7	7	relating to supplemental appropriations and reductions in
8	8	appropriations and giving direction and adjustment authority
9	9	regarding appropriations.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	ARTICLE 1. GENERAL PROVISIONS
12	12	SECTION 1.01. DEFINITION. In this Act, "ARPA fund" means
13	13	money received by this state from the Coronavirus State Fiscal
14	14	Recovery Fund (42 U.S.C. Section 802) established under the
15	15	American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
16	16	to the credit of the Coronavirus Relief Fund No. 325.
17	17	ARTICLE 2. GENERAL GOVERNMENT
18	18	SECTION 2.01. EMPLOYEES RETIREMENT SYSTEM: IMPLEMENTING
19	19	PRIOR LEGISLATION. (a) The amount of $165,600,000 is appropriated
20	20	from the general revenue fund to the Employees Retirement System
21	21	for the two-year period beginning on the effective date of this Act
22	22	for the purpose of implementing the provisions of Chapter 940 (S.B.
23	23	321), Acts of the 87th Legislature, Regular Session, 2021.
24	24	(b) The appropriations made in this section are for the
25	25	purpose of amortizing the Employees Retirement System Retirement
26	26	Program's unfunded actuarial liabilities not later than the state
27	27	fiscal year ending August 31, 2054, consistent with Chapter 940
28	28	(S.B. 321), Acts of the 87th Legislature, Regular Session, 2021.
29	29	SECTION 2.02. EMPLOYEES RETIREMENT SYSTEM: UNFUNDED
30	30	ACTUARIAL LIABILITIES. The amount of $1,000,000,000 is
31	31	appropriated from the general revenue fund to the Employees
32	32	Retirement System for the two-year period beginning on the
33	33	effective date of this Act for the purpose of amortizing the
34	34	Employees Retirement System Retirement Program's unfunded
35	35	actuarial liabilities.
36	36	SECTION 2.03. COMPTROLLER OF PUBLIC ACCOUNTS: OPIOID
37	37	SETTLEMENT FUNDS. The amount of $26,846,996.60 is appropriated
38	38	from the general revenue fund to the comptroller of public accounts
39	39	for immediate deposit to the opioid abatement trust fund pursuant
40	40	to Section 403.507(b)(2), Government Code, from money obtained
41	41	under the statewide opioid settlement agreement in State of Texas
42	42	v. McKinsey & Company, Inc., United States, No. D-1-GN-21-000551
43	43	(98th Dist. Ct., Travis County, Tex., Feb. 4, 2021).
44	44	SECTION 2.04. FISCAL PROGRAMS - COMPTROLLER OF PUBLIC
45	45	ACCOUNTS: TEXAS GUARANTEED TUITION PLAN. The amount of
46	46	$243,800,000 is appropriated from the general revenue fund to
47	47	Fiscal Programs - Comptroller of Public Accounts for the two-year
48	48	period beginning on the effective date of this Act for the purpose
49	49	of paying contract obligations and program expenses for the
50	50	Guaranteed Tuition Plan/Texas Tomorrow Fund.
51	51	SECTION 2.05. COMPTROLLER OF PUBLIC ACCOUNTS: DEFERRED
52	52	MAINTENANCE DEDICATION. Not later than August 31, 2023, the
53	53	comptroller of public accounts shall transfer the amount of
54	54	$400,000,000 from the general revenue fund to the deferred
55	55	maintenance account number 5166 to be used for the purpose of
56	56	addressing future maintenance of state buildings as directed by the
57	57	legislature.
58	58	SECTION 2.06. FACILITIES COMMISSION: LIBRARY AND ARCHIVES
59	59	COMMISSION FACILITY. (a) The amount of $210,000,000 is
60	60	appropriated from the general revenue fund to the Texas Facilities
61	61	Commission for the two-year period beginning on the effective date
62	62	of this Act for the purpose of constructing a new facility to be
63	63	used by the Library and Archives Commission for records and archive
64	64	storage.
65	65	(b) The General Land Office, the Texas Facilities
66	66	Commission, the Library and Archives Commission, and other
67	67	necessary state agencies are directed to take all legal actions
68	68	necessary to sell the Library and Archives Commission facility and
69	69	adjacent state-owned land currently located on Shoal Creek in the
70	70	City of Austin, Texas ("the Shoal Creek facility"). The proceeds
71	71	from the sale of the Shoal Creek facility may be appropriated by a
72	72	future legislature to defray costs of the construction of the new
73	73	facility described by Subsection (a) of this section.
74	74	(c) Any additional full-time equivalent (FTE) employees the
75	75	Texas Facilities Commission may require to achieve the purpose for
76	76	which the appropriation under Subsection (a) of this section was
77	77	made are reflected in the total number of full-time equivalent
78	78	(FTE) employees authorized for the commission in H.B. 1, Acts of the
79	79	88th Legislature, Regular Session, 2023 (the General
80	80	Appropriations Act).
81	81	(d) The capital budget authority of the Texas Facilities
82	82	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
83	83	Regular Session, 2021 (the General Appropriations Act), is
84	84	increased by $210,000,000 for the appropriation made under
85	85	Subsection (a) of this section.
86	86	(e) The capital budget authority of the Texas Facilities
87	87	Commission in H.B. 1, Acts of the 88th Legislature, Regular
88	88	Session, 2023 (the General Appropriations Act), for the state
89	89	fiscal biennium beginning September 1, 2023, is increased by
90	90	$210,000,000 for the appropriation made under Subsection (a) of
91	91	this section.
92	92	SECTION 2.07. APPROPRIATION REDUCTION: DEPARTMENT OF
93	93	INFORMATION RESOURCES. The unencumbered appropriations from the
94	94	ARPA fund and the related increase in capital budget authority made
95	95	to the Department of Information Resources by Section 25, Chapter
96	96	10 (S.B. 8), Acts of the 87th Legislature, 3rd Called Session, 2021
97	97	(the Supplemental Appropriations Act), for cybersecurity projects
