Act.
20092009 SECTION 8.73. DEPARTMENT OF AGRICULTURE: FOOD BANKS. All
20102010 unexpended and unobligated balances remaining as of the effective
20112011 date of this Act from appropriations made by Section 7, Chapter 10
20122012 (S.B. 8), Acts of the 87th Legislature, 3rd Called Session, 2021
20132013 (the Supplemental Appropriations Act), from the ARPA fund to the
20142014 Department of Agriculture for the purpose of providing supplemental
20152015 funding to food banks in response to the coronavirus pandemic
20162016 (estimated to be $72,600,000) are appropriated to the department
20172017 for the purpose of providing supplemental funding to food banks for
20182018 the two-year period beginning on the effective date of this Act.
20192019 ARTICLE 9. MISCELLANEOUS PROVISIONS
20202020 SECTION 9.01. SALARY INCREASE FOR STATE EMPLOYEES. (a) In
20212021 this section, "salary increase" means:
20222022 (1) a 5.0 percent increase in monthly salary with a
20232023 minimum increase of $250 per month, effective July 1, 2023; and
20242024 (2) any related employee benefits costs associated
20252025 with the salary increase described by Subdivision (1) of this
20262026 subsection, including contributions required by Sections 17.03,
20272027 page IX-79, and 17.06, page IX-80, Chapter 1053 (S.B. 1), Acts of
20282028 the 87th Legislature, Regular Session, 2021 (the General
20292029 Appropriations Act).
20302030 (b) The amount necessary to pay for a salary increase for
20312031 all employee positions for state agencies paid according to the
20322032 Classification Salary Schedules listed in Section 2.01, Article IX,
20332033 Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
20342034 Session, 2021 (the General Appropriations Act), including employee
20352035 positions for the Higher Education Coordinating Board, Texas A&M
20362036 University System service agencies, and agencies funded under
20372037 Article X of that Act, for the period beginning July 1, 2023, and
20382038 ending August 31, 2023 (estimated to be an aggregate of
20392039 $99,157,791, of which $63,860,952 is estimated to be from the
20402040 general revenue fund, $5,713,926 is estimated to be from general
20412041 revenue dedicated accounts, $11,390,274 is estimated to be from
20422042 other state funds and accounts, and $18,192,639 is estimated to be
20432043 from federal funds), is appropriated to the comptroller of public
20442044 accounts for that period for the purpose of making those salary
20452045 increases.
20462046 (c) The amount appropriated under Subsection (b) of this
20472047 section includes money from the general revenue fund, general
20482048 revenue dedicated accounts, and other funds that is intended to
20492049 provide the salary increase described by that subsection for
20502050 certain employee positions currently paid from federal funds that
20512051 are not available for this purpose.
20522052 (d) Money appropriated under Subsection (b) of this section
20532053 may not be used to provide a salary increase for statewide elected
20542054 officials, justices or judges of the appellate and district courts,
20552055 district attorneys, criminal district attorneys, county attorneys
20562056 performing the duties of a district attorney, line item exempt
20572057 (non-classified) employees, employees of institutions of higher
20582058 education (other than employees of the Higher Education
20592059 Coordinating Board or a Texas A&M University System service
20602060 agency), or the compensatory per diem of board or commission
20612061 members.
20622062 (e) The provisions of Section 6.08, Article IX, Chapter 1053
20632063 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021 (the
20642064 General Appropriations Act), requiring salaries and benefits to be
20652065 paid proportionally from each source of funding are incorporated
20662066 into this section by reference and apply to the appropriation made
20672067 under Subsection (b) of this section. Each agency shall pay the
20682068 salary increase described by that subsection from funds held in the
20692069 state treasury and from local funds in the same proportion as the
20702070 employee's regular compensation is paid, unless the employee's
20712071 salary is paid from federal funds that are not available for that
20722072 purpose.
20732073 (f) The comptroller of public accounts shall adopt rules as
20742074 necessary to administer this section. The comptroller shall
20752075 allocate money appropriated under Subsection (b) of this section to
20762076 each agency, and to the appropriate employee benefit appropriation
20772077 items, in accordance with those rules.
