66 AN ACT
77 relating to prohibiting public institutions of higher education
88 from requiring diversity training as a condition for enrollment or
99 registration.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1212 amended by adding Section 51.9319 to read as follows:
1313 Sec. 51.9319. DIVERSITY TRAINING AS CONDITION OF ENROLLMENT
1414 OR REGISTRATION PROHIBITED. (a) In this section, "institution of
1515 higher education" has the meaning assigned by Section 61.003.
1616 (b) An institution of higher education may not require a
1717 student to complete diversity training as a condition of:
1818 (1) enrolling at the institution; or
1919 (2) registering for any course or academic program
2020 offered by the institution.
2121 SECTION 2. This Act applies beginning with the 2023-2024
2222 academic year.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2023.