98	98	are reduced by $200,000,000.
99	99	SECTION 2.08. APPROPRIATION REDUCTION: PUBLIC FINANCE
100	100	AUTHORITY. (a) The unencumbered appropriations from the general
101	101	revenue fund to the Public Finance Authority made by Chapter 1053
102	102	(S.B. 1), Acts of the 87th Legislature, Regular Session, 2021 (the
103	103	General Appropriations Act), for use during the state fiscal
104	104	biennium ending August 31, 2023, for bond debt service payments,
105	105	including appropriations subject to Rider 3, page I-52, Chapter
106	106	1053 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021
107	107	(the General Appropriations Act), to the bill pattern of the
108	108	appropriations to the Public Finance Authority, are reduced by a
109	109	total of $18,466,179.
110	110	(b) The Public Finance Authority shall identify the
111	111	strategies and objectives out of which the reduction in
112	112	appropriations described by Subsection (a) of this section are to
113	113	be made and the amount of the reduction for each of those strategies
114	114	and objectives.
115	115	SECTION 2.09. PUBLIC FINANCE AUTHORITY: CUSTOMER RATE
116	116	RELIEF CHARGES RELATED TO WINTER STORM URI. Contingent on the
117	117	enactment of legislation by the 88th Legislature, Regular Session,
118	118	2023, relating to the payment of gas customer rate relief charges
119	119	imposed for costs related to Winter Storm Uri, the amount necessary
120	120	to implement the provisions of that legislation (estimated to be
121	121	$3,861,553,084) is appropriated from the general revenue fund to
122	122	the Public Finance Authority for the two-year period beginning on
123	123	the effective date of this Act for the purpose of making a grant to
124	124	the issuing financing entity created under Section 1232.1072,
125	125	Government Code, to be used to pay the aggregate customer rate
126	126	relief charges authorized by Subchapter I, Chapter 104, Utilities
127	127	Code, on behalf of customers in lieu of monthly charges in order to
128	128	assist with recovery from the impact of Winter Storm Uri.
129	129	SECTION 2.10. STATE PRESERVATION BOARD: ENDOWMENT FUND.
130	130	Contingent on the enactment of legislation by the 88th Legislature,
131	131	Regular Session, 2023, relating to the creation of an endowment
132	132	fund for the State Preservation Board to be held by the Texas
133	133	Treasury Safekeeping Trust Company, the amount of $200,000,000 is
134	134	appropriated from the general revenue fund to the comptroller of
135	135	public accounts for the period beginning on the effective date of
136	136	this Act and ending August 31, 2023, to be deposited before August
137	137	31, 2023, to the endowment fund for use by the State Preservation
138	138	Board for the purposes described by that legislation.
139	139	SECTION 2.11. STATE PRESERVATION BOARD: MAINTENANCE FOR
140	140	TEXAS STATE HISTORY MUSEUM. (a) The amount of $2,975,000 is
141	141	appropriated from the general revenue fund to the State
142	142	Preservation Board for the two-year period beginning on the
143	143	effective date of this Act for the purpose of replacing the roof and
144	144	boiler system of the Texas State History Museum.
145	145	(b) The capital budget authority of the State Preservation
146	146	Board in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
147	147	Regular Session, 2021 (the General Appropriations Act), is
148	148	increased by $2,975,000 for the appropriation made under Subsection
149	149	(a) of this section.
150	150	(c) The capital budget authority of the State Preservation
151	151	Board in H.B. 1, Acts of the 88th Legislature, Regular Session, 2023
152	152	(the General Appropriations Act), for the state fiscal biennium
153	153	beginning September 1, 2023, is increased by $2,975,000 for the
154	154	appropriation made under Subsection (a) of this section.
155	155	SECTION 2.12. TEXAS HISTORICAL COMMISSION: FORT VELASCO
156	156	HISTORICAL SITE. The amount of $500,000 is appropriated from the
157	157	general revenue fund to the Texas Historical Commission for the
158	158	two-year period beginning on the effective date of this Act for the
159	159	purpose of making a grant for the maintenance and improvement of the
160	160	Fort Velasco Historic Site.
161	161	SECTION 2.13. TEXAS HISTORICAL COMMISSION: ENDOWMENT FUND.
162	162	Contingent on the enactment of legislation by the 88th Legislature,
163	163	Regular Session, 2023, relating to the creation of an endowment
164	164	fund for the Texas Historical Commission to be held by the Texas
165	165	Treasury Safekeeping Trust Company, the amount of $300,000,000 is
166	166	appropriated from the general revenue fund to the comptroller of
167	167	public accounts for the period beginning on the effective date of
168	168	this Act and ending August 31, 2023, to be deposited before August
169	169	31, 2023, to the endowment fund for use by the Texas Historical
170	170	Commission for the purposes described by that legislation.
171	171	SECTION 2.14. TEXAS HISTORICAL COMMISSION: SAN JACINTO
172	172	BATTLEGROUND STATE HISTORIC SITE. (a) The amount of $102,700,000
173	173	is appropriated from the general revenue fund to the Texas
174	174	Historical Commission for the two-year period beginning on the
175	175	effective date of this Act for the purpose of restoring the San
176	176	Jacinto Battleground State Historic Site and making improvements to
177	177	the visitor center for the site.
178	178	(b) The capital budget authority of the Texas Historical
179	179	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
180	180	Regular Session, 2021 (the General Appropriations Act), is
181	181	increased by $102,700,000 for the appropriation made under
182	182	Subsection (a) of this section.
