12 | 12 | | SECTION 1.01. DEFINITION. In this Act, "ARPA fund" means |
---|
13 | 13 | | money received by this state from the Coronavirus State Fiscal |

14 | 14 | | Recovery Fund (42 U.S.C. Section 802) established under the |
---|
15 | 15 | | American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited |

16 | 16 | | to the credit of the Coronavirus Relief Fund No. 325. |

54 | 54 | | $400,000,000 from the general revenue fund to the deferred |

55 | 55 | | maintenance account number 5166 to be used for the purpose of |
---|
56 | 56 | | addressing future maintenance of state buildings as directed by the |
---|
57 | 57 | | legislature. |
---|
58 | 58 | | SECTION 2.06. FACILITIES COMMISSION: LIBRARY AND ARCHIVES |
---|
59 | 59 | | COMMISSION FACILITY. (a) The amount of $210,000,000 is |
---|
60 | 60 | | appropriated from the general revenue fund to the Texas Facilities |
---|
61 | 61 | | Commission for the two-year period beginning on the effective date |
---|
62 | 62 | | of this Act for the purpose of constructing a new facility to be |
---|
63 | 63 | | used by the Library and Archives Commission for records and archive |
---|
64 | 64 | | storage. |
---|
65 | 65 | | (b) The General Land Office, the Texas Facilities |

2020 | 2020 | | SECTION 9.01. SALARY INCREASE FOR STATE EMPLOYEES. (a) In |

2028 | 2028 | | the 87th Legislature, Regular Session, 2021 (the General |

2029 | 2029 | | Appropriations Act). |

2030 | 2030 | | (b) The amount necessary to pay for a salary increase for |
---|
2031 | 2031 | | all employee positions for state agencies paid according to the |
---|
2032 | 2032 | | Classification Salary Schedules listed in Section 2.01, Article IX, |
---|
2033 | 2033 | | Chapter 1053 (S.B. 1), Acts of the 87th Legislature, Regular |

2034 | 2034 | | Session, 2021 (the General Appropriations Act), including employee |
---|
2035 | 2035 | | positions for the Higher Education Coordinating Board, Texas A&M |

2036 | 2036 | | University System service agencies, and agencies funded under |

2037 | 2037 | | Article X of that Act, for the period beginning July 1, 2023, and |

2048 | 2048 | | revenue dedicated accounts, and other funds that is intended to |