20782078 (g) A state agency that receives money appropriated under
20792079 Subsection (b) of this section may not increase fees or taxes to
20802080 offset the appropriation. The amount necessary to provide the
20812081 salary increase described by that subsection for employees of a
20822082 state agency subject to a provision in Chapter 1053 (S.B. 1), Acts
20832083 of the 87th Legislature, Regular Session, 2021 (the General
20842084 Appropriations Act), limiting the amount appropriated to the agency
20852085 to revenues collected by the agency, is included in the amount
20862086 appropriated under that subsection. This subsection does not apply
20872087 to the Texas Department of Insurance.
20882088 (h) The salary increase provided under Subsection (b) of
20892089 this section applies to part-time employees hired pursuant to
20902090 Section 658.009, Government Code. For purposes of this section, in
20912091 computing the salary increase described by Subsection (b) of this
20922092 section for those part-time employees, the amount provided for each
20932093 employee must be proportional to the number of hours the employee
20942094 works per week as compared to a 40-hour work week.
20952095 (i) This section:
20962096 (1) applies to:
20972097 (A) all staff positions at the Windham School
20982098 District and the Texas Juvenile Justice Department; and
20992099 (B) the non-instructional staff positions at the
21002100 School for the Deaf and the School for the Blind and Visually
21012101 Impaired; and
21022102 (2) does not apply to the instructional staff
21032103 positions at the School for the Deaf and the School for the Blind
21042104 and Visually Impaired whose salaries are statutorily tied to the
21052105 salary schedule at the Austin Independent School District.
21062106 (j) It is the intent of the legislature that if this Act
21072107 becomes effective after July 1, 2023, the salary increase described
21082108 by Subsection (b) of this section should be calculated for the month
21092109 of July at a percentage that yields a 5.0 percent increase in each
21102110 employee position's salary for the month of July compared to the
21112111 employee position's salary for the month of June.
21122112 (k) The amount of a salary increase provided under this
21132113 section may not be considered in determining the amount of a salary
21142114 increase provided in H.B. 1, Acts of the 88th Legislature, Regular
21152115 Session, 2023 (the General Appropriations Act).
21162116 SECTION 9.02. MOTOR VEHICLE PURCHASES. (a) The following
21172117 amounts are appropriated from the specified sources to the
21182118 following agencies for use during the two-year period beginning on
21192119 the effective date of this Act for the purpose of purchasing motor
21202120 vehicles for the agency's use as authorized by general law:
21212121 (1) Office of the Attorney General: $170,000 from the
21222122 ARPA fund, and $330,000 from federal funds;
21232123 (2) Texas Historical Commission: $1,966,983 from the
21242124 ARPA fund;
21252125 (3) Secretary of State: $30,000 from the ARPA fund;

22122212 appropriation made to the agency under Subsection (a) of this
22132213 section.
22142214 (c) The capital budget authority of each agency listed under
22152215 Subsection (a) of this section in H.B. 1, Acts of the 88th
22162216 Legislature, Regular Session, 2023 (the General Appropriations
22172217 Act), for the state fiscal biennium beginning September 1, 2023, is
22182218 increased by the amount of the appropriation made to the agency
22192219 under Subsection (a) of this section.
22202220 SECTION 9.03. LIMITATION, REPORTING, AND TRANSFER
22212221 PROVISIONS OF GAA INCORPORATED BY REFERENCE. The provisions
22222222 relating to limitations, reporting, or transfer of Article IX,
22232223 Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
22242224 Session, 2021 (the General Appropriations Act), and of Article IX,
22252225 H.B. 1, Acts of the 88th Legislature, Regular Session, 2023 (the
22262226 General Appropriations Act), are incorporated into this Act by
22272227 reference and apply to the appropriations made by this Act.
22282228 ARTICLE 10. EFFECTIVE DATE
22292229 SECTION 10.01. EFFECTIVE DATE. (a) Subject to Subsections
22302230 (b) and (c) of this section, this Act takes effect immediately.
22312231 (b) Sections 8.03, 8.04, 8.08, 8.10, 8.11, 8.13, 8.14, 8.15,
22322232 8.25, 8.37, 8.40, 8.41, 8.42, and 8.68 of this Act take effect only
22332233 if this Act receives a vote of two-thirds of the members present in
22342234 each house of the legislature, as provided by Section 49-g(m),
22352235 Article III, Texas Constitution.
22362236 (c) Sections 4.05 and 8.51 of this Act take effect only if
22372237 this Act receives a vote of two-thirds of the members present in
22382238 each house of the legislature, as provided by Section 18(i),
22392239 Article VII, Texas Constitution.