183	183	(c) The capital budget authority of the Texas Historical
184	184	Commission in H.B. 1, Acts of the 88th Legislature, Regular
185	185	Session, 2023 (the General Appropriations Act), for the state
186	186	fiscal biennium beginning September 1, 2023, is increased by
187	187	$102,700,000 for the appropriation made under Subsection (a) of
188	188	this section.
189	189	SECTION 2.15. TEXAS HISTORICAL COMMISSION: BATTLESHIP
190	190	TEXAS SITE RESTORATION. (a) The amount of $40,000,000 is
191	191	appropriated from the general revenue fund to the Texas Historical
192	192	Commission for the two-year period beginning on the effective date
193	193	of this Act for the purpose of restoring the Battleship Texas site,
194	194	including demolishing the battleship's slip and accessory
195	195	structures and restoring the historic appearance of the entire
196	196	site.
197	197	(b) The capital budget authority of the Texas Historical
198	198	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
199	199	Regular Session, 2021 (the General Appropriations Act), is
200	200	increased by $40,000,000 for the appropriation made under
201	201	Subsection (a) of this section.
202	202	(c) The capital budget authority of the Texas Historical
203	203	Commission in H.B. 1, Acts of the 88th Legislature, Regular
204	204	Session, 2023 (the General Appropriations Act), for the state
205	205	fiscal biennium beginning September 1, 2023, is increased by
206	206	$40,000,000 for the appropriation made under Subsection (a) of this
207	207	section.
208	208	SECTION 2.16. TEXAS HISTORICAL COMMISSION: OFFICE
209	209	MAINTENANCE AND REPAIRS. (a) The amount of $327,000 is
210	210	appropriated from the general revenue fund to the Texas Historical
211	211	Commission for the two-year period beginning on the effective date
212	212	of this Act for the purpose of maintenance and repairs to the
213	213	commission's complex in central Austin, Texas, including lead paint
214	214	abatement and window repairs.
215	215	(b) The capital budget authority of the Texas Historical
216	216	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
217	217	Regular Session, 2021 (the General Appropriations Act), is
218	218	increased by $327,000 for the appropriation made under Subsection
219	219	(a) of this section.
220	220	SECTION 2.17. TEXAS HISTORICAL COMMISSION: MAGOFFIN HOME
221	221	STATE HISTORIC SITE. (a) The amount of $4,144,000 is appropriated
222	222	from the general revenue fund to the Texas Historical Commission
223	223	for the two-year period beginning on the effective date of this Act
224	224	for the purpose of stabilizing and rebuilding the Magoffin Home in
225	225	the City of El Paso, Texas.
226	226	(b) The capital budget authority of the Texas Historical
227	227	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
228	228	Regular Session, 2021 (the General Appropriations Act), is
229	229	increased by $4,144,000 for the appropriation made under Subsection
230	230	(a) of this section.
231	231	(c) The capital budget authority of the Texas Historical
232	232	Commission in H.B. 1, Acts of the 88th Legislature, Regular
233	233	Session, 2023 (the General Appropriations Act), for the state
234	234	fiscal biennium beginning September 1, 2023, is increased by
235	235	$4,144,000 for the appropriation made under Subsection (a) of this
236	236	section.
237	237	SECTION 2.18. TEXAS HISTORICAL COMMISSION: VARNER-HOGG
238	238	PLANTATION STATE HISTORIC SITE. (a) The amount of $825,000 is
239	239	appropriated from the general revenue fund to the Texas Historical
240	240	Commission for the two-year period beginning on the effective date
241	241	of this Act for the purpose of remediating damage to the foundation
242	242	of Varner-Hogg Plantation structures caused by decades of flood
243	243	events occurring at the plantation.
244	244	(b) The capital budget authority of the Texas Historical
245	245	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
246	246	Regular Session, 2021 (the General Appropriations Act), is
247	247	increased by $825,000 for the appropriation made under Subsection
248	248	(a) of this section.
249	249	(c) The capital budget authority of the Texas Historical
250	250	Commission in H.B. 1, Acts of the 88th Legislature, Regular
251	251	Session, 2023 (the General Appropriations Act), for the state
252	252	fiscal biennium beginning September 1, 2023, is increased by
253	253	$825,000 for the appropriation made under Subsection (a) of this
254	254	section.
255	255	SECTION 2.19. TEXAS HISTORICAL COMMISSION: MAINTENANCE AT
256	256	VARIOUS STATE HISTORIC SITES. (a) The amount of $2,875,000 is
257	257	appropriated from the general revenue fund to the Texas Historical
258	258	Commission for the two-year period beginning on the effective date
259	259	of this Act for the purpose of undertaking maintenance projects at
260	260	various state historic sites, which may include replacing roofs,
261	261	stabilizing ruins, replacing heating, ventilation, and air
262	262	conditioning (HVAC) systems, or other necessary maintenance
263	263	projects.
264	264	(b) The capital budget authority of the Texas Historical
265	265	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
266	266	Regular Session, 2021 (the General Appropriations Act), is
267	267	increased by $2,875,000 for the appropriation made under Subsection
268	268	(a) of this section.
269	269	(c) The capital budget authority of the Texas Historical
270	270	Commission in H.B. 1, Acts of the 88th Legislature, Regular
271	271	Session, 2023 (the General Appropriations Act), for the state
272	272	fiscal biennium beginning September 1, 2023, is increased by
273	273	$2,875,000 for the appropriation made under Subsection (a) of this