2049 | 2049 | | provide the salary increase described by that subsection for |
---|
2050 | 2050 | | certain employee positions currently paid from federal funds that |
---|
2051 | 2051 | | are not available for this purpose. |
---|
2052 | 2052 | | (d) Money appropriated under Subsection (b) of this section |
---|
2053 | 2053 | | may not be used to provide a salary increase for statewide elected |
---|
2054 | 2054 | | officials, justices or judges of the appellate and district courts, |
---|
2055 | 2055 | | district attorneys, criminal district attorneys, county attorneys |
---|
2056 | 2056 | | performing the duties of a district attorney, line item exempt |
---|
2057 | 2057 | | (non-classified) employees, employees of institutions of higher |
---|
2058 | 2058 | | education (other than employees of the Higher Education |
---|
2059 | 2059 | | Coordinating Board or a Texas A&M University System service |
---|
2060 | 2060 | | agency), or the compensatory per diem of board or commission |
---|
2061 | 2061 | | members. |
---|
2062 | 2062 | | (e) The provisions of Section 6.08, Article IX, Chapter 1053 |
---|
2063 | 2063 | | (S.B. 1), Acts of the 87th Legislature, Regular Session, 2021 (the |
---|
2064 | 2064 | | General Appropriations Act), requiring salaries and benefits to be |
---|
2065 | 2065 | | paid proportionally from each source of funding are incorporated |
---|
2066 | 2066 | | into this section by reference and apply to the appropriation made |
---|
2067 | 2067 | | under Subsection (b) of this section. Each agency shall pay the |
---|
2068 | 2068 | | salary increase described by that subsection from funds held in the |
---|
2069 | 2069 | | state treasury and from local funds in the same proportion as the |
---|
2070 | 2070 | | employee's regular compensation is paid, unless the employee's |
---|
2071 | 2071 | | salary is paid from federal funds that are not available for that |
---|
2072 | 2072 | | purpose. |
---|
2073 | 2073 | | (f) The comptroller of public accounts shall adopt rules as |
---|
2074 | 2074 | | necessary to administer this section. The comptroller shall |
---|
2075 | 2075 | | allocate money appropriated under Subsection (b) of this section to |
---|
2076 | 2076 | | each agency, and to the appropriate employee benefit appropriation |
---|
2077 | 2077 | | items, in accordance with those rules. |
---|
2078 | 2078 | | (g) A state agency that receives money appropriated under |
---|
2079 | 2079 | | Subsection (b) of this section may not increase fees or taxes to |
---|
2080 | 2080 | | offset the appropriation. The amount necessary to provide the |
---|
2081 | 2081 | | salary increase described by that subsection for employees of a |
---|
2082 | 2082 | | state agency subject to a provision in Chapter 1053 (S.B. 1), Acts |
---|
2083 | 2083 | | of the 87th Legislature, Regular Session, 2021 (the General |
---|
2084 | 2084 | | Appropriations Act), limiting the amount appropriated to the agency |
---|
2085 | 2085 | | to revenues collected by the agency, is included in the amount |
---|
2086 | 2086 | | appropriated under that subsection. This subsection does not apply |
---|
2087 | 2087 | | to the Texas Department of Insurance. |
---|
2088 | 2088 | | (h) The salary increase provided under Subsection (b) of |
---|
2089 | 2089 | | this section applies to part-time employees hired pursuant to |
---|
2090 | 2090 | | Section 658.009, Government Code. For purposes of this section, in |
---|
2091 | 2091 | | computing the salary increase described by Subsection (b) of this |
---|
2092 | 2092 | | section for those part-time employees, the amount provided for each |
---|
2093 | 2093 | | employee must be proportional to the number of hours the employee |
---|
2094 | 2094 | | works per week as compared to a 40-hour work week. |
---|
2095 | 2095 | | (i) This section: |
---|
2096 | 2096 | | (1) applies to: |
---|
2097 | 2097 | | (A) all staff positions at the Windham School |
---|
2098 | 2098 | | District and the Texas Juvenile Justice Department; and |
---|
2099 | 2099 | | (B) the non-instructional staff positions at the |

2100 | 2100 | | School for the Deaf and the School for the Blind and Visually |
---|
2101 | 2101 | | Impaired; and |

2102 | 2102 | | (2) does not apply to the instructional staff |
---|
2103 | 2103 | | positions at the School for the Deaf and the School for the Blind |

2104 | 2104 | | and Visually Impaired whose salaries are statutorily tied to the |

2105 | 2105 | | salary schedule at the Austin Independent School District. |
---|
2106 | 2106 | | (j) It is the intent of the legislature that if this Act |
---|
2107 | 2107 | | becomes effective after July 1, 2023, the salary increase described |
---|
2108 | 2108 | | by Subsection (b) of this section should be calculated for the month |
---|
2109 | 2109 | | of July at a percentage that yields a 5.0 percent increase in each |
---|
2110 | 2110 | | employee position's salary for the month of July compared to the |
---|
2111 | 2111 | | employee position's salary for the month of June. |
---|
2112 | 2112 | | (k) The amount of a salary increase provided under this |
---|
2113 | 2113 | | section may not be considered in determining the amount of a salary |
---|
2114 | 2114 | | increase provided in H.B. 1, Acts of the 88th Legislature, Regular |
---|
2115 | 2115 | | Session, 2023 (the General Appropriations Act). |
---|
2116 | 2116 | | SECTION 9.02. MOTOR VEHICLE PURCHASES. (a) The following |