275	275	SECTION 2.20. TEXAS HISTORICAL COMMISSION: COURTHOUSE
276	276	GRANT PROGRAM. (a) The amount of $45,000,000 is appropriated from
277	277	the general revenue fund to the Texas Historical Commission for the
278	278	two-year period beginning on the effective date of this Act for the
279	279	purpose of the courthouse grant program, including grants for
280	280	restorations and emergency planning projects.
281	281	(b) The capital budget authority of the Texas Historical
282	282	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
283	283	Regular Session, 2021 (the General Appropriations Act), is
284	284	increased by $45,000,000 for the appropriation made under
285	285	Subsection (a) of this section.
286	286	(c) The capital budget authority of the Texas Historical
287	287	Commission in H.B. 1, Acts of the 88th Legislature, Regular
288	288	Session, 2023 (the General Appropriations Act), for the state
289	289	fiscal biennium beginning September 1, 2023, is increased by
290	290	$45,000,000 for the appropriation made under Subsection (a) of this
291	291	section.
292	292	SECTION 2.21. TEXAS HISTORICAL COMMISSION: LEVI JORDAN
293	293	STATE HISTORIC SITE. (a) The amount of $5,000,000 is appropriated
294	294	from the general revenue fund to the Texas Historical Commission
295	295	for the two-year period beginning on the effective date of this Act
296	296	for the purpose of land acquisition to restore the boundaries of the
297	297	Levi Jordan plantation and develop a visitor center and exhibits
298	298	for the plantation site.
299	299	(b) The capital budget authority of the Texas Historical
300	300	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
301	301	Regular Session, 2021 (the General Appropriations Act), is
302	302	increased by $5,000,000 for the appropriation made under Subsection
303	303	(a) of this section.
304	304	(c) The capital budget authority of the Texas Historical
305	305	Commission in H.B. 1, Acts of the 88th Legislature, Regular
306	306	Session, 2023 (the General Appropriations Act), for the state
307	307	fiscal biennium beginning September 1, 2023, is increased by
308	308	$5,000,000 for the appropriation made under Subsection (a) of this
309	309	section.
310	310	SECTION 2.22. TEXAS HISTORICAL COMMISSION: TRAVEL
311	311	PUBLICATION REPRINTS. The amount of $522,240 is appropriated from
312	312	the general revenue fund to the Texas Historical Commission for the
313	313	two-year period beginning on the effective date of this Act for the
314	314	purpose of reprinting:
315	315	(1) the Statewide Heritage Travel Guide;
316	316	(2) the African Americans in Texas brochure;
317	317	(3) the Hispanic Texans brochure;
318	318	(4) the Chisholm Trail guide; and
319	319	(5) the Texas and the Great War guide.
320	320	SECTION 2.23. TEXAS HISTORICAL COMMISSION: NATIONAL MUSEUM
321	321	OF THE PACIFIC WAR. (a) The amount of $7,500,000 is appropriated
322	322	from the general revenue fund to the Texas Historical Commission
323	323	for the two-year period beginning on the effective date of this Act
324	324	for the purpose of making updates and modifications to modernize
325	325	the George H. W. Bush Gallery and exhibits at the National Museum of
326	326	the Pacific War.
327	327	(b) The capital budget authority of the Texas Historical
328	328	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
329	329	Regular Session, 2021 (the General Appropriations Act), is
330	330	increased by $7,500,000 for the appropriation made under Subsection
331	331	(a) of this section.
332	332	(c) The capital budget authority of the Texas Historical
333	333	Commission in H.B. 1, Acts of the 88th Legislature, Regular
334	334	Session, 2023 (the General Appropriations Act), for the state
335	335	fiscal biennium beginning September 1, 2023, is increased by
336	336	$7,500,000 for the appropriation made under Subsection (a) of this
337	337	section.
338	338	SECTION 2.24. TEXAS HISTORICAL COMMISSION: EISENHOWER
339	339	BIRTHPLACE STATE HISTORIC SITE. (a) The amount of $3,401,000 is
340	340	appropriated from the general revenue fund to the Texas Historical
341	341	Commission for the two-year period beginning on the effective date
342	342	of this Act for the purpose of making site upgrades at the
343	343	Eisenhower Birthplace State Historic Site, including a new visitor
344	344	center, landscaping improvements, improved entry to the site, and
345	345	enhancement to the overall appearance of the Eisenhower statue.
346	346	(b) The capital budget authority of the Texas Historical
347	347	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
348	348	Regular Session, 2021 (the General Appropriations Act), is
349	349	increased by $3,401,000 for the appropriation made under Subsection
350	350	(a) of this section.
351	351	(c) The capital budget authority of the Texas Historical
352	352	Commission in H.B. 1, Acts of the 88th Legislature, Regular
353	353	Session, 2023 (the General Appropriations Act), for the state
354	354	fiscal biennium beginning September 1, 2023, is increased by
355	355	$3,401,000 for the appropriation made under Subsection (a) of this
356	356	section.
357	357	SECTION 2.25. TEXAS HISTORICAL COMMISSION: MONUMENT HILL
358	358	STATE HISTORIC SITE. (a) The amount of $4,300,000 is appropriated
359	359	from the general revenue fund to the Texas Historical Commission
360	360	for the two-year period beginning on the effective date of this Act
361	361	for the purpose of building a new visitor center and incorporating
362	362	an open-air pavilion at the Monument Hill State Historic Site.
363	363	(b) The capital budget authority of the Texas Historical
364	364	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
365	365	Regular Session, 2021 (the General Appropriations Act), is
366	366	increased by $4,300,000 for the appropriation made under Subsection
367	367	(a) of this section.
368	368	(c) The capital budget authority of the Texas Historical
369	369	Commission in H.B. 1, Acts of the 88th Legislature, Regular
370	370	Session, 2023 (the General Appropriations Act), for the state
371	371	fiscal biennium beginning September 1, 2023, is increased by
372	372	$4,300,000 for the appropriation made under Subsection (a) of this
373	373	section.
374	374	ARTICLE 3. HEALTH AND HUMAN SERVICES
375	375	SECTION 3.01. HEALTH AND HUMAN SERVICES COMMISSION:
376	376	MEDICAID SHORTFALL. The amount of $2,935,300,000 is appropriated
377	377	from the general revenue fund, and the amount of $5,500,000,000 is
378	378	appropriated from federal funds, to the Health and Human Services
379	379	Commission for the state fiscal year ending August 31, 2023, for the
380	380	purpose of Medicaid client services under Goal A, Medicaid Client
381	381	Services, as listed in Chapter 1053 (S.B. 1), Acts of the 87th
382	382	Legislature, Regular Session, 2021 (the General Appropriations
383	383	Act).
384	384	SECTION 3.02. HEALTH AND HUMAN SERVICES COMMISSION: STATE
385	385	HOSPITALS AND CAPACITY. (a) The amount of $2,321,000,000 is
386	386	appropriated from the general revenue fund to the Health and Human
387	387	Services Commission for the two-year period beginning on the
388	388	effective date of this Act for the purpose of constructing state

430	430	School Fund No. 193 made to the Texas Education Agency by Chapter
431	431	1053 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021

433	433	biennium ending August 31, 2023, for Strategy A.1.1, Foundation
434	434	School Program - Equalized Operations, as listed in that Act, are

476	476	effective date of this Act for the purpose of responding to
477	477	previously occurring and future natural disasters, including
478	478	responding through the mobilization of ground and aviation
479	479	resources for fire suppression.
480	480	SECTION 4.05. UNIVERSITY OF TEXAS AT AUSTIN: TEXAS MEMORIAL
481	481	MUSEUM. (a) The amount of $8,000,000 is appropriated from the
482	482	general revenue fund to The University of Texas at Austin for the
483	483	two-year period beginning on the effective date of this Act for the
484	484	purpose of renovating the Texas Memorial Museum.
485	485	(b) The legislature finds that there is a demonstrated need
486	486	for the appropriation of general revenue funds for the purpose of
487	487	renovating the Texas Memorial Museum. The appropriation made by
488	488	this section is contingent on approval by two-thirds of each
489	489	chamber of the legislature, as required under Section 18(i),
490	490	Article VII, Texas Constitution.
491	491	SECTION 4.06. LAMAR INSTITUTIONS: DISASTER RESILIENCY
492	492	INFRASTRUCTURE. The following amounts totaling $24,500,000 are
493	493	appropriated from the ARPA fund to the following institutions for
494	494	the two-year period beginning on the effective date of this Act for
495	495	the purpose of creating disaster resiliency infrastructure at those
496	496	institutions:
497	497	(1) Lamar University: $10,000,000;
498	498	(2) Lamar State College - Port Arthur: $4,000,000;
499	499	(3) Lamar Institute of Technology: $4,000,000; and
500	500	(4) Lamar State College - Orange: $6,500,000.
501	501	SECTION 4.07. TEACHER RETIREMENT SYSTEM: BENEFIT
502	502	ENHANCEMENT. Contingent on the enactment of legislation by the
503	503	88th Legislature, Regular Session, 2023, relating to providing a
504	504	benefit enhancement for retired employees under the Teacher
505	505	Retirement System, and contingent on compliance with the
506	506	requirements regarding the amortization period of the unfunded
507	507	actuarial liabilities of the Teacher Retirement System under
508	508	Section 821.006, Government Code, the amount of $1,000,000,000 is
509	509	appropriated from the general revenue fund to the Teacher
510	510	Retirement System for the two-year period beginning on the
511	511	effective date of this Act for the purpose of providing a benefit
512	512	enhancement.
513	513	ARTICLE 5. PUBLIC SAFETY AND CRIMINAL JUSTICE
514	514	SECTION 5.01. TEXAS DEPARTMENT OF CRIMINAL JUSTICE: AGENCY
515	515	OPERATIONS. The amount of $237,200,000 is appropriated from the
516	516	general revenue fund to the Texas Department of Criminal Justice
517	517	for the two-year period beginning on the effective date of this Act
518	518	for the purpose of correctional security operations, staffing
519	519	adjustments, resumption of services at the Bradshaw State Jail, and
520	520	other agency operations expenses.
521	521	SECTION 5.02. TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
522	522	CORRECTIONAL MANAGED HEALTH CARE. The amount of $141,770,855 is
523	523	appropriated from the general revenue fund to the Texas Department
524	524	of Criminal Justice for use during the state fiscal year ending
525	525	August 31, 2023, for correctional managed health care under
526	526	Strategy C.1.9, Hospital and Clinical Care, as listed in Chapter
527	527	1053 (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021
528	528	(the General Appropriations Act).
529	529	SECTION 5.03. TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
530	530	DEFERRED MAINTENANCE SECURITY PROJECTS. (a) The amount of
531	531	$23,762,000 is appropriated from the general revenue fund to the
532	532	Texas Department of Criminal Justice for the two-year period
533	533	beginning on the effective date of this Act for the purpose of
534	534	addressing previously deferred maintenance of correctional
535	535	facilities' security.

547	547	SECTION 5.04. TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
548	548	TRAINING FACILITY. (a) The amount of $35,000,000 is appropriated
549	549	from the ARPA fund to the Texas Department of Criminal Justice for
550	550	the two-year period beginning on the effective date of this Act for
551	551	the purpose of constructing a training facility on land owned by the
552	552	department.
553	553	(b) The capital budget authority of the Texas Department of
554	554	Criminal Justice in Chapter 1053 (S.B. 1), Acts of the 87th
555	555	Legislature, Regular Session, 2021 (the General Appropriations
556	556	Act), is increased by $35,000,000 for the appropriation made under
557	557	Subsection (a) of this section.
558	558	(c) The capital budget authority of the Texas Department of
559	559	Criminal Justice in H.B. 1, Acts of the 88th Legislature, Regular
560	560	Session, 2023 (the General Appropriations Act), for the state
561	561	fiscal biennium beginning September 1, 2023, is increased by
562	562	$35,000,000 for the appropriation made under Subsection (a) of this
563	563	section.
564	564	SECTION 5.05. TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
565	565	VOCATIONAL TRAINING PROGRAM. The amount of $600,000 is
566	566	appropriated from the general revenue fund to the Texas Department
567	567	of Criminal Justice for the two-year period beginning on the
568	568	effective date of this Act for the purpose of implementing the
569	569	provisions of Chapter 1014 (H.B. 2352), Acts of the 87th
570	570	Legislature, Regular Session, 2021, relating to an educational and
571	571	vocational training pilot program to assist certain offenders in
572	572	finding jobs on release from incarceration or community
573	573	supervision.
574	574	SECTION 5.06. TEXAS DEPARTMENT OF PUBLIC SAFETY: BORDER
575	575	SECURITY. The amount of $47,300,000 is appropriated from the
576	576	general revenue fund to the Texas Department of Public Safety for
577	577	the two-year period beginning on the effective date of this Act for
578	578	the purpose of supporting the border security deployment for
579	579	Operation Lone Star.
580	580	SECTION 5.07. TEXAS JUVENILE JUSTICE DEPARTMENT:
581	581	REIMBURSEMENT TO COUNTIES. The amount of $9,720,960 is
582	582	appropriated from the general revenue fund to the Texas Juvenile
583	583	Justice Department for the two-year period beginning on the
584	584	effective date of this Act for the purpose of reimbursing counties
585	585	for the costs of holding juveniles for whom the department does not
586	586	have adequate capacity.
587	587	ARTICLE 6. NATURAL RESOURCES
588	588	SECTION 6.01. COMMISSION ON ENVIRONMENTAL QUALITY:
589	589	HAZARDOUS AND SOLID WASTE REMEDIATION. (a) Rider 24, page VI-24,
590	590	Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
591	591	Session, 2021 (the General Appropriations Act), to the bill pattern
592	592	of the appropriations to the Commission on Environmental Quality is
593	593	amended to read as follows:
594	594	24. Appropriations and Unexpended Balances: [from] Cost
595	595	Recovery for Site Remediation and Cleanups. (a) In addition to
596	596	amounts appropriated above, any unobligated and unexpended
597	597	balances as of August 31, 2021, (estimated to be $0) remaining in
598	598	the Hazardous and Solid Waste Remediation Fee Account No. 550 which
599	599	were received from responsible parties as cost recovery payments
600	600	for site remediation and cleanups undertaken by the Commission on

607	607	are appropriated from the Hazardous and Solid Waste Remediation Fee
608	608	Account No. 550 to the TCEQ for that biennium for site remediation
609	609	and cleanups.
610	610	(c) In addition to amounts appropriated above, $3,755,606
611	611	is appropriated from Hazardous and Solid Waste Remediation Fee
612	612	Account No. 550 to the TCEQ for the biennium beginning September 1,
613	613	2021, for site remediation and cleanups.
614	614	(b) Any unobligated and unexpended balances remaining as of
615	615	August 31, 2023, from appropriations made under Rider 24, page
616	616	VI-24, Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
617	617	Session, 2021 (the General Appropriations Act), to the bill pattern
618	618	of the appropriations to the Commission on Environmental Quality
619	619	are appropriated to the commission for the same purpose for the
620	620	two-year period beginning on the effective date of this Act.
621	621	SECTION 6.02. RAILROAD COMMISSION: PIPELINE TRANSPORTATION
622	622	AND STORAGE OF NATURAL AND OTHER GASES. (a) The amount of $541,000
623	623	is appropriated from the general revenue fund to the Railroad
624	624	Commission for the two-year period beginning on the effective date
625	625	of this Act for Strategy B.1.1, Ensure Pipeline Safety, as listed in
626	626	Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
627	627	Session, 2021 (the General Appropriations Act), and H.B. 1, Acts of
628	628	the 88th Legislature, Regular Session, 2023 (the General
629	629	Appropriations Act), to implement rule changes adopted by the
630	630	United States Department of Transportation Pipeline and Hazardous
631	631	Materials Safety Administration.
632	632	(b) During the two-year period beginning on the effective
633	633	date of this Act, in addition to the number of full-time equivalent
634	634	(FTE) employees other law authorizes the commission to employ
635	635	during that period, the Railroad Commission may employ out of money
636	636	appropriated by Subsection (a) of this section 10.0 full-time
637	637	equivalent (FTE) employees.
638	638	SECTION 6.03. PARKS AND WILDLIFE DEPARTMENT: PARK
639	639	ACQUISITION. (a) The amount of $100,000,000 is appropriated from
640	640	the general revenue fund to the Parks and Wildlife Department for
641	641	the two-year period beginning on the effective date of this Act for
642	642	Strategy D.1.2, Land Acquisition, as listed in Chapter 1053 (S.B.
643	643	1), Acts of the 87th Legislature, Regular Session, 2021 (the
644	644	General Appropriations Act), and H.B. 1, Acts of the 88th
645	645	Legislature, Regular Session, 2023 (the General Appropriations
646	646	Act), to acquire real property for use as state parks.
647	647	(b) The capital budget authority of the Parks and Wildlife
648	648	Department in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,

665	665	for the two-year period beginning on the effective date of this Act
666	666	for Strategy B.1.1, State and Federal Financial Assistance
667	667	Programs, as listed in Chapter 1053 (S.B. 1), Acts of the 87th
668	668	Legislature, Regular Session, 2021 (the General Appropriations
669	669	Act), and Strategy C.1.1, State and Federal Financial Assistance

721	721	35(c)(3), Chapter 995 (H.B. 2), Acts of the 87th Legislature,
722	722	Regular Session, 2021 (the Supplemental Appropriations Act), from
723	723	the general revenue fund to the Pension Review Board for the purpose
724	724	of the creation of a self-service portal to allow retirement
725	725	systems to access a secure reporting portal to upload reports and
726	726	view compliance status in real time (estimated to be $276,000) are
727	727	appropriated to the board for the same purpose for the two-year
728	728	period beginning on the effective date of this Act.
729	729	(b) The capital budget authority of the Pension Review Board

732	732	amount of the appropriation made under Subsection (a) of this

734	734	SECTION 8.03. FACILITIES COMMISSION: CAPITOL COMPLEX PHASE
735	735	I. (a) All unexpended and unobligated balances remaining as of the
736	736	effective date of this Act from appropriations made by Section 3,
737	737	Chapter 995 (H.B. 2), Acts of the 87th Legislature, Regular
738	738	Session, 2021 (the Supplemental Appropriations Act), from the
739	739	economic stabilization fund to the Texas Facilities Commission for
740	740	the purpose of providing interior finish out of new facilities

817	817	the effective date of this Act from appropriations made by Section
818	818	26, Chapter 10 (S.B. 8), Acts of the 87th Legislature, 3rd Called
819	819	Session, 2021 (the Supplemental Appropriations Act), from the ARPA
820	820	fund to the Texas Facilities Commission for the purpose of
821	821	constructing a 100-bed comprehensive behavioral health center to
822	822	serve the Permian Basin region (estimated to be $40,000,000) are
823	823	appropriated to the commission for the same purpose for the
824	824	two-year period beginning on the effective date of this Act.
825	825	(b) The appropriation under Subsection (a) of this section
826	826	is contingent on the completion of a signed agreement between the
827	827	Texas Facilities Commission and the Ector County and Midland County
828	828	Hospital Districts guaranteeing the ongoing operations of the
829	829	comprehensive behavioral health center described by that
830	830	subsection to ensure the construction and operation of the health
831	831	center will provide a continuing benefit to the residents of this
832	832	state.
833	833	(c) Subject to Subsection (b) of this section, all gifts or
834	834	grants made to the Texas Facilities Commission to support the
835	835	construction of the comprehensive behavioral health center
836	836	described by Subsection (a) of this section (estimated to be
837	837	$50,000,000) are appropriated to the commission for the two-year
838	838	period beginning on the effective date of this Act for the
839	839	construction of the center.
840	840	(d) The capital budget authority of the Texas Facilities
841	841	Commission in Chapter 1053 (S.B. 1), Acts of the 87th Legislature,
842	842	Regular Session, 2021 (the General Appropriations Act), is
843	843	increased by the amount of the appropriations made under this
844	844	section.
845	845	(e) The capital budget authority of the Texas Facilities
846	846	Commission in H.B. 1, Acts of the 88th Legislature, Regular
847	847	Session, 2023 (the General Appropriations Act), for the biennium
848	848	beginning September 1, 2023, is increased by the amount of the
849	849	appropriations made under this section.
850	850	SECTION 8.07. COMMISSION ON STATE EMERGENCY
851	851	COMMUNICATIONS: NEXT GENERATION 9-1-1 SERVICE FUND. All unexpended

1667	1667	SECTION 8.50. HEALTH AND HUMAN SERVICES COMMISSION:
1668	1668	STAFFING NEEDS. (a) All unexpended and unobligated balances
1669	1669	remaining as of the effective date of this Act from appropriations
1670	1670	made by Section 33, Chapter 10 (S.B. 8), Acts of the 87th
1671	1671	Legislature, 3rd Called Session, 2021 (the Supplemental
1672	1672	Appropriations Act), from the ARPA fund to the Health and Human
1673	1673	Services Commission for the purpose of providing funding to
1674	1674	administer one-time grants related to providing critical staffing
1675	1675	needs resulting from frontline health care workers affected by
1676	1676	COVID-19 as described by that section (estimated to be $0) are
1677	1677	appropriated to the commission for the same purpose for the

1683	1683	(the Supplemental Appropriations Act).
1684	1684	SECTION 8.51. TEXAS A&M UNIVERSITY AT GALVESTON: MARITIME
1685	1685	INFRASTRUCTURE PROJECT. (a) All unexpended and unobligated
1686	1686	balances remaining as of the effective date of this Act from
1687	1687	appropriations made by Section 59, Chapter 995 (H.B. 2), Acts of the
1688	1688	87th Legislature, Regular Session, 2021 (the Supplemental
1689	1689	Appropriations Act), from the general revenue fund to Texas A&M
1690	1690	University at Galveston for dock and other infrastructure
1691	1691	improvements needed to accept new and larger vessels from the
1692	1692	United States Department of Transportation and the United States
1693	1693	Maritime Administration (MARAD) (estimated to be $10,000,000) are
1694	1694	appropriated to the university for the same purpose for the
1695	1695	two-year period beginning on the effective date of this Act.
1696	1696	(b) The legislature finds that there is a demonstrated need
1697	1697	for the appropriation of general revenue funds for the purpose
1698	1698	described by Subsection (a) of this section. The appropriation made
1699	1699	by this section is contingent on approval by two-thirds of each
1700	1700	chamber of the legislature, as required by Section 18(i), Article
1701	1701	VII, Texas Constitution.
1702	1702	SECTION 8.52. HIGHER EDUCATION COORDINATING BOARD: TEXAS
1703	1703	CHILD MENTAL HEALTH CARE CONSORTIUM. (a) All unexpended and
1704	1704	unobligated balances remaining as of the effective date of this Act
1705	1705	from appropriations made by Section 8, Chapter 10 (S.B. 8), Acts of
1706	1706	the 87th Legislature, 3rd Called Session, 2021 (the Supplemental
1707	1707	Appropriations Act), from the ARPA fund to the Higher Education
1708	1708	Coordinating Board for the purpose of supporting the operations and
1709	1709	expansion of the Texas Child Mental Health Care Consortium to
1710	1710	expand mental health initiatives for children, pregnant women, and
1711	1711	women who are up to one year postpartum (estimated to be
1712	1712	$56,541,442) are appropriated to the coordinating board for the
1713	1713	same purpose for the two-year period beginning on the effective
1714	1714	date of this Act.
1715	1715	(b) At the direction of the Texas Child Mental Health Care
1716	1716	Consortium, the Higher Education Coordinating Board shall transfer
1717	1717	money appropriated under Subsection (a) of this section to
1718	1718	health-related institutions of higher education through
1719	1719	interagency contracts for:
1720	1720	(1) enhancements and expansion of the Child Psychiatry
1721	1721	Access Network;
1722	1722	(2) enhancements and expansion of the Texas Child
1723	1723	Access Through Telemedicine program;
1724	1724	(3) expansion of the child and adolescent mental
1725	1725	health workforce; and
1726	1726	(4) administrative expenses.
1727	1727	(c) The Texas Child Mental Health Care Consortium may
1728	1728	transfer money allocated for a purpose described by Subsection
1729	1729	(b)(1), (2), or (3) of this section to any other purpose described
1730	1730	by those subdivisions, except that a transfer of more than 10
1731	1731	percent of the money allocated for one of those purposes may be made
1732	1732	only with the prior approval for the transfer and expenditure from
1733	1733	the Legislative Budget Board. A request for approval of the
1734	1734	transfer and expenditure by the consortium is considered approved
1735	1735	unless the Legislative Budget Board issues a written disapproval
1736	1736	within 10 business days of the receipt and review of the request by
1737	1737	the Legislative Budget Board.
1738	1738	(d) Out of money appropriated by Subsection (a) of this
1739	1739	section, the Texas Child Mental Health Care Consortium may enhance
1740	1740	the Child Psychiatry Access Network to improve perinatal mental
1741	1741	health services.
1742	1742	SECTION 8.53. TEXAS DIVISION OF EMERGENCY MANAGEMENT: STATE
1743	1743	OPERATIONS CENTER. All unexpended and unobligated balances
1744	1744	remaining as of the effective date of this Act from appropriations
1745	1745	made by Section 9, Chapter 10 (S.B. 8), Acts of the 87th
1746	1746	Legislature, 3rd Called Session, 2021 (the Supplemental
1747	1747	Appropriations Act), from the ARPA fund to the Texas Division of

1925	1925	disease pandemic (estimated to be $15,000) are appropriated to the

1939	1939	the general revenue fund and the Oil and Gas Regulation and Cleanup

2012	2012	(S.B. 8), Acts of the 87th Legislature, 3rd Called Session, 2021
2013	2013	(the Supplemental Appropriations Act), from the ARPA fund to the
2014	2014	Department of Agriculture for the purpose of providing supplemental
2015	2015	funding to food banks in response to the coronavirus pandemic
2016	2016	(estimated to be $72,600,000) are appropriated to the department
2017	2017	for the purpose of providing supplemental funding to food banks for
2018	2018	the two-year period beginning on the effective date of this Act.
2019	2019	ARTICLE 9. MISCELLANEOUS PROVISIONS
2020	2020	SECTION 9.01. SALARY INCREASE FOR STATE EMPLOYEES. (a) In
2021	2021	this section, "salary increase" means:
2022	2022	(1) a 5.0 percent increase in monthly salary with a
2023	2023	minimum increase of $250 per month, effective July 1, 2023; and
2024	2024	(2) any related employee benefits costs associated
2025	2025	with the salary increase described by Subdivision (1) of this
2026	2026	subsection, including contributions required by Sections 17.03,
2027	2027	page IX-79, and 17.06, page IX-80, Chapter 1053 (S.B. 1), Acts of
2028	2028	the 87th Legislature, Regular Session, 2021 (the General
2029	2029	Appropriations Act).
2030	2030	(b) The amount necessary to pay for a salary increase for
2031	2031	all employee positions for state agencies paid according to the
2032	2032	Classification Salary Schedules listed in Section 2.01, Article IX,
2033	2033	Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
2034	2034	Session, 2021 (the General Appropriations Act), including employee
2035	2035	positions for the Higher Education Coordinating Board, Texas A&M
2036	2036	University System service agencies, and agencies funded under
2037	2037	Article X of that Act, for the period beginning July 1, 2023, and
2038	2038	ending August 31, 2023 (estimated to be an aggregate of
2039	2039	$99,157,791, of which $63,860,952 is estimated to be from the
2040	2040	general revenue fund, $5,713,926 is estimated to be from general
2041	2041	revenue dedicated accounts, $11,390,274 is estimated to be from
2042	2042	other state funds and accounts, and $18,192,639 is estimated to be
2043	2043	from federal funds), is appropriated to the comptroller of public
2044	2044	accounts for that period for the purpose of making those salary
2045	2045	increases.
2046	2046	(c) The amount appropriated under Subsection (b) of this
2047	2047	section includes money from the general revenue fund, general
2048	2048	revenue dedicated accounts, and other funds that is intended to
2049	2049	provide the salary increase described by that subsection for
2050	2050	certain employee positions currently paid from federal funds that
2051	2051	are not available for this purpose.
2052	2052	(d) Money appropriated under Subsection (b) of this section
2053	2053	may not be used to provide a salary increase for statewide elected
2054	2054	officials, justices or judges of the appellate and district courts,
2055	2055	district attorneys, criminal district attorneys, county attorneys
2056	2056	performing the duties of a district attorney, line item exempt
2057	2057	(non-classified) employees, employees of institutions of higher
2058	2058	education (other than employees of the Higher Education
2059	2059	Coordinating Board or a Texas A&M University System service
2060	2060	agency), or the compensatory per diem of board or commission
2061	2061	members.
2062	2062	(e) The provisions of Section 6.08, Article IX, Chapter 1053
2063	2063	(S.B. 1), Acts of the 87th Legislature, Regular Session, 2021 (the
2064	2064	General Appropriations Act), requiring salaries and benefits to be
2065	2065	paid proportionally from each source of funding are incorporated
2066	2066	into this section by reference and apply to the appropriation made
2067	2067	under Subsection (b) of this section. Each agency shall pay the
2068	2068	salary increase described by that subsection from funds held in the
2069	2069	state treasury and from local funds in the same proportion as the
2070	2070	employee's regular compensation is paid, unless the employee's
2071	2071	salary is paid from federal funds that are not available for that
2072	2072	purpose.
2073	2073	(f) The comptroller of public accounts shall adopt rules as
2074	2074	necessary to administer this section. The comptroller shall
2075	2075	allocate money appropriated under Subsection (b) of this section to
2076	2076	each agency, and to the appropriate employee benefit appropriation
2077	2077	items, in accordance with those rules.
2078	2078	(g) A state agency that receives money appropriated under
2079	2079	Subsection (b) of this section may not increase fees or taxes to
2080	2080	offset the appropriation. The amount necessary to provide the
2081	2081	salary increase described by that subsection for employees of a
2082	2082	state agency subject to a provision in Chapter 1053 (S.B. 1), Acts
2083	2083	of the 87th Legislature, Regular Session, 2021 (the General
2084	2084	Appropriations Act), limiting the amount appropriated to the agency
2085	2085	to revenues collected by the agency, is included in the amount
2086	2086	appropriated under that subsection. This subsection does not apply
2087	2087	to the Texas Department of Insurance.
2088	2088	(h) The salary increase provided under Subsection (b) of
2089	2089	this section applies to part-time employees hired pursuant to
2090	2090	Section 658.009, Government Code. For purposes of this section, in
2091	2091	computing the salary increase described by Subsection (b) of this
2092	2092	section for those part-time employees, the amount provided for each
2093	2093	employee must be proportional to the number of hours the employee
2094	2094	works per week as compared to a 40-hour work week.
2095	2095	(i) This section:
2096	2096	(1) applies to:
2097	2097	(A) all staff positions at the Windham School
2098	2098	District and the Texas Juvenile Justice Department; and
2099	2099	(B) the non-instructional staff positions at the
2100	2100	School for the Deaf and the School for the Blind and Visually
2101	2101	Impaired; and
2102	2102	(2) does not apply to the instructional staff
2103	2103	positions at the School for the Deaf and the School for the Blind
2104	2104	and Visually Impaired whose salaries are statutorily tied to the
2105	2105	salary schedule at the Austin Independent School District.
2106	2106	(j) It is the intent of the legislature that if this Act
2107	2107	becomes effective after July 1, 2023, the salary increase described
2108	2108	by Subsection (b) of this section should be calculated for the month
2109	2109	of July at a percentage that yields a 5.0 percent increase in each
2110	2110	employee position's salary for the month of July compared to the
2111	2111	employee position's salary for the month of June.
2112	2112	(k) The amount of a salary increase provided under this
2113	2113	section may not be considered in determining the amount of a salary
2114	2114	increase provided in H.B. 1, Acts of the 88th Legislature, Regular
2115	2115	Session, 2023 (the General Appropriations Act).
2116	2116	SECTION 9.02. MOTOR VEHICLE PURCHASES. (a) The following
2117	2117	amounts are appropriated from the specified sources to the
2118	2118	following agencies for use during the two-year period beginning on
2119	2119	the effective date of this Act for the purpose of purchasing motor
2120	2120	vehicles for the agency's use as authorized by general law:

2217	2217	Act), for the state fiscal biennium beginning September 1, 2023, is
2218	2218	increased by the amount of the appropriation made to the agency
2219	2219	under Subsection (a) of this section.
2220	2220	SECTION 9.03. LIMITATION, REPORTING, AND TRANSFER
2221	2221	PROVISIONS OF GAA INCORPORATED BY REFERENCE. The provisions
2222	2222	relating to limitations, reporting, or transfer of Article IX,
2223	2223	Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular
2224	2224	Session, 2021 (the General Appropriations Act), and of Article IX,
2225	2225	H.B. 1, Acts of the 88th Legislature, Regular Session, 2023 (the
2226	2226	General Appropriations Act), are incorporated into this Act by
2227	2227	reference and apply to the appropriations made by this Act.
2228	2228	ARTICLE 10. EFFECTIVE DATE
2229	2229	SECTION 10.01. EFFECTIVE DATE. (a) Subject to Subsections
2230	2230	(b) and (c) of this section, this Act takes effect immediately.
2231	2231	(b) Sections 8.03, 8.04, 8.08, 8.10, 8.11, 8.13, 8.14, 8.15,
2232	2232	8.25, 8.37, 8.40, 8.41, 8.42, and 8.68 of this Act take effect only
2233	2233	if this Act receives a vote of two-thirds of the members present in
2234	2234	each house of the legislature, as provided by Section 49-g(m),
2235	2235	Article III, Texas Constitution.
2236	2236	(c) Sections 4.05 and 8.51 of this Act take effect only if
2237	2237	this Act receives a vote of two-thirds of the members present in
2238	2238	each house of the legislature, as provided by Section 18(i),
2239	2239	Article VII, Texas Constitution.
